Sections of these documents contain information relating to the personal affairs of third
parties, namely mobile phone numbers, a signature and the names of third parties not
associated with this request. Under clause 6(1) of Schedule 1 to the Act, information is
exempt if releasing it would involve the ‘unreasonable disclosure of information
concerning the personal affairs of any person’. I have considered that the application of
clause 6(1) requires two elements, one that the information contains the personal affairs
of that person; and secondly that disclosure would be unreasonable and contrary to
public interest. I have determined that this information falls within the category of
‘personal affairs’ as listed under section 4(1) of the Act, thereby meeting the first
elements of this clause. Further, I have considered whether the disclosure of this
information would be unreasonable. In doing so, I have considered the relevance of this
information to the public and the likelihood as to whether the person in question would
consent to disclosure. I have concluded that this information was likely obtained in
confidence and through measures which would otherwise make it unavailable to the
public. I have considered the factors in favour of public interest and determined that
these factors are outweighed by the need to maintain personal confidentiality in this
instance. Therefore, I have determined that this information meets the requirements of
clause 6(1) and is thereby exempt pursuant to this clause.

Documents 4, 6, 7 and 9

These documents contain account and credit card numbers which form part of the
business and financial affairs of the Government of South Australia. These account
numbers may still be active. If released there is a possibility some adverse effect could
flow from their disclosure. As the release of this information is not likely to enhance
participation by members of the public in the democratic process, but could possibly
have some adverse effect on the state’s financial affairs, DPC considers that, on
balance, it would be contrary to the public interest to release it. In light of this, DPC
submits that the information is exempt pursuant to clause 7(1)(c) of the Act.

Documents 4 and 9

These documents contain the fee for service of a third party. The third party has
indicated that the rate of their fee is variable depending on the nature of the event they
are scheduled to perform at. Clients are required to keep the fee confidential as to reveal
it would reasonably be expected to have an adverse effect on the maximum established
fee rate this third party charges for their services. This particular fee is a variated rate on
the established fee and so to publically disclose the amount charged would therefore
prejudice future ability to maintain the established fee rate. Whilst I acknowledge the
public interest factors around transparency of Government spending on promotional
material, I believe in this instance it is important that third parties are not adversely
effected by disclosure of their business affairs, particularly when this fee is offered at a
lower than established rate. I have therefore determined to remove this information
subject to clause 7(1)(c) of the Act.

This document consists of unique methodology and concepts of a third party that are
arguably a virtual blueprint for best practice in this field and have developed over
considerable time in the progression of this third parties expertise in their vocation. It
would be extremely valuable to competitors in this field and release of this document
could reasonably be expected to destroy or diminish the commercial value of this
material. I acknowledge the public interest factors around transparency of services
provided to Government and return on money spent with third parties but I believe in this
instance it is outweighed by the need to protect the intellectual property of this third party
so that it does not suffer diminished commercial value to their brand. I have therefore
determined to refuse access to this document pursuant to clause 7(1)(b) of the Act.

Exemptions

Clause 6 – Documents affecting personal affairs

(1) A document is an exempt document if it contains matter the disclosure of which


would involve the unreasonable disclosure of information concerning the personal
affairs of any person (living or dead).

Clause 7 – Documents affecting business affairs

(1) A document is an exempt document—

(b) if it contains matter—

(i) consisting of information (other than trade secrets) that has a commercial
value to any agency or any other person; and

(ii) the disclosure of which—

(A) could reasonably be expected to destroy or diminish the


commercial value of the information; and

(B) would, on balance, be contrary to the public interest; or

(c) if it contains matter—

(i) consisting of information (other than trade secrets or information referred to


in paragraph (b)) concerning the business, professional, commercial or
financial affairs of any agency or any other person; and

(ii) the disclosure of which—

(A) could reasonably be expected to have an adverse effect on those
affairs or to prejudice the future supply of such information to the
Government or to an agency; and

(B) would, on balance, be contrary to the public interest.

Hi Rita, Hi Alan,

I have just updates to Stephen Boyle about this and want to also keep David
and Alan in the loop.

The SA Department of Premier and Cabinet have just awarded a James


Morrison Academy student $1,500 for the composition of a piece of music to
accompany an advertisement campaign celebrating the relationship between
South Australia and Shandong Province in China. 10 students submitted
entries and a panel selected a winner. On 11 March in Adelaide, the piece will
be recorded by the winner and several other JMA students along with some
professional musicians. James will also be there to oversee the recording. It
will take place at Mixmasters in Adelaide and we would like to invite David to
visit the recording session, talk to the students and even get some photos if
you’d like. The recording will start at 10:00 and could take anything from 3 -
6 hours (but we are all hoping for 3 hours.)

Let me know if David would like to visit as James and the students would be
thrilled to see him there.
