This office notice F.No,22-16/2004-CZA(422)(Vol.{AKW 1179/2017 dated 28.06.2017 Whereas, the recognition to the Great Golden Circus under Section 38H(1) of the Wildlife (Protection) Act, 1972 communicated vide letter F No.22-16/2004-CZA(422)M)/732 dated 11.10.2011 was valid up to 31.10.2012. Whereas, the Great Golden Circus was evaluated on 12.07.2016, by a team deputed by this Authority as per provisions laid down in Rule 6 of the Recognition ‘of Zoo Rules, 2009. Based on the evaluation report, having noted violation of the Recognition of Zoo Rules 2009, ‘Show Cause Notice dated 14.09.2016 was served on the operator of the Great Golden Circus. Subsequently, the reply filed by the operator of the Great Golden Circus was placed before the Technical Commitiee of this Authority in its 80" Meeting held on 04 11.2016 Whereas, after due deliberation, the Technical Committee noted failure of the Circus operater to comply with conditions stipulated by the Central Zoo Authority and decided to cancel recognition of Great Golden Circus. Meanwhile, the circus operator filed Writ Petition No.2707 of 2017 before the Hon'ble High Court of Bombay wherein the Hon'ble Court in its order dated 08.03.2017 set aside the CZA’s order dated 07.12.2016, with observation that the CZA should have carried out surprise check to re-examine the situation before passing the order dated 07.12.2016 and directed the Central Zoo Authority to carry out inspection of the Great Golden Circus within a period of four weeks and to pass an order after hearing the petitioner. ‘Whereas, in compliance with directives of the Hon'ble Court, the Central Zoo Authority vide order dated 15.03.2017 has constituted following Committee to carty out evaluation of ‘captive animal facility’ of the Great Golden Circus: Or. Pethe, Veterinary Officer, Sanjay Gandhi National Park-Zoo, Borivali— Member and Co-ordinator oaene Whereas, the Committee constituted by the CZA carried out evaluation of the Great Golden Circus camped at General Arun Kumar Vaidhya Maidan, Gorai Road, Near MHB Colony, Borivali (West), Mumbai on 16” March, 2017 and submitted ils repor. Whereas, the inspection report of the Great Golden Circus was placed before the Technical Committee of the Central Zoo Authority, in its 83” meeting held on 19” May, 2017 The Technical Committee, after due deliberation, decided to serve Show Cause Notice to operator of the Great Golden Circus as per provisions laid under Section 38H(6) of the Wildife (Protection) Act, 1972, for violation of Recognition of Zoo Rules, 2009. The Committee has also decided to obtain commitment from operator of the Circus on compliance with the Rules, in order to take a decision on renewal of recognition of the Circus for period beyond 31.40.2012. However, on request of the Manager, Great Golden Circus vide letter dated 24.07.2017, the hearing was post-poned to 07.08.2017, Whereas, a hearing was conducted by the undersigned as per provisions laid down under Section 38H(6) of the Wildlife (Protection) Act, 1972, on 07.08.2017 ‘Whereas, the representatives of the Great Golden Circus altended the hearing on 7" August, 2017, but they failed to produce documents in original for perusal. Subsequently, the Proprietor of the Great Golden Circus was provided ancther opportunity of hearing on 21.08 2017 Whereas, the reply submitted by operator of the Great Golden Circus to the Show Cause Notice through the SSPA Law Firm, Mumbai and corresponding remarks of this office is as follows: S$. The Committee has also decided to obtain commitment from operator of the Circus on compliance with the Rules, in order to take a decision on renewal of recognition of the Circus for period beyond 31.10.2012. Violation reported and recommendations of the evaluating officers are as follows 1. Failed to produce records on origin of two female elephants (Micro-chip numbers 0006586247 and 00065841CF) presently in possession of the Great Golden Circus, However, the owner claims that the elephants were procured from Sonpur Mela. This is in violation of provisions ‘aid dewn in Schedule 3(8) of Rule 10 under Recognition of Zoo Rules, 2009. The Circus operator has been directed oy the Central Zoo Authority vide letter F.No.22-16/2004-CZA(422)(M) dated 26.03.2009, F.No.22- 16/2004-CZA(422)(M) dated 10.08.2010 and F.No.22-16/2004-CZA(422)(M)/732 dated 11.10.2011 respectively, for compliance in this regard 2. Evaluators cbserved that limited movement of elephants is facilitated in view of their tethering, though the area available is as per minimum requirement prescribed by the CZA, The animal is not able to use the entire area provided it in view of tethering, Evaluators also observed that one of the elephants (Anar) threatened the other elephant (Champa), af the time of evaluation; it broke its cope and ran away. it was Stated that ‘apparently there is some discord between the two animals which when unattended by mahouts tends to aggravate into a dominance tussle’. It was observed by evaluating officers that the elephant namely ‘Anar showed mild Signs of stereotypic behaviour. This is in violaticn of provisions laid down in Schedule 4(3) of Rule 10 under Recognition of Zoo Rules, 2009. Non-compliance by the circus Operator indicates failure to ensure expression of nalural behaviour by the elephants in possession 4. The elechants were found to be obese indicating overfeeding and under exercise as the fat on the spinal ridge is complete giving #t round shape with no sign of nage being visible. This is in violation of provisions laid down in Schedule 4(3) of Rule 10 under Recognition of Zoo Rules, 2009. The Circus operator has been repeatedly directed by the Central Zoo Authority vide letter F.No.22-16(2004-CZA(422)(M) dated 12.10.2008. F.No.22-1612004-CZA(422\(M) dated 26.03.2009, F.No.22-16/2004- CZA(422)(M) dated 10.08.2010 and F.No.22-16/2004-CZA(422\(M)/732_ dated 11.10.2014 respectively, for compliance in this regard. Non-compliance by the circus operator indicates lack of skill and expertise in management of elephants in possession 5. Failed to maintain treatment records of elephants prior to 17" August, 2016 in format prescribed by the CZA. Further, observed that the visiting Veterinarian recorded “all is well” without recording any facts observed during clinical examination of the animals. The observation or examination record of temperature, pulse ete needs to be recorded by the Veterinarian at the time of examination of the animals. This is in Violation of srovisions laid down in Schedule (10) of Rule 10 under Recognition of Zoo Rules, 2009. The Circus operator has been repeatedly directed by the Central Zo Authority vide letter F.No.22-16/2004-CZA(422)(M) dated 12.10.2006, F.No.22- 16/2004-C2A(422)(M) dated 26.03.2008, F.No.22-16/2004-CZA(422)(M) dated 10.08.2010 and F.No.22-16/2004-CZA(422)(MV/732 dated 11.10.2011 respectively, for compliance in this regard. Therefore, for safety of the human beings and the animals the trangullizing equipment and drugs are essential to meet any unforeseen eventuality, although the circus is keeping femate elephants only. This is in violation of provisions laid down in Schedule 8(3) of Rule 10 under Recognition af Zoo Rules, 2009. The Circus operator has been repeatedly directed by the Central Zoo Authority vide letter F.No.22-16/2004-CZA(422)(M) dated 12.10 2008, F.No.22-16/2004- CZA(422)(M) dated 26.03.2008, F.No.22-16/2004-CZA(422\(M) dated 10.08.2010 and F.No.22-16/2004-CZA(422)(M)/732 dated 11.10.2011 respectively, for compliance in this regard. Non-compliance by the circus operator is fiddling with risk of being unprepared to possibility of animal going out of control endangering human lives. The elepnant is being housed and used for performance in a place surrounded by the public. Therefore, for safety of the human beings and the animal the tranquilizing equipment and drugs are essential [o meet any unforeseen eventuality, although the circus is keeping female elephant only. Observed thal the space for walking of elephants is fimited and is an open ground approximately 100 x $0 meters, which is also used by children as play ground Evaluating officers opined that it is highly unlikely that even one hour of walking for elephants is possible. Moreover, it was stated by tHe circus people that the elephants are being given a walk in that area But, no evidences of dung or tracks were observed in the area, raising doubts that the elephants ere being given a.walk in that area. This is in violation of provisions taid down in Schedule 4(3) of Rule 10 under Recognition of Zoo Rules. 2009.
