Defendants

PRAECIPE

1. Plaintiff is a person of good character and reputation


and enjoys the esteem and

respect of his relatives, friends and members of the


public' Plaintiff is a well-known

jockey, horses at race meetings in South Africa, Abu Dhabi'


France as well as in
riding
Mauritius. Plaintiffhas numerous fans in those aforesaid countries'

2. Plaintiff in Mauritius rides horses belonging to the Alain
since race meetings of 2017 '
by the defendants, and Plaintiffhas been doing so ever
3. Defendants 1, 3 and 4 are prdposds of Defendant No.2 and Defendant No.5 is the
prdposd of Defendant No.6.

4. Plaintiff was selected by Defendant No.2 to ride as jockey for different existing
stables in Mauritius at intemational racing events that took place on Saturday 30

November 2019 and Sunday I December 2019.

5a. On Saturday 30 November, Plaintiff was convened to a meeting of the Mauritius


Turf Club at which were present the following members of the M.T.C Board and GRA:
(a) Mr Stdphan De Chalain, Chief Stipe;

(b) Mr Alain Rousset;


(c) Mr Paul Beeby, Chairman of the Gambling Regulatory Authority;
(d) Mrs Julia Keevy, a South African citizen who sits on the board of The Mauritius
Turf Club:
5b. Plaintiff was not told prior to his said attending the meeting the reason for being
summoned.

6. At the aforesaid meeting, Plaintiff was told by Defendant No. l, in the presence of
the other persons mentioned at Paragraph 4:"there are rumours going around lhat you

are involved in race fixing. You have to step down for the inrernational race events
scheduled for 30 November 2019 and I December 20j9, and ifyou do not step down
by yourse$ you will be forced to do so".

7. During the same meeting, Defendant No.5, the chairman of the Defendant No.6
GRA, then stated the following to the Plaintiff: "The betting factor can affect the public
and you should step down".

8. During the same meeting, Defendant No.4 (Ms Julia Keevy) asked the plaintiff
whether he was prepared to make a statement. The plaintiff then said: ,,yes I am
prepared to make a deposition", and Plaintiff was then asked if he can submit his mobile
phone and bank statement to the Board. Plaintiffsaid he was prepared to do so. He was

then asked to leave the room for the persons present to discuss amongst themselves and

that he would be called back.


g. After about 20 minutes, Plaintiff was convened again to the said meeting and

place semblent confirmer le conplot. La GM a pris le relais de I'enquete, qui a dt6

13.Plaintiffavers that at no time he agreed and consented to step down and not to ride.
Plaintiff never said so to Defendant No.1 and to the members present sitting at that
meeting where he was convened.

14. Plaintiff avers that all allegations made against him are false, wicked and
unfounded. Plaintiffavers that he had not been given a fair hearing and the opportunity
to refuse all the false allegations made against him. plaintiffalso avers that he has never
been involved in any attempt for race fixing.
15' Plaintiff avers that as a result
of the unlawful acts and doings
of Defendants, his
reputation and hisjob as ajockey
has taken a sharp blow and
his reputation has been
tamished in Mauritius and abroad
and is suffering great mentar
anguish and prejudice.

l6' Plaintiff avers that he has been forced


not to ride
at those intemational events due
to false' wicked and unwarranted
rumours espoused by the defendants,
although his
name already appeared on the
race cards and in all racing magazines
for both
intemational meetings.

17' Plaintiff avers that of all the jockeys


against whom there were rumours,
as
mentioned in paragraphs a and
llb above, he was the only one who had been
prevented from riding horses
at the internationar events on 30
November 201g nd 1
December 2019.

18. Plaintiff avers that he had in


the circumstances, been deprived
of the great
opportunity to participate for the
first time in an Intemational horse racing
event in
Mauritius organised by the Defendant
No.2.

l9' Plaintiff avers that the 'commettants"


Defendants No.2 and 6 and the ,prdposds,
Defendants No' l 4 and 5, are jointly
'3 and in solido liable for the damage
and prejudice
caused to the plaintiff.

20' Plaintiff avers that as a result


of the unlawful acts and doings of
the Defendants
which constitute a faute; he has suffered
damage and prejudice which
he values al 5
million rupees' which sum the defendants
are boundjointly and in solido
to make good
to the Plaintiff. However, praintiff
voluntarily reduces his craim to Rs.2,000,000
so as
to meet the jurisdiction of this Court.

21. Plaintiff therefore humbly prays


from this Honourable Court for a judgment
ordering the Defendants j ointry and
in solido to pay to him the sum of2
million rupees
as damages and this, for the reasons set forth above, together
rnterest at legar rate as
from the date entry of the plaint till final payment. With costs.
