You may return to work on August 8, 2019 at 23:27 hours for the regularly ‘scheduled shift or use 2 hours and 33 minutes of your own tme. During your ten (10) day ‘suspension, you shall not wear the Department uniform, or exercise any power oF authority {granted 1 you as a deputy she, including but not limited to using your identification card to gain entry oF access to City and County of Denver facies or entering City and County of Denver {aciitios for reasons other than to conduct personal business. Under the DSD cisciptinary matrix, a violation of OSD rule 400.8.1 is @ Conduct Category D through F violation CONTEMPLATION OF DISCIPLINE You were served witha contemplation of decline letter regarding this matter on Tuesday, March 18, 2018. At that time, a contemplation of discipline meeting vas scheduled for Monday, Api 22, 2019 at 1:30 pm. Aithe request of your aitorney, the contemplation of discipline meeting wat rescheduled to and held on Monday, May 6, 2019 at approximately 12:00 hours in the Darwer ‘Sherif Department (OSD) Downtown Detention Center (DDC) adminitrative conference room, located at 490 West Gotfax Avenue, Denver, Colorado. The purpose of this meeting was to allow you to correct any erro in the Agency’s information or facts, to tell your side of the story, and to present any mitigating information as to why possible disciplinary action should not be taken against you. Present at this meeting was Sherif Patrick Firman and Chief Eas Diggins. Present from the Conduct Feview Office (CRO) was Major tephen Koch and Ms, Brigitta Sadler. Present from the Ofice ofthe Independent Monitor was Mr. Nick Witchel. Present from the Cy Attorney's Office was Ms. Jennifer Jacobson. Present from the Office of Safaty was Mr Alfredo Hemandez. You attended this meating with Mr. Jorean Lubeck as your attorney. ‘The contemplation of discipline meeting was transcribed and is contained inthe intemal Affairs Bureau (IAB) fle, incorporated by reference herein, Your attorney, Jordan Lubeck, made a statement on your behalf about this incident So fest, the failure to protect prisoners from harming themselves or others. Deputy Kemble certainly takes responsibly for no following up on the ~ the noose gesture that ‘was made in ~ in his presence by Ms. Graham. | think he's always taken responsiblity {or no following up with thal. While he wasn't privy to te ial conversations between. the inmate and Ms. Graham, he certainly understands thal he has a roe to pay in folowing up with that situation | then asked Deputy Kemble some questions about the incident: MA. HERNANDEZ: Okay. And now if we can go back to that frst conversation with ~ with Ms. Graham ~ DEPUTY KEMBLE: Uh-huh, MR, HERNANDEZ: ~ right? think you'd agree with me that it ~ that looked like she was talking, with you~ DEPUTY KEMBLE: Yeah, sho was. MR. HERNANDEZ: ~ right? DEPUTY KEMBLE: Yes. MR. HERNANDEZ: And you've told us on ~ on numerous cocesions that you don't recall at all what the conversation wat about or what she eaid to you?” DEPUTY KEMBLE: Uh-huh. MR, HERNANDE jut you do remember her making the gesture withthe noose? DEPUTY KEMBLE: Yeah, MR. HERNANDEZ: Okay. DEPUTY KEMBLE: And I ~ like, my attorney said, | should rave followed up on that, and I ropped the ballon that and | -- MR, HERNANDE hat rule would that have tiggered? DEPUTY KEMBLE: | don't know the exact ule but ~ perso, butthe suicide ~ MR. HERNANDEZ: So protection of an inmate ~ DEPUTY KEMBLE: Yeab. MR, HERNANDEZ: potentially, right? And ~ and -- DEPUTY KEMBLE: Protection, yeah. Yeah. Where | should have wrote up a report, brought up: ‘medical, stuf ike that (Contemplation of cisciptine meeting ranscript pages 10-12 lines 220 ~ 251). The meeting then concluded. PRIOR DISCIPLINE You have no prior sustained violations within a seven-year period and therefore the: penalty level for this incident would not be mandatorily increased. {As will be discussed on the pages tha follow, the evidence surports a finding that you violated the above-mentioned rues and regulations. The Department has concer regarding your ability ‘act responsibly and to conduct yourselt appropriately while on duly. Your conduct has been in Violation of the Departments policies and procedures. There is an immediate need for Improvement inthis area. Further rule violations shall be dealt wih appropriately. Please be advised that you may appeal the discipline imposed and these determinations in accordance with Career Service Rule 20, Appeals. You may also inate dispute resolution pursuant to Career Service Rule 18, Dispute Resolution. Please note that pursuing dispute Fesolution does not toll your time for fing an appeal Finally, please be reminded that you are not to take any retalitory action against anyone as a. result of this disciplinary action. If any such action is taken, further elecipline may be contemplated and taken, up to and including dismissal cc: Career Service Authority, Records Management Division 1AB File DEPARTMENTAL DETERMINATIONS OF DISCIPLINE Deputy Timothy Kemble ‘52018-0043 After a thorough review of the DSD Internal Affaire Bureau (IAB) investigation, the Executive Director of the Department of Safety's Office has made the folowing findings of fact and determinations of discioline. ‘SUMMARY OF FACTS Deputy Kembie has been employed as a Deputy Sherif with the Derver Sherif Department (08D) since March 10, 2008, ‘On January 25, 2018, Sergeant Joseph Bowen spoke with cillan GED volunteer Becky Graham, During their conversation, Ms. Graham related that on January 23, 2018 at approximately 2015, hours, Inmate BC confided in her that he wanted to hang himsel. ‘Ns. Graham also stated that she notfied the deputy who was working upstairs in Dullding 20, ouside of me GED classroom/pad at the officers desk. When she told the deputy of Inmate BC's statements, the {deputy tld Ms. Graham that the inmate would have to ask for assistance on his own. On January 25, 2016, Ms. Graham also informed Sergeant Bowen thatthe deputy she spoke with regarding Inmate BC was currently working atthe main cordor post when she arrived atthe Denver County Jail After their conversation, Sergeant Bowen immediately escorted Inmate BC to Building 4 ‘where he was evaluated and placed on the psychology line. Sergeant Bowen then responded to the main corridor security post and spoke with Deputy Kemble. Sergeant Bowen asked Deputy Kemble iit was relayed to him that an inmate was suicidal on Tuesday, January 23, 2018 to which Deputy Kemble responded, “Yes.” When Sergeant Bowen asked Deputy Kemble why he cnt respond and act when he was informed of Inmate BC's statements, Deputy Kemble sald he dn’ know what to do since the inmate hadn't sald anything Io him, Before Sergeant Bowen could ask Deputy Kemble any other questions, thelr conversation was interrupted. Sergeant Bowen instructed Deputy Kemble that they would ‘speak later. ‘At approximately 19:50 hours on January 25, 2018, Deputy Kemble was instructed to respond to the Captain's office. Deputy Kemble responded and requested Deputy Jerome Gonzales to serve 1s his employes representative while meeting with Sergeant Bowen and Captain Kennoth
