Checklist: for Labour Welfare Inspectors and Principal Employers’ staff are provided for ensuring
compliance of Contract Labour Acts/Laws while making payment to the contractor/s.

The Railway shall ensure that the contractor shall pay the wages to their workers not
below the rate of minimum wages, as notified by the State Government or Central
Government, whichever is higher, through the bank transfer.
It is to be monitored by the PE, that the contractor is complying with the provision of
the Contract Labour Act 1970,/ Rules 1950 , as modified from time to time.
In every case in which, by virtue of the provision of the aforesaid act or the rules, the
Railway is obliged to pay any amount of wages to a worker employed by the contractor
or subcontractor in the execution of the work, due to contractor failure to fulfill her
statutory obligation. Railway has the liberty to recover from the contractor the amount
of wages so paid or the amount of expenditure so incurred.
The railway shall be at liberty to recover such amount or part thereof by deducting it
from any sum due by the railway to the contractor whether under the control or
otherwise.
Every Principal Employer shall nominate a representative duly authorised by her to
present at the time of disbursement of wages by the contractor and it shall be the duty
of such representative to certify the amounts paid wages in such manner as may be
prescribed.
The contractor is to produce a certificate of compliance of Minimum Wage Act 1948/
Rules 1950, which shall be verified by the Railway Manager and placed on record- this is
to be checked while passing of bills.
Proof of payment of wages is to be checked- bank remittances of salaries of all the
contractor’s works and to produce the documents to the effect to Railways for claiming
monthly bills.
It is the responsibility of the PE to ensure registration of the contractor with the
Employees’ Provident Fund Organisation before award of contract.
The applicability of the Act and Rules regarding Employees’ State insurance act, 1948
and Employees state Insurance (General regulations, 1950 are required to be ensured
by the Principal Employer/Contractor.
