REGULATION 16 – DANGEROUS ACTIVITIES AND OPERATIONS

16.1. Dangerous activities and operations are considered to be those listed in Annexes 1 and 2 of this Regulatory
Standard -Regulation.

16.2. Working in dangerous conditions allows the worker an addition of 30% (thirty percent) to his salary, without the
increases resulting from gratifications, premiums or profit sharing. (116.001-0 / I1)

16.2.1. Employees may opt for the extra payment for unhealthy conditions which might be owed him.

16.3. Companies, or unions for the professional categories request from the Ministry of Labor, through the Regional
Labor Delegation, a inspection of the establishment or sector of the company, with the objective of describing and
classifying a given activity as dangerous.

16.4. The provisions in item 16.3 will not hinder the supervision of the Ministry of Labor or the holding of ex-officio
inspections.

16.5. For the purposes of this Regulation, dangerous activities or operations are those executed with explosives subject
to:
a) auto catalytic chemical degradation;
b) action of outsides agents such as heat, humidity, sparks, fire, seismic phenomena, shocks and friction.

16.6. Operations for transporting liquid inflammables or liquefied gasses, in any container or in bulk, are considered
dangerous conditions, with the exception of transporting small quantities of up to 200 (two hundred) liters for
inflammable liquids and 135 (a hundred and thirty-five) kilos for liquefied inflammable gas.

16.6.1. Inflammables in gas tanks of vehicles for their own consumption are not considered for the effects of this
Regulation.

16.7. For effects of this Regulation, a liquid fuel is considered one with a flash point equal or greater than 70ºC
(seventy degrees centigrade) and less than 93.3ºC (ninety three point three degrees centigrade).

16.8. All areas of risk foreseen in this Regulation shall be delimited, under the responsibility of the employer. (116.002-

ANNEX 1

DANGEROUS ACTIVITIES AND OPERATIONS WITH EXPLOSIVES

1. Dangerous activities or operations are considered to be those enumerated in Table 1, following:

2. Workers in the activities listed above have the right to the 30% (thirty percent) increase over their salary, without the
increases resulting from gratifications, premiums or profit sharing, and they have the option of this addition for
unhealthy conditions.

3. Risk areas are considered to be:

a) locations for storing chemical powders, pyrotechnical artifacts and chemical products used in manufacturing
explosive mixtures for fireworks, to the distances given in Table n° 2:

1. Dangerous activities or operations, that allow workers in these activities or in the risk area the addition of 30
(thirty) percent, are those:

2. The following definitions are adopted for effects of this Regulation:

I. Services for operation and maintenance of vessels, tanker wagons, tanker trucks, pumps and containers for
inflammables:
a) activities for inspection, calibration, measuring, counting inventory and gathering samples in any full container;
b) security services, for arranging empty non-degassed containers, propulsion pumps in enclosed areas and for
supervision;
c) maintenance, repair, washing, painting vessels, tanks, supply vehicles and any containers full of inflammables or
empty, non-degassed containers;
d) activities of de-gassing and washing vessels, tanks, vehicles, pumps or any containers that have contained
inflammable liquids;
e) any other activities of operation and maintenance such as: services for warehouses, offices, safety inspection
laboratories, checking stocks, the medical ambulatory, engineering, workshops in general, boilers, mechanics,
electricity, welding, filling, closing and arranging any containers with substances considered inflammable, so long as
these activities are executed within the area considered dangerous, ad-referendum of the Ministry of Labor .

II. Services for operation and maintenance of vessels, tanker wagons and tanker trucks, and containers with liquid
inflammables or liquefied gasses: activities for inspection of any leakage points in the system of storage for
distribution, and measurement of tanks by processes of direct escape; supervision services; maintenance of the
installations for the tanker truck fleet, within the area and around the normal or eventual escape points;
d) activities for decantation, degassing, washing, repair, painting, and aeration of tanks, cylinders and bottles full of
GLP;
e) any other activities of maintenance or operations executed within the areas considered dangerous by the Ministry of
Labor.

III . Storage of inflammable liquids in tanks or containers:


any activity executed within the safety basin for the tanks; arrangement of drums or cans or any other activity executed
within the building for storage of inflammables or in open areas with containers full of inflammables, non-degassed or
decanted.

IV. Storage of inflammable liquids or liquefied gasses, in tanks or containers:


a) arrangement of containers or any other activities executed within the storage building for inflammables or in open
areas with containers full of inflammables or non-degassed or decanted materials.
V. Operations at service stations for supplying inflammable liquids:
a) activities directly linked to fuelling vehicles with internal combustion engines.

VI. Other activities such as: maintenance, lubrication, washing vehicles, mechanicals, electricity, sales offices and
management, ad referendum the Ministry of Labor.

VII. Filling any containers (drums, cans), with inflammable liquids:


a) activities of filling, closing and arranging cans or boxes of cans.

VIII. Filling any containers (cylinders, bottles) with inflammable liquefied gasses:
a) activities of filling, weighing, inspection, stowing and arrangement of cylinders or bottles full of GLP;
b) other activities executed within the area considered dangerous, ad referendum do Ministry of Labor.

3. Risk areas are considered to be:

4 – The following are not considered dangerous for purposes of receiving the salary addition:

combined, so long as the limits given in Table I below are obeyed, independently of the total number of packages
handled, stored or transported, always obeying the Regulations issued by the Ministry of Labor and Employment,
Standard NBR 11564/91 and the legislation for dangerous products related to the means of transport used;

4.2 - handling, storage and transport of containers of up to five liters, sealed at the factory, containing inflammable
liquids, independently of the total number of packages handled, stored or transported, always obeying the Regulations
issued by the Ministry of Labor and Employment and the legislation for dangerous products related to the means of
transport used.
