CYBER TORTS : AN
INTRODUCTION

ABSTRACT

Noone will ever believe that computer and internet were invented to save our time! Just as
their usage is increasing day by day, crime related to that are also increasing by that pace.
CYBER TORT is a negligent or intentional act that injures someone in some or the other way.
The only difference between tort and a cyber tort is that the latter involves the usage of
technology. It is civil in nature, such as defamation committed online through computer by
someone. Although not defined or addressed as civil cyber cyber wrongs, the essence of civil
liability is defined under section 43 of the IT Act,2000. Hacking, theft, cyber stalking, identity
theft, malicious software, cyber pornography, online gambling, online disputes, fraud, cyber
terrorism etc. come under cyber wrongs. A cyber tort is the main part in the infringement of a
person’s right to privacy in the cyber world and also the real world. Digital revolution has been
both a boon and a curse. In order to deal with the wrongs happening with the cyber world, the
Information Technology Act was adopted in the year 2000. The main purpose of this act was to
provide legal recognition to facilitate electronic records with the government. India has many
law codified, but, with the ascension of the internet, came new legal issues related to it.

RESEARCH METHODOLOGY

SCOPE OF THE PROJECT

This proposed research work is mostly confined within the legal regime of cyber torts and
wrongs and its introduction. This research being a doctrinal and non-empirical type of research
has not required any collection of field data or sampling etc. however, knowing more about
torts related to cyber world would definitely show mirror and analyse various legislations in this
area and to explore the possibilities of a stricter legal framework. If cyber space is left
ungoverned, it will lead to hazardous end.

OBJECTIVE OF THE RESEARCH

The main objective is to specify e-danger. The objective of the research is to call attention to
the intimidating problems faced by the legal world. As a lot of people may unaware of the
wrongs that can happen online and are happening on a regular basis. The government should
devise a strategy to publicise the offences and penalties regarding them.

HYPOTHESIS

The cyber world has a different set of rules from that of the real world as a huse or a tiny nation
can incur a cyber technology capability for legitimate or even illegitimate reasons, even
terrorist organistaions like ISIS can nurture powerful cyber organisations by using social media
for their propaganda and have cyber units which can hack confidential information from
advanced nations, such as USA. India is new to the digital world and still needs some more time
to have a strong hand in the cyber world.it is hypothesized that the law has prohibited the
phenomenon of cyber crimes but the operation of the law has no preview over the cyber
criminals. Use of online services, such as social media, to tarnish your organisations’s image,
trademark infringement, illegal downloading or dissemination of intellectual property, having
domain names pillared in what is legally termed “conversion”. The cyber laws need to be more
strict and more governing. Basically, the youth of India is always diverted where something new
comes on, especially digitally. Measures should be taken like firewalls, frequent password
changing, frequent virus checks, email filters and safe surfing. Prevention is better than cure.
Awareness regarding education and technical support to prevent e-crime is essential, but
without discouraging the development of e-commerce. But these mechanisms are not sufficient
to check or control the cyber wrongs. There is however need to undertake research work on
the protection of the cyber crime from the different angle and so as to find out how it can be
minimized, with the use of internet.

What is the need of stricter cyber legislation?


Will cyber wrongs decrease after laws evolve?
How cyber terrorism also affects the nation in a whole?
How trolling and defaming on social media is a major issue?
