FACTS OF THE CASE:
That on 1:00 o‘clock in the afternoon on October 15, 2003, Barangay Captain Manuel
Adao of the Makati Anti-Drug Abuse Council –Cluster 2 received the information about
Rolly Soriaga’s unbridled selling of illegal drugs particularly at the streets of Arellano
and Bautista, Barangay Palanan, Makati City. A joint buy-bust operation was conducted
by the police head PO3 Montes together with Herminio Facundo and Leovino Perez
(MADAC representative). The above mentioned suspect which is Rolly Soriaga did and
there, willfully, unlawfully and maliciously selling prohibited drugs commonly known as
”Shabu”, found in his left side pocket in which he handed it over to Herminio Facundo
resulting to Rolly Soriaga’s under arrest and brought to the office of the Anti-Illegal
Drugs Special Operation Task Force for investigation. The evidence seized was turned
over to police investigator PO2 Reynaldo Juan. An examination was conducted on the
contents of the plastic sachet which tested positive for Methamphetamine
Hydrochloride.

AFFIDAVIT OF ARRESTING OFFICER
I, PO3 Henry Montes, of legal age, PNP member and assigned at Makati City
Police Station, Makati City, Metro Manila after having sworn to in the manner prescribed
by the law do hereby depose and say, that:
I am the same and identical person who causes the execution of this instrument
against Rolly Soriaga, of legal age, jobless and a resident of Arellano Street, Barangay
Palanan, Makati City for violating Sec. 5. Sale, Trading, Administration, Dispensation,
Delivery, Distribution and Transportation of Dangerous Drugs and/or Controlled
Precursors and Essential Chemicals.
1. In the afternoon of October 15, 2003, an informant named Barangay Captain

Manuel Adao of the Makati Anti-drug Abuse Council – Cluster 2 (MADAC) arrived in
our station informing about ROLLY SORIAGA’s unbridled selling of illegal drugs on
Arellano and Bautista Streets, Barangay Palanan, Makati City ;
2. Thereafter, with the instruction ordered by our Chief of Police, accompanied by

MADAC representative Herminio Facundo and Leovino Perez, we conducted test buy
operation towards the suspect Rolly Soriaga. Herminio Facundo put into record in the
police blotter the noted test buy money one hundred peso bill with serial number
AC113423 that we are going to use during our test buy operation;
3. During our short briefing, I and Leovino Perez were being tasked to serve as
security position in a distance from the moment we arrived at the target area wherein
Herminio Facundo will act as buyer of shabu that will be introduced by our confidential
informant;
4. As we arrived at the Arellano and Bautista Streets, Barangay Palanan, Makati

City accompanied by our informant, Herminio Facundo went to the position of one
person standing on a tall and handsome identified as Rolly Soriaga wherein I and
Leovino Perez positioned ourselves a distance from them;
5. I saw Herminio Facundo in front of the person identified as Rolly Soriaga’s

having a conversation later on. I saw Rolly Soriaga took something out from his pocket
and gave it to Herminio Facundo wherein the latter also gave something to Rolly
Soriaga’s as an exchange;
6. After which, he (referring to Herminio Facundo) left the place and signaled us to
leave also. We all met at the police station and upon arrival thereat, I saw Herminio
Facundo put initial “HF” on the said one(1) piece sachet of suspected shabu and put it
into blotter as recorded by PO1 Mary Rose Ann Veña;
7. Afterwards, Herminio Facundo presented also the said one(1) piece of suspected
shabu with initial “HF” to PO2 Reynaldo Juan who in turn, made a request for the
conduct of laboratory examination of said specimen addressed to Crime laboratory
office at Makati City;
8. At about 1:30pm of same date, I together with MADAC representative Herminio
Facundo and Leovino Perez left the station bound to Crime laboratory office at Makati
City for laboratory examination purposes of said specimen. As we arrived thereat,
Herminio Facundo handed over the said specimen together with the request for
laboratory examination including the chain of custody form to PSI PRINCESS JOY
M.SIMON, Forensic Chemist of SOCO Makati City. The latter received all of it and
without any delay conducted laboratory examination. Few minutes after, she handed to
Herminio Facundo the result with conclusion that the said specimen which the latter
brought to their office for laboratory examination positively contained methamphetamine
hydrochloride;
9. As Herminio Facundo handed the result, we left the place and returned to our
station and thereafter put it into record the events to the blotter book. I informed our
Chief of Police with regards to the result and the latter ordered us to launch a buy bust
operation towards the suspect Rolly Soriaga;
10. A short briefing ensued and during that time, I was tasked to be the arresting
officer and Herminio Facundo as the poseur buyer/seizing officer while Leovino Perez
also tasked to be one of the seizing officers. I was also designated to be the personnel

made a cellphone call to the PDEA informing about the buy bust operation that we will
be conducting, who in turn gave us the pre-ops coordinating number 40005-133127-
0546. Pre-arranged signal was also been discussed wherein Herminio Facundo will
throw a lighted cigarette when the sale is consummated. Herminio Facundo requested
the desk officer PO1 Mary Rose Ann Veña to put on record the one hundred peso bill as
our noted buy bust money with serial number AC221597. Buy bust operation followed;
11. Accompanied by the MADAC representative Herminio Facundo and Leovino

Perez, we went to the target area and upon arrival thereat, I and Leovino Perez
positioned ourselves a distance from Herminio Facundo and our confidential informant
.Herminio Facundo and our confidential informant were in front of Rolly Soriaga, I saw
them having short conversation and later on Rolly Soriaga took something from his front
pocket and subsequently, I saw Herminio Facundo throw a lighted cigarette as our pre-
arranged signal , after which , I and Leovino Perez went closer to their position arrested
Rolly Soriaga for violating Republic Act 9165 and apprised to him the constitutional
rights. After which, I commanded Leovino Perez to empty the pockets of Rolly Soriaga
and recovered the 100 peso bill served as the marked money.
12. I shouted “CLEAR!” and after my announcement, I noticed that Honorable City
Prosecutor Ellyn Mae P. Moreno, Media representative Jade Abe Awing of DZMM radio
station and City Counselor Mary Rose Ann S. Vena arrived accompanied by other PNP
personnel. So then, in their presence and in the presence of Rolly Soriaga, we
conducted physical inventory of seized drug evidences and had been photographed by
investigator SPO1 Enrico Manuel. After which, marking of evidences ensued in the
presence of the aforementioned witnesses and the suspect himself wherein Herminio
Facundo put initial “RSD” on one(1) piece sachet of believed to be containing shabu
which was the object of sale which Herminio Facundo took from the possession of the
suspect Rolly Soriaga. Leovino Perez also put his initials on the seized 100 peso bill
marked as “LP”. SPO1 Enrico Manuel took photographed during marking of evidences;
13. Herminio Facundo and Leovino Perez give the said drug evidences to me and
upon our arrival in police station, I blotter the events and proceeded to invest section for
proper disposition of case .Afterwards, I turned over to police investigator PO2
Reynaldo Juan the said seized evidences.

I, Herminio Facundo, of legal age, MADAC Representative of Makati Anti-Drug

Abuse Council-Cluster 2, after having sworn to in the manner prescribed by the law do
hereby depose and say, that:
against Rolly Soriaga, of legal age, jobless and a resident of Arellano Street, Barangay
Palanan, Makati City for violating Sec. 5.Sale, Trading, Administration, Dispensation,
Manuel Adao of the Makati Anti-drug Abuse Council – Cluster 2 (MADAC) arrived in the
station informing about ROLLY SORIAGA’s unbridled selling of illegal drugs on Arellano
and Bautista Streets, Barangay Palanan, Makati City ;
2. Thereafter, with the instruction ordered by the Chief of Police, accompanied by
PO3 Henry Montes and my co-representative Leovino Perez. We conducted test buy
operation towards the suspect Rolly Soriaga. I put into record in the police blotter the
noted test buy money one hundred peso bill with serial number AC113423 that we are
going to use during our test buy operation;
3. During our short briefing, I arrived at the target area wherein I will act as a poseur
buyer of the said illegal drug commonly known as shabu that will be introduced by our
informant;
City accompanied by our informant, I went to the position of one person standing on a
tall and handsome identified as Rolly Soriaga wherein I was introduced to Rolly Soriaga
by our informant;
5. I’m in front of the person identified as Rolly Soriaga having a conversation with
him. Afterwards, Rolly Soriaga asks how much would I buy and I say “piso lang” which
refer to 100 peso bill then suddenly Rolly Soriaga took the one hundred peso bill from
me and placed it in his front pocket. Instantaneously, Soriaga took out a plastic sachet
with crystalline substance from his left pocket and gave it to me.
6. after which, I left the place and signaled PO3 Montes and Leovino Perez to leave
also. We all meet at the police station and upon arrival thereat, I put initial “HF” on the
said one(1) piece sachet of suspected Shabu and put it into blotter as recorded by PO1
Monick Porcadilla ;
7. Afterwards, I presented also the said one (1) piece of suspected shabu with initial
“HF” to PO2 Reynaldo Juan who in turn, made a request for the conduct of laboratory
examination of said specimen addressed to Crime laboratory office at Makati City;
8. At about 1:30pm of same date, I together with Leovino Perez and PO3 Montes
left the station bound to Crime laboratory office at Makati City for laboratory examination
purposes of said specimen. As we arrived thereat, I handed over the said specimen
together with the request for laboratory examination including the chain of custody form
to PSI PRINCESS JOY M.SIMON, Forensic Chemist of SOCO Makati City. The latter
received all of it and without any delay conducted laboratory examination. Few minutes
after, I handed the result with conclusion that the said specimen which the latter brought
to their office for laboratory examination positively contained methamphetamine
hydrochloride;
9. I handed the result, we left the place and returned to the station and thereafter
put it into record the events to the blotter book. PO3 Montes informed the Chief of
Police with regards to the result and the latter ordered us to launch a buy bust operation
towards the suspect Rolly Soriaga;
10. A short briefing ensued and during that time, PO3 Henry Montes tasked me as
the poseur buyer while Leovino Perez was also tasked to be one of the seizing officers.
Same mode of operation during test buy will be conducted.PO3 Henry Montes made a
