JUDICIAL AFFIDAVIT

I, Ivana Alawi, of legal age, Filipino, single, and a


resident of #123, Lacson St., Brgy., Mandalagan, Bacolod
City, Negros Occidental, after having been duly sworn to in
accordance with law, hereby states that:

I am submitting this Judicial Affidavit as Petitioner in the


above entitled case currently pending before the Regional
Trial Court, Branch 43, Bacolod City, docketed as Civil Case
No. 165-019 and pursuant to A.M. No. 12-8-8-SC (Judicial
Affidavit Rule) of the Supreme Court.

I am answering the questions propounded by my


private counsel, Atty. _______, fully conscious that I am
under oath and that I may face criminal liability for false
testimony or perjury;

This Judicial Affidavit is written in English, a language


known and understood by me, and the examination and
execution thereof were done at Rm. 14324, 3/F., R & J
Building, B.S. Aquino Drive., Bacolod City, 6100; and

This Judicial Affidavit shall serve as my direct testimony


in this case.
1. Q: Please state your name and other personal
circumstances.
A: I am IVANA ALAWI, of legal age, Filipino
citizen, single, and a resident of #123, Lacson
Street, Brgy., Mandalagan, Bacolod City, Negros
Occidental.

2. Q: What is the purpose of your execution of this


affidavit?
A: To give my testimony in connection with the
nullity of marriage case filed by Ricardo Dalisay
against his wife Sam Pinto.

3. Q: How do you know of Petitioner and


Respondent?
A: We have been friends since college. I’ve known
them when they became a couple up to their
marriage.

4. Q: How would you describe your familiarity with


them?
A: I’m very familiar with them.

5. Q: How would you describe your closeness?


A: I am more than sufficiently acquainted with
them. We’re very close. In fact, I was one of those
who pushed them to be together.

6. Q: How would you describe their relationship?


A: It looked like your typical college romance.
They looked sweet and happy together. But, they
did have problems one or the other would share.

7. Q: Can you please expound?


A: Ricardo told me that Sam never allowed them
to be public with their feelings. They didn’t hold
hands. She didn’t want him to be expressive when
other people were around.

8. Q: Is that the only problem they had?


A: I noticed Sam to be very controlling despite the
cold behavior. She didn’t let Ricardo go out with
friends, she would tell me. She didn’t want him
around other women.
9. Q: Are you personally aware if these issues
continued up to their marriage?
A: Ricardo would tell me that Sam needs him to
call every hour and to send pictures that he didn’t
have anyone else in his hotel when he’s out of
town. Sam would share that she does in fact
require this.

10. Q: Have they shared if they underwent steps to fix


these problems?
A: I remember when we were having lunch
before, Ricardo opened up about them possibly
seeking professional help by asking if I knew a
doctor who could help them. Sam shushed him
then and there.

11. Q: How would you describe their marriage?


A: I thought it would be a happy one. However,
Ricardo’s wanted to have a child since their
wedding. Sam told me she doesn’t want to have
it.

12. Q: Is there anything more you wish to add?


A: None, Attorney.

13. Q: Do you affirm and confirm the truthfulness and


veracity of all the statements you stated in this
judicial affidavit?
A: Yes, Attorney.
