NOTICE TO SHERIFF

The the City Sheriff City of Zamboanga, Philippines

S I R:

GREETINGS:

We are delivering to you a signed copy of that certain chattel mortgage


deed hereto attached, executed on____________, by ________________ in favor of
___________, mortgaging the personal property therein described.

The terms and conditions of this mortgage have been broken on


_____________ by the mortgagor, having failed to pay the instalments therein
mentioned on the dates due.

The mortgage has not, expressly or impliedly, varied the terms and
conditions of the original contract nor postponed its fulfilment; nor has said
mortgagee consented or known any second or subsequent mortgage of the
property in question.

On ____________, the mortgagor was notified of the date of the foreclosure


of this mortgage as well as the date of sale at public auction of the property
mortgaged, copy of which notice is also hereto attached, as Annex “A.”

The mortgagor is still indebted to the mortgagee in the sum of __________


as principal, plus ___% of interest computed from ______ and ____% of _______
representing attorney’s fees, in accordance with the stipulations in the said
mortgage contract, thus making a total sum of ___________ due and payable,
besides the expenses of this foreclosure.

In view hereof, it is respectfully requested that you take immediate


possession of the property, described in said mortgage contract, to be sold
pursuant to the Chattel Mortgage Law.

That to the best of my knowledge, the mortgaged property is subject to


no prior mortgage or any lien whatsoever and is now in the possession and full
control of the above-named Mortgagor-Debtor;

That the Mortgagor-Debtor defaulted in his obligation under the


aforementioned Chattel Mortgage Contract and Promissory Note;

That under the terms and conditions of the Chattel Mortgage Contract,
the Mortgagee is entitled to foreclose extra-judicially the mortgaged property,
with the following descriptions, to wit:

That by the terms and conditions of the Chattel Mortgage Contract


herein-above referred to, the principal obligation of the Mortgagor which has
become overdue as of _____________ is in the amount of
__________________________ (P___________), excluding penalties,
liquidated damages, past due interest, attorney's fee representing _______% of
the total obligation due, other charges and expenses of foreclosure.
I respectfully request you to take possession of the property described in
the aforementioned Chattel Mortgage Contract and sell the same at Public
Auction in accordance with the provisions of Act 1508. Please furnish the
undersigned and the Mortgagor-Debtor with copies of your Notice of Sale at
least ten (10) days before the sale.
