DEED OF SALE with ASSUMPTION OF MORTGAGE

KNOW ALL MEN BY THESE PRESENTS;

This Deed of ABSOLUTE SALE is made, executed and entered into by


___________________________________, legal age, Filipino, and with
residence and postal address at
_________________________________________, hereinafter referred to
as the SELLER

-AND-

________________________________________, legal age, Filipinos and


with residence and postal address at
______________________________, hereinafter referred to as the
BUYER

WITNESSETH

WHEREAS, the SELLER is the registered owners of a parcel of land with


improvements located at ________________________________________
and covered by Transfer Certificate of Title No. _________________ containing
a total area of ______________________ more or less and more particularly
described as follows:

TRANSFER CERTIFICATE OF TITLE NO. _________

WHEREAS, the BUYER have offered to buy and the SELLER have
agreed to sell the above mentioned property for the amount of

WHEREAS, the BUYER may assume HOME DEVELOPMENT MUTUAL


FUND (HDMF) balance starting on ____________________ including
occurrence of charges until fully paid, except on the event that the SELLER
death may agree to pay half of the unamortized balance to his beneficiary.

THAT the said property is mortgage by the SELLER in favor of Home


Development Mutual Fund (PAG-IBIG Fund) as evidenced by the DEED OF
MORTGAGE executed on ___________________________ by the said
SELLER and acknowledged before a Notary Public of ____________________,
and enter his notarial register as Doc No. ____; Page_____; Book No._____;
Series of _____, a copy of mortgage deed is hereto attached as ANNEX “A” and
made an integral part thereof.

WHEREAS, the BUYER have agreed to assume, as they hereby assume,


all the duties and obligations of the SELLER imposed upon the latter in the
aforementioned DEED OF MORTGAGE, as if the present BUYERS were
mortgagors in the said DEED OF MORTGAGE.
NOW THEREFORE, for and in consideration of the sum of PESOS:

to and the receipt whereof is hereby acknowledged by the SELLER, the said
SELLER does hereby SELL, TRANSFER and CONVEY, in a manner absolute
and irrevocable, unto the BUYER, his/her heirs and assigns the real property
above-described together with all the improvements existing thereon, free and
clear of all liens and encumbrances except the mortgage as may be subsisting in
favor of ___________________; and,
The BUYER does hereby accept this sale and binds himself/ herself to assume
as he/ she assumes the payment of the unpaid balance of the mortgage
indebtness of the SELLER amounting to PESOS;
