Lesson 1: Substance Abused Education

A. R.A. 9165- Comprehensive Dangerous Act of 2002

- Mandates the government to “Pursue an intensive and unrelenting campaign against the trafficking and the
use of dangerous drugs and other similar substances.
Under the law, those who caught importing, selling, manufacturing and using of illegal drugs may be fined and
imprisoned for at least 12 years to life time, depending on the severity of crime.
Since they was passed at a time, the death penalty was still applicable, it is the maximum punishment imposed
by the original law.
2006- Death Penalty was abolished.

R.A. 9165 repealed R.A. 6425 or Dangerous Act of 1972


-Mandates the Dangerous Drug Board to be the policy-and-strategy making body that plan and formulate on
drug prevention and control.
Article 9, section 77- DDB shall develop and adopt a comprehensive, integrated, unified and balanced national
drug abuse prevention and control strategy.
DDB composed of 17 members including chairman with a rank secretary. These 2, ideally, work hand in hand to
fight drugs.

B. Drug, Drug abuse and Drug dependency


 A drug is any chemical you take that affect the way your body works. Alcohol, caffeine, aspirin and nicotine are
all drugs.
 Drugs must be able to past from your body into your brain.
 Substance abuse also known as drug abuse, is patterned use of a drug in which the user consumes the substance
in amounts or with methods which are harmful to themselves or others, and is form of substance- related
disorder.
 Drug dependence applies to any drug, including alcohol, that is consumed repeatedly in spite of the negative
consequences the drug use is having on the life of the drug users and the lives of those around the users
 Drug dependence indicates the drug user is dependent on the drug either physically, psychologically or both in
order to function in everyday life.
 Is defined in the DSM as a recognized medical illness in part because of the way drug dependency affects the
brain.

C. Kinds of Commonly Abused Drug Substance


1. Hallucinogens - also called psychedelic drugs, capable of provoking changes or cessation of thinking, self-
awareness, and emotion.
 people under the influence of these seem so distant
 they might talk to invisible people or objects and experience a "bad" or "high trip" feeling
 they might act as paranoid and catatonic
 they ultimately scream, whisper, cry, or laugh
LSD, marijuana, PCP (angel dust), mescaline, ecstasy are the popular hallucinogens
2. Stimulants - uppers or pep pills
 are drugs which increase alertness, reduce hunger, and provide a feeling of well-being
 they stimulate mind, overconfidence, extreme energy, euphoria, and excessive talking
 they are highly addictive
 the most common stimulants are amphetamines, cocaine, and CAT (or metcathinone)
3. Depressants – “downers”
 are drugs which decrease or depress body functions and nerve activity
 they are also known as tranquilizers which keep people from having panic attacks, anxiety, and insomia
 barbiturates, methaqualine, valium, and halycon are among the commonly used depressants.
4. Narcotics - are drugs which produce insensitivity, stupor, melancholy, or dullness of mind with delusions
 these are the most deadly drugs of all

 they are highly addictive and dangerous to the body
 opium, heroine, codeine, and morphine are the most popular narcotics
5. Volatile solvents or inhalants
- are chemical that, when sniffed or inhaled, can produce intoxication, excitement, dulling of the brain,
and irrational behavior
- chemical inhalants include rugby, gasoline, paint kerosene, airplane glue, nail Polish, acetone, and
lighter fluid

D. Commonly Abused Drug and Their Effects


1. Alcohol (Beers, Wines and Liquors)
-it obtain and possess, alcohol is another commonly abused drugs with the potential for serious consequences
Effects:
Intoxicated behaviour, smell of alcohol on breath or clothes , hang over, glazed eyes.
2. Narcotics (Heroin and Pain Pills)
Originally referred medically to any psychoactive compound with sleep-including properties.
Effects:
Needle marks, Small pupils, Cold, Moist skin.
3. Marijuana
Refers to the dried leaves, flowers, stems, and seeds from the Cannabis sativa or Cannabis indica plant and is
the most commonly used illicit substance.
Effects:
Increased adrenalin, Stimulant
4. Tobacco
The common name of several plants in the Nicotiana genus and the Solanaceae family, the general term for any
products prepared from the cured leaves of the tobacco plant.
Effects:
Increased adrenalin, Stimulant
5. Heroin
 Commonly abused drug which is extremely harmful to the user and to the society.
 Heroin abused often leads to heroin addiction which is one of the hardest drug addictions to beat
 Causing the most damage both physically and mentally
 Related deaths are not uncommon and may come as a result of taking a mixture of drugs.
6. Cocaine
 is an illicit illegal commonly abused drug
 it can lead to addiction, severe health problems and death
7. Valium
 Commonly abused drug that requires a doctor’s prescription to legally obtain and use.
 If continued a long period of time, will lead to tolerance of the drug
 Lead to physical dependence which means that withdrawal will occur when the valium abuse is reduce or
stopped suddenly and it can very dangerous.

General Symptoms of Drug Abuse


1. Abrupt changes in school or work attendance, quality of work, grades, work output
2. Unusual flare-up or outbreaks of temper
3. Withdrawal from responsibility
4. Changes in overall attitude
5. Deterioration of physical appearance and grooming

E. Unlawful Acts and Penalties
Section 4. Importation of dangerous drugs and/or controlled precursors and essential chemicals
Offenders Penalty
1. Importer Life to death + Fine of 500,000 to 10,000,000
2. Importer using Diplomatic Passport Death + Fine of 10,000,000
3. Financer, Organizer, Manager of Importation Death + Fine of 10,000,000
4. Protector/Coddler 12 years to 20 years + Fine of 100,000 to 500,000

Section 5. Sale, Trading, Administration, Dispensation, delivery, distribution and Transportation of dangerous
drugs and/or controlled precursors and essential chemicals
Elements:
1. Identify of the buyer and the seller, the object, and the consideration.
2. Delivery of the thing sold and the payment thereof.

Penalty: life imprisonment to death and fine ranging from ₱500,000-₱10,000,000


Maximum Penalty Imposed on:
1. Committed within 100 meters away from a school.
2. Use of minors or mentally incapacitated person as runners, couriers and messengers, or in any other capacity.
3. If victim the victim is minor of mentally incapacitated
4. Dangerous drug is the proximate cause death of the victim.
5. Organizer, Manages the unlawful acts, financer
Protector/Coddler -12 year and 1 day to 20 years plus 100,000 to 500,000 fine

Section 6. Maintenance of a den, dive or resort


Den, drive or resort- A place where any dangerous drug and/or controlled precursor and essential
chemical is administered, delivered, stored for illegal purposes, distributed, sold or used in any form.

Any person or group who shall maintain a den, dive or resort where any controlled precursors and
essential chemical is used or sold in any form
Penalty: imprisonment ranging from 12 yrs and 1 day to 20 yrs plus fine ranging from ₱100,000-₱500,000

Section 7. Employees and visitors of den. Dive or resort.


The penalty: imprisonment ranging from 12 years and 1 day to 20 years plus fine ranging from ₱100,000-
₱500,000
a. Any employee of a den, drive or resort, who is aware of the nature of the place as such; and
b. Any person who, not being included in the provision of the next preceding, paragraph is aware of the nature
of the place such and shall knowingly visits the same.

Section 8. Manufacture of dangerous drugs and/or controlled precursors and essential chemicals.
The penalty of life imprisonment to death and fine ranging from ₱500,000.00-₱10,000,000 shall be
imposed upon any person, who, unless authorized by law, shall engage in the manufacturer of any dangerous
drug - The penalty of imprisonment ranging from12 yrs and 1 day to 20 yrs.

Section 9. Illegal chemical diversion of controlled precursors and essential chemicals.


The penalty of imprisonment ranging from 12 yrs and 1 day to 20 yrs and a fine ranging from ₱100,000-
₱500,000 shall be imposed upon any person, who, unless authorized by law, shall illegally divert any controlled
precursors and essential chemical.

Section 10. Manufacturer or delivery of equipment, Instrument, Parents and other paraphernalia for dangerous
drugs and/or controlled precursors and essential chemical.
The penalty shall be imprisonment for 12 yrs and 1 day or 20 yrs.
A fine ranging for ₱100,000-₱500,000 imposed upon any person who shall deliver equipment,
instrument, apparatus and other paraphernalia for dangerous drug.

Knowing, or under circumstances where one reasonability shall know harvest, manufacture, compound,
convert, produce, process, prepare, test, analyze, pack, repack, cultivate, grow, harvest, manufacture,
compound, convert, store, contain or conceal any dangerous drug and/or controlled precursors and essential
chemical in violation of this act.
Section 11: Possession of Drug Dangerous Drugs
Life Imprisonment to Death and Fine 500,000-10,000,000.
Any person, who, unless authorized by law, shall possess any dangerous drug in the following quantities,
regardless, of the degree of purity.

Community Leaders' Advocacy to Prevent Drug Abuse


1. Plan and implement social action programs involving young people, civic groups, professionals, and religious
organizations to improve life in the community.
The following activities must be implemented in the community:
a. Parent Education Programs
b. Recreational, Social, and Sports Programs
c. Vocational/Skills Development and Training Programs
d. Youth Development Programs
e. Seminars on Drug Education
2. Participate and assist in the implementation of RA 6425 also known as the Dangerous Drug Act of 1972 by:
a. motivating known drug abusers to undergo treatment and rehabilitation;
b. reporting drug pushers, drug den maintainers, and drug traffickers to the law enforcement agencies or authorities;
c. encouraging and supporting the establishment of community guidance clinics for drug users;
d. helping after-care rehabilitated clients to be accoeted back to their community and involving them in meaningful
and productive activities; and
e. helping discharged clients strengthen their moral and spiritual values.

What would a CWTS students and parents do to help drug abuse?


The CWTS students can help parents in the following aspects:
1. Create a warm and friendly atmosphere in the home.
2. Assist parents in developing effective means of communication with their children and for the children to be
open and honest to their parents.
3. Help parents learn how to listen and respect the opinion of their children.
4. Motivate parents to develop strategies on how to be with their children in spite of their being given busy.
5. Assist parents on how to teach responsibility to their children by giving duties commensurate to their age.
