HPNLU INTRA UNIVERSITY MOOT COURT COMPETITION RULES, 2019

 TEAM ELIGIBILITY AND REGISTRATION:


1. Students enrolled insecond, third and fourth year of B.A./ B.B.A. LL.B courses at
HPNLU, Shimla are eligible to participate in the competition.
2. Theteam shall comprise of 3 members only (2 designated as speakers and1 as researcher).
3. The interested team shall register itself by submitting the hard copy of Annexure-A to
either the Convener or the Co-Convener latest by 7 th September, 2019.

 LANGUAGE, DRESS CODE AND CONDUCT:


1. The language of the competition shall be English.
2. The dress code shall be white shirt, black pants/grey pants, black blazer and black
shoes.
3. The participants shall follow strict courtroom decorum and any violation of this rule
shall entail disqualification from the Internal Moot.

 MEMORIAL SUBMISSION:
1. The deadline for submission of the soft copies of the memorials is 20th September,
2019 before 5:00 PM.
2. Each team must prepare memorials for both the parties, i.e. the petitioner/appellant
and the respondent.
3. Submission of memorials beyond the prescribed time shall not be entertained. Further,
any participant submitting memorials beyond 5 p.m. shall be automatically
disqualified from participating in the HPNLU Intra Moot Court Competition, 2019.
4. The memorials are to be submitted in electronic form to the following email id’s:
hpnlumcc@gmail.com, CC to adv.singh15@gmail.com.
5. Two hard copies of the memorials shall be submitted to the faculty convener on or
before 21st of September, 2019.
6. Memorials must contain the following:
(a) Cover page.
(b) Table of Contents.
(c) Index of Authorities.
(d) Statement of Jurisdiction.

(e) Synopsis of Fact.
(f) Summary of Arguments.
(g) Arguments Advanced.
(h) Conclusion /Prayer.
7. The memorial shall not be of more than forty (40) pages and the Arguments advanced
shall not exceed more than twenty five (25) pages.
8. The Memorial shall be typed on A4 size page in Font type: Times New Roman, Font
size: 12, 1.5 line spacing & 1 inch margin on each side.
9. The Cover Page of the Memorial must follow the following color scheme, Blue for
the Applicant Cover Page and Red for the Respondent Coverage.
10. Cover page scheme
a) Team Code (Top right corner)
b) Name of the Court
c) Cause Title
d) Identification (as to respondent/ appellant)
11. Memorials that do not comply with the abovementioned specifications will be
penalized.
12. Identification mark of any type shall attract severe penalty.

 Marking criteria for Memorials:


1. Memorial from each side shall carry total of 50 marks.
2. The following shall be the criteria for marking memorials:

 Oral Rounds:

1. The match up of teams shall be determined on the basis of draw of lots.


2. Each team shall be given 20 minutes to present their case including rebuttals.
3. The rank of teams shall be determined on the basis of aggregate score of pleadings.
4. Only one (1) speaker from each team shall be permitted to rebut/sur-rebut.
5. In case of a tie in the aggregate speaker scores, then the team with higher memorial
score shall be considered.

 Marking criteria for arguments:


The following will be the marking criteria for the Mooters:

 Other Rules :
1. All participants are expected to maintain the decorum in the court during the
competition & are expected to behave themselves in a manner befitting the legal
profession.
2. The organizer’s decision regarding the interpretation of rules of any other matter
related to the competition shall be final.
3. If there is any situation which is not contemplated in the rules, the organizer’s
decision on the same shall be final.

ANNEXURE-B

MOOT PROPOSITION

1. Rohit and Raman were close friends. They were young people who started their own
small company of electronics and telecommunication. And for this, they hired an
office of one Mr. Madhav. Since Madhav was an experienced man and a retired
engineer they also used to take his guidance and help in setting up the business.
Madahv’s niece Sandhya who stays with him, is a beautiful young girl and was of the
same age as that of Rohit and Raman. Sandhya was in final year of Engineering in
electronics and Telecommunication.
2. She used to visit the office of Rohit and Raman in order to meet her uncle Madhav.
After a passage of time, Rohit, Raman and Sandhya became friends and she started
visiting their office frequently even in the absence of her uncle Madhav.
3. Rohit wanted to marry Sandhya. He also proposed her for marriage. However, she
neither accepted nor rejected the proposal. Sandhya’s indifference towards the
proposal infuriated Rohit. However, with time their friendship strengthened, resulting
into physical intimacy between the two of them.
4. In the meantime, Raman also proposed Sandhya to which she responded that she
could decide about it once she completes her degree. However, this did not affect their
friendship and the three of them continued to spend time together.
5. Six months down the line Sandhya completed her Engineering Degree and scored 90
per cent marks and secured campus placement in a very reputed engineering and
telecommunication Company.
6. However, on persuasion by Rohit and Raman, she decided to join their company. She
also discussed the same with her uncle and family and accordingly joined the
company. As per company’s rules and regulations the timing for female employees
was from 9.00 A.M to 6.00 P.M. However, as the company was new, so in order to
expand the business, she sometimes used to work late hours and consequently Rohit
and Raman often used to drop her at her place.
7. On the night of 5th May, 2019 Sandhya went to attend the marriage reception of her
friend. At about 11.00 P.M. she called Raman and told him the same and asked him as
to whether he can drop her home. To which Raman replied that Rohit is also at a

nearby place and if she wants she can ask Rohit to pick her up from the marriage
party and drop her at her place, to which she agreed.
8. However, instead of Rohit, Raman reached the venue and thus, she asked Raman to
drive her home. In the meantime, Rohit called Sandhya and apologized for being late
and told her that he is coming to pick her up. Sandhya informed him that she is with
Raman and he will drop her at her place.
9. Instead of dropping Sandhya to her place, Raman took her to his house. Raman then
lifted Sandhya and put her on his cot. After that he removed his clothes and tried to
make forceful physical contact with her. When Sandhya objected and screamed in
resistance, Raman shouted that since she is very proud of her beauty and showed
arrogance when he proposed her for marriage, she now has to face the consequences.
This whole incident was recorded in a camera which was installed in that room.
10. At the same time, Rohit reached there and rang the doorbell. Raman opened the door.
He had a glass of water and after having a brief conversation with Raman he entered
the room where Sandhya was lying on the bed and crying. Rohit jolted her and had
sexual intercourse with her and when Sandhya again retaliated, Rohit strangulated
her. Thereafter, both of them threatened her that in case she narrated the incident to
anybody she would be done to death and her video would be made public. They
further warned her that no harm will be caused to her provided she remains quiet
about the incident. They also suggested her that since it’s quite late, she should leave
for home the next morning. Controlling her emotions, she somehow agreed and went
to the bathroom and cleaned herself.
11. After a short while, Madhav called Sandhya and asked her whereabouts. To which she
replied that she is fine and will return back home from the party the next morning.
12. When Sandhya reached home the next morning, her mother observed a change in her
behavior and asked her the reason for not going to work. To which she replied that
she is not keeping well but her mother noticed abrasion on her neck and arms and
enquired about the same. Sandhya initially hesitated and told her that it was an
allergy. But, when she repeatedly questioned, Sandhya came out with the truth. She
narrated the whole incident to her mother. Her mother called both Raman and Rohit
and told them that they will face the consequences of outraging the modesty of her
daughter and that she will lodge an FIR against both of them. After four days of the
alleged incident Sandhya filed an FIR against Rohit and Raman.

13. On the basis of the FIR, Sandhya’s medical examination was conducted by Dr. Suman
Gupta. The medical report suggested minor abrasions on her arms and neck; it also
suggested that she has undergone sexual intercourse in recent past.
14. Both the accused were arrested and also medically examined. As per their medico-
legal report, Rohit was found incapable of performing sexual intercourse.
15. On the appraisal and consideration of the above mentioned facts and evidences on
record, the trial court found Rohit guilty of offence punishable under Section 376 read
with Section 511 of the Indian Penal Code (hereinafter, referred as IPC) and found
Raman guilty of the offence punishable under Section 376 of IPC. The court also
convicted both the accused under Section 506 of IPC.
16. The appellants have filed an appeal before the Hon’ble High Court expressing
dissatisfaction with the decision of the lower court.

 The proposition is a fictitious account prepared for the purpose of the present
competition and does not attempt to influence the outcome of any matter whatsoever.
 Issues to be drafted on behalf of both the parties and oral arguments to be limited and
based on the aforementioned information.
