EXPLANATION OF EXEMPTIONS

SUBSECTIONS OF TITLE 5, UNITED STATES CODE, SECTION 552

(b)(1) (A) specifically authorized under criteria established by an Executive order to be kept secret in the interest of national defense or foreign
policy and (B) are in fact properly classified to such Executive order;

(b)(2) related solely to the internal personnel rules and practices of an agency;

(b)(3) specifically exempted from disclosure by statute (other than section 552b of this title), provided that such statute (A) requires that the
matters be withheld from the public in such a manner as to leave no discretion on issue, or (B) establishes particular criteria for withholding
or refers to particular types of matters to be withheld;

(b)(4) trade secrets and commercial or financial information obtained from a person and privileged or confidential;

(b)(5) inter-agency or intra-agency memorandums or letters which would not be available by law to a party other than an agency in litigation with
the agency;

(b)(6) personnel and medical files and similar files the disclosure of which would constitute a clearly unwarranted invasion of personal privacy;

(b)(7) records or information compiled for law enforcement purposes, but only to the extent that the production of such law enforcement records
or information ( A ) could reasonably be expected to interfere with enforcement proceedings, ( B ) would deprive a person of a right to a
fair trial or an impartial adjudication, ( C ) could reasonably be expected to constitute an unwarranted invasion of personal privacy, ( D )
could reasonably be expected to disclose the identity of confidential source, including a State, local, or foreign agency or authority or any
private institution which furnished information on a confidential basis, and, in the case of record or information compiled by a criminal law
enforcement authority in the course of a criminal investigation, or by an agency conducting a lawful national security intelligence
investigation, information furnished by a confidential source, ( E ) would disclose techniques and procedures for law enforcement
investigations or prosecutions, or would disclose guidelines for law enforcement investigations or prosecutions if such disclosure could
reasonably be expected to risk circumvention of the law, or ( F ) could reasonably be expected to endanger the life or physical safety of any
individual;

(b)(8) contained in or related to examination, operating, or condition reports prepared by, on behalf of, or for the use of an agency responsible for
the regulation or supervision of financial institutions; or

(b)(9) geological and geophysical information and data, including maps, concerning wells.

SUBSECTIONS OF TITLE 5, UNITED STATES CODE, SECTION 552a

(d)(5) information compiled in reasonable anticipation of a civil action proceeding;

(j)(2) material reporting investigative efforts pertaining to the enforcement of criminal law including efforts to prevent, control, or reduce crime
or apprehend criminals;

(k)(1) information which is currently and properly classified pursuant to an Executive order in the interest of the national defense or foreign
policy, for example, information involving intelligence sources or methods;

(k)(2) investigatory material compiled for law enforcement purposes, other than criminal, which did not result in loss of a right, benefit or
privilege under Federal programs, or which would identify a source who furnished information pursuant to a promise that his/her identity
would be held in confidence;

(k)(3) material maintained in connection with providing protective services to the President of the United States or any other individual pursuant
to the authority of Title 18, United States Code, Section 3056;

(k)(4) required by statute to be maintained and used solely as statistical records;

(k)(5) investigatory material compiled solely for the purpose of determining suitability, eligibility, or qualifications for Federal civilian
employment or for access to classified information, the disclosure of which would reveal the identity of the person who furnished
information pursuant to a promise that his/her identity would be held in confidence;

(k)(6) testing or examination material used to determine individual qualifications for appointment or promotion in Federal Government service

(k)(7) material used to determine potential for promotion in the armed services, the disclosure of which would reveal the identity of the person
who furnished the material pursuant to a promise that his/her identity would be held in confidence.

New York file 100-151~5, indicates that one Charles Bukowski,
poet, was the author of an article appearing on page 43 of the
June, 1963, issue of "llaiutreaa." It was indicated that
Charles Bukowski could oot be further identified at that time.

The Best of the Underground Press," Volume 1, published by the
Underground Oomaunications, Inc., P. 0. Box 211, Village Station,
Mew York, Hew York 10014, telephone 11 7-6900, contains an
article by Charles Bukowski on pages 76-79 entitled "Notes of a
Dirty Old Man." Page 79 indicates that the writer's name may b e
Henry Charles Bukowski. The publication indicates at the end
of the article on page 79 that the article may have originally
appeared in "Open City" 5420 Carlton Way, lmi Angeles, California,
90027; $5 per year. Singie copies of the article "Notes of
a Dirty Old Man" together with a copy of the masthead of the
Underground Digest are enclosed for New York and Los Angeles

and crying and grabbed that dead head and 'tissed it. they had to pull her off. then when
Henry came down the steps tlus Shnley grabbed lum and started klSsing him, "oh, you look
JUSt like your father!" he got hot as she kissed him and when he shoved her off something
was showing through his pants. he hoped the people didn't notice. he made a note to check
Shirley out. she wasn 1 t much older than he. he went from the fuqeral to the track, but no
high yellow thu time. and he also lost some money. the old man had left his shgma on
him.
the lawyer sa1d no will had been left. there was no money but thel:'e was a house and a
car. Henry wasn't working so he moved right in. and drank. drank w1th his old girlfriend
Maggy. he'd get up about noon and water the damned lawn. and the flowers. the old man
liked flpwers. he watered the flowers . he stood there hungover, remembenng how the old
man had hated him because Henry didn't hke to work, JUSt drink and lay up with women.

under his pants. the pulpit, luckily, hid this sechon of him from Vlew. he had to ~ook out the wmdow
and keep talklng until the trung under hu pants went away.
Harry lost hlS Job. Henry sold the house. the preacher made 1t with Maggy. Slurley married a tv
repairman. Harry sat around looking at the empty cages and the birds starved and died m the streets.
every time he saw another dead bird he beat his wife agun. Henry gambled and drank away the•money
from the house in 6 months.

The June 1963 issue of uMainstream 11 contains an


article entitled 11 liTTLE MMlGAZINES IN AMERICA: CONCLUSION
OF SYMPOSIUM", beginning on page 38, which sets forth, in
part, the following editor's notes of explanation:
"With these few last contributions we bring our
Little Mag symposium to a close. We would like to thank our
Contributing editor, Walter Lowenfels, whose fertile imagina-
tion conceived the thing. For those who would like to review
what writers and editors in the thick of the little magazine
movement think, we refer them to the November and December
1962 Mainstreams. All told, we received sixteen responses 1
and, with this issue, met our promise of publishing everyone '
who replied to walter Lowenfels original questionnaire.
Little re-editing was done because, we discovered, little
magazine writers are developing a language of their own,
coining new words, deliberately mispelling others. Charles
Bukpwski's reply is the only one which we have censored- for
obscenity, and there only in a few places. We have let most
of the contributors swear their heads offe ~ut Mr. Bukowski,

Fairmount Motor Products Company, Inc.
1800 west Indiana Avenue
Philadelphia, Pa.
On March 14, 1968, Mr. Vice
President, Fairmount Motor Products Company, Inc., advised
that the company was formerly located at Fairmount Avenue and
16th Street in Philadelphia. He stated that he does not
recall the employee but Mr.l ladded that he was on
a military leave from the c ompany during the period 1942 through
194~. He stated that the company personnel records do not go
back as far as 1945 and he advised that the re is no current b6
employee who would be in a position to recall HENRY BUKOWSKI. b7C

on March 14, 1968 , Mr. I I Realtor, 555
North 17th Street, advised that he does not recall the employee.
Mr. I lexplained that many buildings in the ne ighborhood
have been purchased by the Urban Renewal Association in
Philadelphia and that some of the buildings have al r eady been
demolished. He stated that as a result of this program by the
Urban Renewal Association most of the peyple have moved and
that many of the houses are vacant. Mr._ Jadded that
the neighborhood has changed completely since 19 2 and that
he felt confident that there is no one in the neighborhood
today who would have been there in the 1940s .

as the New Orleans Committee to End the War in Vietnam
(NOCEWV). The latter committee voted to change its name to
the NOMOS in the Spring of 1967, and a constitution prepared
for it specified that it was an affiliate of the Students
for a Democratic Society (SDS).

STUDENTS FOR A DE\lOCRATIC SOCIETY

The Students for a Democrat1c Society (SDS), as


it is lmown today, came ~nto be1ng at a founding convent1on
held at Port Huron , M1ch1gan , 1n June, 1962 . The SDS is
an assocat1on of young people on the left and has a current
program of protest1ng the draft, promot1ng a campa1gn for
youth to develop a consc1ent1ous obJector status, denounc1ng
Un1ted States 1ntervent1on 1n the war in V1etnam and to
"radically transform" the un1vers1ty commun1ty, and provide
for 1ts complete control by students . Gus Hall, General
Secretary, Commun1st Party, USA, when 1nterviewed by a repre-
sentative of United Press Internat1onal 111 San Franc1sco,
Cal1torn1a, on May 14, 196~ 1 descr1bed the SDS as a part of
the "respons1blc left" wh1ch the Party has "going for us."
At the June, 1965, SDS Nat1onal Convent1on, an antl.-
Communist prov1so was removed from the SDS const1tution.

In the October 7, 1966, 1ssue of "New Left Notes",


the offl.L~al publicat1on of SDS, an SDS spokesman stated
that there are some Commun1sts 111 SDS and they are welcome.
The n a t1onal headquarters of th1s organ1zat1on, as of
Apr11 18, 1967, was located 1n Room 206, 1608 West Mad1son
Street, Ch1cago, Ill1no1S .

On March 14, 1968, a file pertaining to the employee
at the Bureau of Personnel Investigations Civil Service
Commission was reviewed and no additional pertinent information
was noted.
Records of the Passport Office, United States
Department of State (USDS), reviewed by SAl I
on April S, 1968, contained a Report of Birth of HENRY CHARLES
BUKOWSKI, JR. This report disclosed that BUKOWSKI was born
August 16, 1920, in An~ach, Germany. His parents were
listed as HENRY CHARL UKOWSKI, born in Pasedena, California,
whose occupation was ntracting business, th~re~g rn
.~affendorf. Hoch Strasse 40, Germany, and KA~RI~ETT­
~UKOWSKI born Weissentyrm., ,Germany. According to ....the record,
the fat r or the employee was then employed in a civilian
capacit by the Rents Requisitions and Claims Service of the

Reference Service Branch, Federal Records Center, made avall-
able the U. s. Attorney's, Eastern Distr1ct of Louis1ana, File
#12974, 1n Federal Records Center Conta1ner #12106, on HENRY
CHARLES BUKOWSKI, JR., which disclosed the follow1ng pertinent
information:

On June 21, 1944, Mrs.l I
Chief Clerk, b7C
Local Draft Board #2, New Orleans, Louisiana, submitted a
letter to the U. S. Attorney's Off1ce, New Orleans, Lou1s1ana,
ask1ng for ass1stance 1n getting Reg1strant BUKOWSKI exam1ned
by a Med1cal Advisory Board. This letter further adv1sed
the Registrant was reJected for M1l1tary Serv1ce on July 2,
1943, by reason of "Military Unsuitable Group 5". Pr1or to
report1ng, he advised Local Draft Board #2 by letter that he
d1d not have any 1ntentions of reporting for induct1on due to
his personal philosophy, and wanted to know JUSt what act1on
Local Draft Board #2 would take 1n v1ew of that 1nformat1on.
Local Draft Board #2 adv1sed him unless he reported,the matter
would be handled by the U. S. Attorney's Off1ce, New Orleans.
For several months following his reJect1on, the case
was not re-opened, but after the med1cal survey program was put
into effect, Local Draft Board #2, endeavored to have h1m
exam1ned by a Phychiatr1st, 10 order to determine if Registrant
was a malingerer.
On March 15, 1944, Local Draft Board #2, had been
unsuccessful 1n locat1ng Reg1strant at any of the various address-
es that was furnished to Local Draft Board #2. All ma1l was
returned "Uncla1med". Last address was Ph1ladelph1a, Pennsylvan1a.
On June 27, 1944, this case was referred to the FBI
Off1ce, New Orleans, Lou1siana, by the U. S. Attorney's Off1ce,
New Orleans, for 1nvestigat1on.
On August 7, 1944, the Reg1strant was exam1ned by
Armed Service Forces, Armed Forces Induct1on Station, 32nd
Street and Lancaster Avenue, Phlladelphia, Pennsylvania, by
I I Captain, Q.M.C. Induct1on Off1cer and was found
to be physically and mentally d1squal1f1ed for mil1tary service
and rejected for "Failing To Meet Medical Standards."

On August 25, 1944, the U. S. Attorney's Office,


New Orleans, Louis1ana, closed their case s1nce Registrant had
corrected his delinquency with Local Dratt Board #2, by report-
ing for Physical Exam1nation and found to1physlcally unfit for
m1litary service.
