THE CONSOLIDATED HOUSE RULES1


I
PRELIMINARY MATTERS

RULE 1. Title. This issuance shall be known as the “CHR.”

RULE 2. Applicability. The CHR shall be applicable in all classes being administered
by the professor or his duly authorized representative, and are without prejudice to existing rules
and regulations promulgated and enforced by MSEUF on the same or similar subject matter.
The latter shall still apply primarily to any and all affairs of the students specifically governed by
it, while the CHR shall be applicable in a suppletory manner. (04 August 2018)

RULE 3. Administrative Matters. For ease of administration and communication,


point persons called “beadles” shall be selected from the class with whom all readings, messages,
and other instructions shall be coursed through.

Section 3.1. Number. The number of beadles, which shall not be less than two
(2), shall depend on the total population of the class and on the opinion of the professor.

Section 3.2. Primary Duties and Responsibilities. Each beadle shall provide the
professor with the best means by which he or she can be contacted. Any and all concerns,
communication or correspondence from professor to students, and vice versa, shall be,
as far as practicable, coursed through the beadles. Furthermore, said beadles shall also
create a Facebook Group (classified as “secret”) and/or a Facebook Messenger Group
Chat (15 August 2019) wherein all members of the class, together with the professor,
must be included. However, only the professor and the beadles shall become
administrators thereof. This group shall be another medium by which all readings,
messages and instructions will be relayed to the class. In this regard, it is understood that
once the readings, messages and instructions are posted in the Facebook Group or
relayed to at least one of the beadles, all members of the group or class are deemed to
have been notified. (04 August 2018)

Section 3.3. Secondary Duties and Responsibilities. The beadles shall be responsible
for any other duties and responsibilities the professor may assign, designate or impose
upon him or her from time to time.

RULE 4. Academic Expectations. Students are, first and foremost, expected to comply
with all the academic requirements of MSEUF. In addition, students are required to:

which are required, explicitly or implicitly, by the course; and bring, at all times,
respective copies of the CHR, the Study Guide, or the relevant portions thereof, and all
mandatory references cited therein or declared to be such by the professor; (04 August

Section 4.2. Read and understand all assigned materials for the particular week
and perform satisfactorily in examinations.

EXAMINATIONS

RULE 5. Exam Types. Examinations, designed to test comprehension of the


assigned topics, will be both oral and written.

Section 5.1. Electronic Devices. Students’ use of any electronic device in class is
strictly prohibited, except during Oral Examinations when the student is not yet called
to recite or debate and only for purposes of obtaining, retrieving and/or storing
materials mentioned in Rule 4; provided, the electronic device shall be placed in silent
mode without vibration and that such use shall not be disruptive or distracting to either
the professor or the students.

Section 5.2. Sanctions. If at any time during class, any electronic device, for
whatever reason, produces any sound, either by itself or through its vibration, the owner
of which shall be given: a) a grade of 60% for Oral Examinations; or, b) a deduction of
ten (10) points from his or her grade for Written Examinations; provided, in the event the
owner of the electronic device does not or refuses to reveal his or her identity, all
students present shall be given the sanctions herein provided. (15 August 2019)

RULE 6. Oral examinations. These exams shall consist of recitations of and debates
among students during the class. The coverage of foregoing shall mainly be dependent on the
particular topic per week, but does not however exclude the possibility of reference to previous
topics for comparison and/or validation purposes. Selection shall be at random, but the
professor reserves the right to call on specific students whenever the situation is fit of such or
the circumstances deem it appropriate.

Section 6.1. Absence. An absence at any instance by any student called to recite
or debate in any oral examination will merit a grade of 60% or its equivalent. This grade
will only be cancelled upon presentation of any of the documents under sections 7.5 to
7.8 of Rule 7 attesting to the need of the student to take his or her leave from class on
the day such student was called to recite or engage in debate. However, invoking this
remedy is subject to the provisions of sections 7.9, 7.11 and 7.12. (15 August 2019)

Section 6.2. Coaching. Coaching during recitation or debates is strictly


prohibited. In the event that there is coaching, the student being coached and those
coaching shall be made liable. All those involved shall share in the grade given to the
former, that is, the grade given divided by the number of students involved in the
coaching incident, and the quotient shall be grade recorded for all the individual
students involved in the coaching incident for that particular oral exam session. This
rule shall be understood to be without prejudice to any and all policies of MSEUF on
academic dishonesty.

RULE 7. Written examinations. These exams on the other hand shall be composed of
a combination of multiple choice and essay questions, and shall be understood as referring to the
Prelims, Midterms, Semifinals or Finals as used in the MSEUF (except for the Enverga Law

School which allows for Midterms and Finals only). Due to the nature of the subject matter, the
coverage of the exams shall be cumulative, that is, topics which had been covered in a particular
exam shall still be included in subsequent written exams. While the main focus of the exam shall
be primarily on the current topics, students are still expected to recall and apply concepts and
principles previously discussed. Designation and frequency of these exams, as well as the rules
on academic dishonesty, shall be in accordance with the academic policies of MSEUF. (15

Section 7.1. Administration. A Written Exam shall be administered by the


professor, or his duly authorized representative, and answered by the student only at the
designated venue and on the specified date and time for such purpose.

Section 7.2. Absence. A student who shall be absent on the day of a Written
Exam shall be given a grade of zero (0) for that particular exam and such shall serve as
the respective component of the student’s total grade, based on the mathematical
formula provided by the MSEUF or the professor.

Section 7.3. Tardiness. A student who shall, on the day of the Written Exam,
come in after the official start of the period allotted shall be allowed to take the said
exam but only for the remainder of the period, beginning at the moment he or she
physically appears at the designated venue; provided, that the said student does not come
in after a significant portion of the period allotted for the exam has already elapsed.

Section 7.4. Exceptions. A student may be allowed to justify and be excused


from being absent on the day of the Written Exam only if he or she is able substantiate
a valid cause of the absence by presenting, depending on the specific event or
circumstance, the applicable document/s herein enumerated.

Section 7.5. Medical Condition. An original Medical Certificate attesting to the


sickness or other medical condition of the student on the date of the absence requiring
him or her to take leave from the Written Exam on said day, which is duly executed and
signed by a licensed Physician.

Section 7.6. Demise or Bereavement. A copy of the Death Certificate, duly


certified as true and correct by the National Statistics Office or the Local Civil Registrar,
of the deceased who is related to the student up to the fourth (4th) civil degree of
consanguinity or affinity; the date of death should be, at most, ten days prior to the date
of the Written Exam from which the student was absent.

Section 7.7. Legal Incidents. A copy of the police report or police blotter duly
certified by the relevant police officer, subpoenas, warrants of arrest and other
compulsory processes issued by duly authorized persons and bearing the respective
official seals thereof, which shall show that on the date of the Written Exam the student
was compelled to attend legal matters for which absence therefrom was inexcusable or
was under pain of contempt or punishable by law.

Section 7.8. Other Circumstances. Other exceptional and compelling


circumstances may be considered by the professor in assessing whether or not the
student’s absence is justified and may therefore be excused. However, any and all claims

of ignorance, mistake, both, or other rationale of similar import and effect as to the
specific date and time of the Written Exam shall not be an acceptable basis nor will ever
be a valid justification of an absence therefrom.

Section 7.9. Period. A student who wishes to avail of the remedy provided in
Section 7.4 shall give notice and present the applicable document/s to the professor at
within five (5) days after the date of the absence being sought to be excused from.

Section 7.10. Effects. A student who has to the satisfaction of the professor,
upon strict compliance with section 7.4, and without violating Rule 7 or any of its
subsections, successfully justified and substantiated his or her absence on the date of the
Exam shall be given the grade of incomplete or INC; and upon such time, the applicable
rules and regulations of the MSEUF regarding the matter shall thereafter govern.

Section 7.11. Sanctions. A student found to be procuring, presenting or


submitting any document specifically enumerated or determined to be required to be
submitted in relation to previous Rules and Sections, which appears to be or is given the
semblance of validity or genuineness when in truth and in fact it is fictitious, false, or
fraudulent, shall be: a) given the grade under Section 7.2; and, b) recommended for
disciplinary sanctions under the applicable rules and regulations of the MSEUF.

Section 7.12. Other Liabilities. The foregoing shall be without prejudice to any
criminal liability incurred by the student as well as the person executing the said false,
fictitious and fraudulent document under the Revised Penal Code and any other
applicable laws in force.

RULE 8. Online Presence. The abovementioned Facebook Group shall also be an


alternative means of evaluating academic performance.

Section 8.1. For each half of the semester, students must post at least one (1)
multiple choice question (for the Enverga Law School this should be an essay/bar
question) that is relevant to the topic and pertinent enough to merit attention. These
shall be chronologically marked by the student posting such questions as MTQ-01,
MTQ-02 et seq and FQ-01, FQ02 et seq. for the Midterms and Finals respectively. Also,
prior the event mentioned in Section 8.2, each student must answer (in the ALAC
format) at least two (2) questions posted by other group members and mark each of the
two (2) answers as MTA-01, MTA-02 and FA-01,FA-02 for the Midterms and Finals
respectively. (15 August 2019)

Section 8.2. On the day immediately preceding the midterm and final
examination, the same student who posted the question must post the correct answer (in
the ALAC format) to his or her own question as a comment to the original post where
the question is found. (15 August 2019)

Section 8.3. The requirements in Section 8.1 and 8.2 shall comprise ten
percent (10%) of the total recitation grade of said student for that particular half of the

Section 8.4. If at any time the professor posts a question, all students are
required to answer. Each student must post a reply to the posted question and mark his
or her answer chronologically as PA-01, PA-02 et seq. Failure of which shall entail the
sanction included in such post, or in the absence thereof, all students who do not
comply will receive a separate recitation grade of 60%. (15 August 2019)

Section 8.5. The Beadle, at the end of the semester, must submit an electronic
compilation (in the format prescribed) of all the questions and correct answers posted
on the FB page. Non-submission by the beadle will merit an INC for the semester. (15

Section 8.6. Students cannot post a question that has been posted previously
by other students or by the professor. Furthermore, all answers must conform to the
ALAC format. In the event of non-compliance with any of the instructions in Rule 8, it
will be considered as if the student had not posted any question at all. (15 August 2019)

III
FINAL PROVISIONS

RULE 9. Definitions. For purposes of the CHR:

Section 9.1. A student is considered “ABSENT” if he or she is not physically


present: a) when called to recite or debate; or, b) at the exam venue for the entire period
allotted for the said Written Exam or appears thereat only after a significant portion
thereof has already elapsed.

Section 9.2. “ALAC” means Answer, Legal Basis, Application, Conclusion


and, unless otherwise stated, is the standard format for answering in all of the professor’s
requirements, exams, and classes.

Section 9.3. A “CLASS” is a particular session, period, meeting, or a fraction


thereof, of the total length of time allotted for a course that is being handled, taught and
administered by the professor. For purposes of the CHR, the term shall also include
“make-up” or “special” classes.

Section 9.4. The term “COACHING” shall include any verbal or written aid,
as well as actuations, which tend to supply answers, explicitly or implicitly, to the
student/s undergoing oral examinations.

Section 9.5. A “COPY,” which may either be physical printouts or electronic


in form, for purposes of the CHR is a faithful reproduction of the relevant law, a
particular reading, set of rules, the Study Guide, or any other document required by the
professor.

Section 9.6. A “DOCUMENT” under Rule 7 is “fictitious” when the


document does truly exist; “false” when the contents thereof intentionally or
unintentionally deviates from the truth; and, “fraudulent” when the said contents are
entered in bad faith and intended to defraud, deceive or mislead.

Section 9.7. An “ELECTRONIC DEVICE” as used in the CHR shall be


understood so as to include laptops, netbooks, tablets, smartphones, cellular phones or
any other derivative product, device, tool or gadget of the same or similar import, kind,
class or type.

Section 9.8. The term “EXAM” shall be synonymous to the terms


“examination,” “tests” as well as other words of similar meaning and shall also be
understood as referring to the Prelims, Midterms, Semifinals or Finals as used in the
MSEUF. (04 August 2018)

Section 9.9. The term “FACEBOOK” refers to the social media platform
mainly developed by and primarily attributed to Mark Zuckerberg. (04 August 2018)

Section 9.10. The term “MSEUF” shall mean the Manuel S. Enverga
University Foundation, including any of its main, subsidiary or affiliate institutions,
colleges, schools, departments and offices, under the control and/or general supervision
of its Board of Trustees, Top or Mid Level Management, and any other person or group
of persons mandated to oversee operations and activities.

Section 9.11. The term “PERIOD ALLOTTED” when used in relation to an


Exam and in the context of the CHR shall mean that span of time, with a definite
beginning and end, within which the students are allowed to write down their answers to
a set of questions presented in an Exam.

Section 9.12. The term “SIGNIFICANT PORTION,” in relation to the entire


period allotted for the Exam, shall mean a length of time from the start of the period
allotted for the Exam until fifteen (15) minutes prior to the end of the said period.

Section 9.13. A “STUDENT” is a person enrolled in any course being handled,


taught and administered by the professor.

RULE 10. Separability. Should any provision of the CHR be declared invalid by the
proper authorities, those portions unaffected by the declaration of invalidity shall remain binding,
and in full force and effect.

RULE 11. Repeal. Except as herein provided, all issuances and/or rules and
regulations or any part thereof that are inconsistent with the provisions of the CHR are hereby
repealed or modified accordingly.

RULE 12. Effectivity. These Rules shall take effect upon issuance and shall remain in
force until subsequently modified, amended or repealed by the professor.
