PREAMBLE

We, the teachers and employees of Batac National High School,

Batac City, Ilocos Norte, invoking the aid of the Almighty God, desirous in
developing and maximizing our God-given talents and potentials to
promote professionals growth, pursue excellence, create a venue to ventilate
our ideas and aspirations, generate goodwill and camaraderie among ourselves,
In order to serve the people with the highest standard of dedication and
professionalism do hereby adopt and promulgate this Constitution By-Laws

organization where all members can exercise their rights and privileges.

ARTICLE I
NAME, DOMICILE AND LOGO

Section I. Name of the Association - The name of the association shall be the
TEACHERS AND EMPLOYEES ASSOCIATION (TEA).

Section 2. Domicile and Residence -The office of the association be initially

located at Batac National High School, Bungon Campus, Batac,
Ilocos Norte. However, the officers and members may meet at any of the
 Batac BNHS three campuses as it may deem fit and proper.
Section 3. The Official Logo -There shall be an official logo of the association
to be designed and deliberated by its members. The design, once adopted,
shall be registered and become the official seal of the association.
ARTICLE II
NATURE AND PURPOSES
Section 4. Nature -The association shall be civic, professional ,social, non-Political,
non sectarian and non-profit/non-stock in nature.
Section 5. Purposes -The association shall:
a. Provide assistance on administrative and personal matters.
b. Adopt and implement a fair and uniform interpretation and application
of personnel rules and policies consistent Civil Service Laws, Rules
and Procedure.
c. Serve as clearing house of information of Civil Service Rules and other
Administrative issuance. Stimulate the use of sound methods
of personnel management that will contribute to good government.
e. Source as a form to foster unity among all the members.
ARTICLE III
MEMBERSHIP
Section 6. Regular Members - Regular membership shall be open to all teachers
and employees of Batac NHS regardless of their present positions or
designations and the campus they are assigned.
ARTICLE IV
DUES AND FEES
Section 7. Membership and Monthly Dues - An annual fee of ten pesos (10.00)
and monthly due of five pesos (5.00) shall be collected from the members
as a source of fund for the association and the mode of payment shall be by
salary deduction.
Section 8. Health Aid. It shall be given to the Member and to his/her
Immediate Family Members, i.e., Legal Spouse, Legal/Biological Parents,
and Legal Children (whose names appear in the Member Data Sheet of the
Member), when anyone of them underwent medical treatments for the
purpose of combating physical or mental disorder.
a. MAJOR CASES. An amount of Php 15,000.00 shall be collected and
equally divided among the members as financial Health Aid provided
the member/immediate family members who underwent medical treatments
shall present medical abstracts/certificates and hospital bills for further
assessment by the Committee on, Rules Legislation and Legal Matters.
For a clearer understanding, the term MAJOR CASES refer to SERIOUS illnesses
with GREAT severity and are compulsive for chemotherapy, radiation, dialysis,
major surgical due to severe accidents.
b. MINOR CASES. An amount of Php 7, 000.000 shall be collected and
equally divided among the members as financial Health Aid provided
the member/immediate family members who underwent medical treatments
have had been confined for at least three days and shall present
medical abstracts/certificates and hospital bills for further assessment
by the Committee on Rules, Legislation and Legal Matters. For a clearer
understanding, the term MINOR CASES refer to illnesses with low severity
and are not necessarily compulsive for chemotherapy, radiation, dialysis,
major surgical operations due to severe accidents.
Section 9. DEATH AID. It shall be given to the member and to his/her
Immediate Family members, i.e., Legal Spouse, Legal/Biological Parents,
and Legal Children, and other five relative and or non-relative whose names
appear in the Member Data Sheet of the member.
a. An amount of 500.00 shall be collected from each member and
be given as Death Aid including wreath to the bereaved family if the
departed one is the member.
b. An amount of 200.00 shall be collected from each member and be
given as Death Aid including wreath to the bereaved family if the
departed one/s is/are the Immediate Family Members, i.e., Legal
 Spouse, Legal/Biological Parents, and Legal Children, and other five 2 months on a date, time and place they fix. The President, or in his absence,

Section 17.Powers and Duties of the President –In addition to the powers
and duties pertaining to the President, provided elsewhere in this
Constitution and By-Laws, the President shall have the following
duties and functions:
a) Exercise general supervision over the affairs of the association
and over its officers.
b) Sign with the secretary all deeds, agreements and other instruments,
except as otherwise provided by these Constitution and By-Laws,
or other resolutions duly adopted at any meeting of the association.
c) Preside in all meetings if or when he is present;
d) Approve and sign the minutes of all meetings and proceedings;
e) Countersign all disbursements made by the treasurer; and
f) Perform such other functions inherent in the position of a President.
Section 18.Powers and Duties of the Vice President –In the absence or temporary
disability of the President, the Vice President shall discharge all the functions
of the office of the President and those that may be assigned to him from
time to time, by virtue of resolutions duly adopted at any meeting.
Section 19. Powers Duties of the Secretary –The Secretary shall:
a) Issue all notices for all meetings and elections of the association
and be present thereat and keep the minutes of the meetings.
b) Have custody of books, reports of different committees, and such
other records that the association may keep;
c) Perform other duties incidental to his office.
Section 20. Powers and Duties of the Treasurer –The treasurer shall
have the following powers and responsibilities:
a) Be the custodian of all funds and properties of the association;
b) Collect and keep an accurate and up to date record book of all
receipts and expenditures, which shall be opened for inspection to
any member of the association any time during office hours.
c) Post bond for the faithful performance of his/her duties; and
d) Perform such other related functions.
Section 21. Powers and Functions of the Auditor –The auditor shall see to it
that all accounts and books of the association are properly kept. For this purpose,
he or she shall make full, detailed and periodic audit of all the funds and
accounts of the association and shall certify this to the President in a written
report. If the Auditor finds that the books and accounts are not properly kept
or any irregularity has been committed or believes to have been committed he
or she shall so report her or his findings and shall advice or make the
proper recommendation to the President. The latter shall call a special meetings
of the officers to initiate appropriate action to as the facts and circumstances
may warrant.
Section 22.Powers and Duties of the Business Manager –
The business manager shall take charge of all business affairs of the association.
Section 23.Powers and Duties of the Public Relations Officer –
The Public Relations Officer shall take charge in promoting good relations
between the association and the public.
Section 24:Powers and Duties of the Representative –
The Representative shall assist the Secretary in notifying or informing the
members about all meetings of the association. She or he shall coordinate
with the members she/he is representing.
ARTICLE VIII
MEETINGS OF THE GENERAL ASSEMBLY
Section 25.Monthly Meeting – As far as practicable, there shall likewise be a regular
meeting every 2 months of the General assembly to be fixed scheduled
by the members.
Section 26.Special Meetings – Special meetings of the General Assembly may be
called by the President at his discretion or on written petition of at least
(10) ten members.
Section 27.Minutes of the Meeting – The Secretary shall take the minutes of the
meeting and shall be systematically filed and kept as records of the business
transacted at the meetings.
ARTICLE IX
ELECTION
Section 28. Call and notice of Election- At least one (1) month before the expiration
of the term of elected officials, the Secretary shall send notice to all members
of the association calling for a regular election. The notice shall indicated
the time, place and date of the election. After notice of the election shall have
been sent to the members, the scheduled election cannot be postponed
unless other notice is given to all members not later than the one (1) week
before the previously scheduled election, except when the postponement is
due to lack of quorum as required in the immediately following section.
Section 29. Election quorum - Upon proof of proper notice to all the
members, as provided in the immediately preceding section, the
Secretary shall determine if there is a quorum; Provided that at least one half
one of all the members are present to constitute a quorum. In the absence of
a quorum or when there are less than one half + one of all the members,
those present may reset the time, date and place of the next election.
The group may adjourn from time to time until a quorum for election is satisfied.
Section 30. Election on a Regular Meeting- When there is no election due to
a failure to muster a quorum, the election may be held in the next regular
meeting every two months of the association upon the motion of any member
present during the originally scheduled election. No formal notice is necessary
for the purpose of election in this instance. The previous notice shall be
considered sufficient and due notice as required under Section 28.
Section 31. Voting - All members not otherwise disqualified by any provisions
of this Constitution and Bylaws are entitled to vote. Voting may be by viva
voice, by rising of hands or by secret balloting. However, should any members
request for secret balloting, then voting shall be by secret balloting. The
President is not entitled to vote but in case of a tie, he is the one responsible to
break it.
Section 32. Nomination of Candidates - Only members present during
the election and qualified to vote may be nominated to an elective office.
Candidates by proxy shall not be allowed even if the proxy presents a written
authority from an absent member.
Section 33. No Proxy Voting - A member who is absent during an election
cannot vote. Neither can an absent member authorize anyone to vote for him
or for another.
ARTICLE X
PERMANENT COMMITEES
Section 34. The Permanent Committees-The fallowing shall be standing
committees of the association:
a) Committee on Rules, Legislation & Legal Matters
 b) Committee on Membership AMELIA G. BUNYE
c) Committee on Finance Officer-in-Charge
d) Committee on Professional and Cultural Advancement Office of the School Principal IV
Each committee shall be composed of one Chairman and four members
of good standing.

Section 35. Submission of Annual Report of the Association -

All committees shall furnish the association an Annual Report of their
activities, an audited financial statement and other reports. The Association,
in turn, may furnish the administration of said reports.

Section 36. Amendments of the Constitution and Bylaws - A majority vote of
all the members of the association may propose and initiate amendments
of the Constitution and Bylaws. The amended Constitution and Bylaws shall
