I. IDENTIFYING INFORMATION
D. LEGAL BASIS :
Pursuant to Article IX, Section 2 (4) of the 1987 Philippine Constitution , the Commission on Election (COMELEC)
has the power to deputized law enforcement agencies and instrumentalities of the government for the exclusive
purpose of ensuring fees, orderly, honest, peaceful and credible elections.
The Department of Education (DepEd), is one of the national agencies deputized by COMELEC to ensure free,
orderly, honest, peaceful and credible elections, through the appointment of public school teachers to serve as
chairperson, poll clerk, and third member of the Electoral Board.
Republic Act No. 9369, the COMELEC has resolved to adopt a paper-based election system (AES) in connection
with the May 13, 2019 National and Local Elections by using a Vote Counting Machine (VCMs) in the voting,
counting, and transmission of election results from the precinct level, and the consolidation Canvassing System
(CCS) in the Canvassing/consolidation of the electronically transmitted election results from the
precinct/city/municipality/district/provincial board of canvassers.
