LETTER OF AWARD

We are pleased to confirm acceptance of your quotation dated 25th Sept 2019 ref
no YKSB/2019/01/R01

Thus you shall enter into a contract with the Conditions of Contract using PAM
Contract 2006 Format.

And in addition subject to the following terms and conditions of tender and
documents, as follows: -

A. SUB CONTRACT SUM

1. The total contract sum shall be approximately at amounting RM 45,000.00


(Ringgit Malaysia: Forty Five Thousand Only) and all quantities is subject to
the total work done quantities basic and are provisional.

B. SCOPE OF WORK

1. You are deemed to do all necessary works as per listed on your quotation. Your
work shall be included with testing and commissioning, obtaining of operation
approval from the relevant authority strictly in accordance to the Main
Contractors’ work programme.

2. You are required to liaise and do coordination activities with our appointed
electrical contractor in completion your scope of work. But any decision is limit
to the approval of Main Contractors.
3. You are deemed to have noticed all requirements of our main contract with
regards to the date of completion of the project and you shall provide and do all
necessary to achieve the dateline.

4. The rate is fixed and not subject to adjustment due to either market escalation or
currency fluctuations.

5. You shall at all times keep on site a competent person in charge of supervising
the sub contract work and receiving instructions given to him by the Main
Contractor’s/ Consultant agent and responsible to inform the Contractor of any
changes made to aforesaid.

6. The Sub Contractor before proceeding with the work shall prepare in cooperation
with the Main Contractor/ Consultant and other trades a Schedule of Work. There
shall be complete cooperation with all other trades in matters of planning,
coordination and execution of work. Every reasonable effort shall be made to
prevent conflicts and other matters tending to obstruct or to delay the work of
other trades.

7. All extra costs incurred in working overtime shall be deemed to be included in the
Sub Contractor's rate.

8. The Sub Contractor is not entitled to any direct costs and/or expenses claim for
reduction or increase in the Sub Contract sum and any prolongation of the
contract period.

9. The Main Contractor reserves the right to bring in another party or to determine
the sub contract after giving notice to the sub contractor in the event that the Sub
Contractor fails to observe any of the provision hereof or of the Head Contract, its
terms, drawings, specifications and conditions. All the costs incurred by the Main
Contractor in effecting a substitution for or completion of the sub contract work
under this clause shall be deducted from any monies due or to become due to
the sub contract and any balance shall be as debt payable immediately to the
Main Contractor

10. All correspondence, drawings, instructions and other communication must be


with the Main Contractor and not directly with client or consultants (i.e. Engineer,
Quantity Surveyor). The Main Sub-Contractor will not be bound to recognize any
other indirect communication.

11. Illegal workers are prohibited. Sub-contractor hereby expressly agree covenant
and undertakes with the main-contractor not to engage any unlawful of illegal
foreign workers to carry out the construction works.

12. All foreign workers are required to have valid working permit from Immigration
Department of Malaysia All worker including foreign worker are required to have
valid green card from CIDB Malaysia.
C. MODE OF PAYMENT AND RETENTION

1. You shall submit to the Clients & relevant consultants for monthly progress claim
for work completed.

2. The honouring period of payment certificate is 30 days base on the amount


certified by Architect/M&E Engineer.

3. A retention sum of 10% of the total value certified to the maximum of 5% of total
sub-contract sum shall be retained from the total value of work done in all interim
payment. This retention shall be imposed throughout the contract period. The
retention money shall be released to you in two (2) moieties, the first 2.5% of
which shall become due and payable upon 6 months after the issuance of the
Certificate of Practical Completion. The second 2.5% shall be released to you
within thirty days after the issuance of the Certificate of making Good Defects.

D. INSURANCE

1. The Contractor’s All Risks and Workmen's Compensation policies to be borne


by the Main Contractor

E. DATE OF COMMENCEMENT AND COMPLETION

1. The Sub Contractor must perform his operations to such timings and sequence
as required by the Main Contractor's Programme. It shall be the sub-contractor
responsibility to constantly liase with the Main Contractor's agent to acquaint
himself with update programme requirement.

2. The Sub Contractor shall be responsible to monitor and maintain the progress of
work in accordance to the Main Contractor's programme.

3. We hereby instruct you to start works on 26th December 2019 (Thursday) as


this is your site possession date. However all drawing and documentation work
shall be start upon issuing this letter. You are require to complete all the works
within 1 months from the date possession.

F. LIQUIDATED AND ASCERTAINED DAMAGES (LAD)

The amount of Liquidated and Ascertained Damages shall be 10% per annum over
Contract price/day (Clause 19 of MEBPA) or any amount set by PRIMA Malaysia
G. ORDERING OR MATERIALS/EQUIPMENT

You shall immediately prepare a detailed list of major materials/equipment which are
required to be ordered for the approval of the M&E Engineer/Architect before placing
of firm orders. Particular care must be exercised in the selection of the
material/equipment in order to avoid any error which may unnecessarily delay the
completion of the Contract Work.

H. SITE SAFETY

You are to observe and comply with safety requirements at all times.
