6.

Handover/Defects Liability Period

6.01 Ensure in coordination with other design consultants, compliance of final buildings as handed over
comply with the Project Brief, design intent and local authority requirements.

6.02 Ensure completion of fully coordinated architectural, structural, building services & other specialist
“as built” drawings (prepared by Contractors) & arrange for their issue to CROWN ASIA.

6.03 Advise and assist as required the consultant team and facility manager in the preparation and issue
of all operation and maintenance manuals’ participate in any briefing session.

6.04 Ensure completion of all remedial works set out in the defect list during the Defects and Liability
Period.

6.05 Identify any latent defects; agree extent, responsibility & programme for remedial works to an
acceptable standards; & define cost responsibility.

6.06 Advise CROWN ASIA on matters related to dispute in finalizing contract accounts.

6.07 Advise and assist the Quantity Surveyor and other Consultants in finalizing all contract accounts & in
determining the final Project Cost on completion.

6.08 Prepare & issue through Project Manager to a Project Close out Report.

IV. TOTAL FEE AND MANNER OF PAYMENT

For the above-mentioned scope of services & deliverables, our total Architectural design consultancy
services fee would be:

EIGHT MILLION PESOS (P 8,000,000.00) VAT INCLUSIVE FINAL DISCOUNTED FEE

PAYMENT SCHEDULE

a.) 10% of the total fee upon Notice to Proceed


b.) 20% of total fee upon submission of Schematic Design Package
c.) 20% of total fee upon submission of Design Development Package.
d.) 20% of total fee upon submission of 50% Construction Documents
e.) 20% of total fee upon submission of 100% Construction Documents
f.) 5% of total fee upon award to Gencon, Tender Evaluation
g.) 5% of total fee during Construction Administration

V. CROWN ASIA’S RESPONSIBILITIES

1. Provides consultant with full information regarding the requirements of the project, specifically, lot
description, site topographical survey, existing utilities arounf the site, as-bulit drawings of the existing
building and other similar information.

2. Undertake the necessary site test which will be used in the design of the Project.

3. Rendering prompt decisions pertaining to the documents submitted by consultant so as to avoid


unreasonable delay in the progress of the work.

VI. OTHER CONDITIONS

1. If the Statement of Account is undisputed in writing within seven (7) days from the receipt thereof
shall be deemed approved and accepted. In the event of dispute, a written notice should be given to the
consultant within seven (7) days from receipt thereof giving out the reasons for the dispute. The
consultant shall immediately respond and furnish a written explanation of the item in dispute attaching
thereto any documents to support thereof.

After seven (7) days from receipt thereof of the approved and accepted SOA, payment of which is due in
two (2) weeks or within a month. A five percent (5%) interest per month shall be imposed if payment for
the approved SOA is not received within the specified time frame.

2. In the event the services are suspended for reason not attributed to the consultant’s fault, then we
shall be compensated for the actual services performed to date including all amounts due consultant for
the reimbursable expenses.

3. In the event the assumed total Construction Floor Area (CFA) stated on this proposal and its
attachments (CROWN ASIA’s Project Brief) varies with the actual documented, the fees shall be
adjusted when there is a variation of 5% or more in the assumed total construction floor area (CFA). The
additional cost will be based on rates/sqm per component of the additional CFA.

4. It is assumed that the plans and designs were approved by CROWN ASIA for the consultant to
proceed with the Contract Documentation phase. However, if a major revision occurs such as redesign of
plans or CROWN ASIA-initiated changes, then the consultant shall be reimbursed accordingly.

Any change orders, supplementary services, changes/revisions and/or time extensions required by
CROWN ASIA after approvals obtained at each phase may be subject to additional compensation to be
agreed upon both parties. The consultant shall execute changes in plans only with writted consent of
CROWN ASIA or its authorized representative. The consultant shall inform CROWN ASIA of any
additional cost/compensation prior to execution of the Change Order/Revision.

For any additional service rendered other than the services mentioned in this proposal, then such
additional service shall be billed on the basis of the following hourly rates:

Partner - P 5,040.00
Associate - 1,260.00
Senior Architect - 787.50
Junior Architect - 504.00
Exec. Secretary - 385.00
Gen. Secretary - 258.00
Filing Clerk - 160.00
Field Architect - 1,900.00
Spec. Writer - 630.00

5. If CROWN ASIA requires the consultant to assign a full-time Field Architect at the project site during
the start of the construction period, a separate fee proposal shall be submitted to CROWN ASIA.

VII. PROJECT IMPLEMENTATION SCHEDULE

The Project Implementation Schedule which was made basis of this proposal is as follows:

Construction 36 months
Above schedule is a tentative schedule to be confirmed upon the agreement between CROWN ASIA and
the consultant. The official start date and end date of the period of our complete works will be
determined and agreed upon once commissioned.

If there is an extension of the schedule beyond the to-be-agreed-upon timetable, then there shall be
additional compensation to the consultant which will be on lump sum basis only.

-Kitchen Design

4. Miniature Scale Models


5. Full time construction supervision (8 hours)
6. Materials for marketing brochures and leaflets

IX. REIMBURSABLE EXPENSES

The following shall be deemed as reimbursable expenses:

1. International communication expenses including telephone, facsimile, & courier costs.


2. Printing costs of documents for Tender will be for the account of CROWN ASIA.

TENDER DOCUMENT RATES are as follows:


A0 Size – Php 100.00/blueprint sheet
A1 Size - 80.00/blueprint sheet
A3 Size - 40.00/sheet
A4 Size - 20.00/sheet

X. PRINTS AND FILES INCLUDED

The following shall be deemed as the only prints and e-files included per stage in this proposal. All other
prints or e-files other than the ones stated below will be for the account of CROWN ASIA.

SCHEMATIC DESIGN PHASE:

 One (1) E-File in CD/Email in CADD and PDF Format


 Two (2) sets of Schematic Drawings in A3
 Draft Design Criteria & Specifications

LGU AND HLURB Permit Drawings:

 One (1) E-File in CD/Email in CADD and PDF Format


 Eight (8) sets of Complete set of Architectural Signed and Sealed Blueprints in compliance with
the Building Permit Requirements.
 A0 or A1 tracing paper (consider 1:100 base plan; One (1) set)
 One (1) set A3 size
 Complete Signed & Sealed AR technical Specifications with Calculation in compliance with the
Building Permit Requirements

DESIGN DEVELOPMENT PHASE:

 One (1) E-File in CD/Email in CADD and PDF Format


 A0 or A1 tracing paper (consider 1:100 base plan; One (1) set)
 One (1) set A3 size
 Adjusted Design Criteria and Draft Technical Specifications (Hardcopy and Soft Copy)

CONTRACT DOCUMENTATION PHASE:

 One (1) E-File in CD/Email in CADD and PDF Format


 A0 or A1 in tracing paper (consider 1:100 base plan, One (1) set)
 One (1) set of A3 of Contract Documentation Package
 Technical Specifications (Hard and Soft Copy)

XI. OWNERSHIP OF DOCUMENTS AND PROTECTION OF INTELLECTUAL PROPERTY

1. Pursuant to P.D. 49 on the protection of intellectual property, the work of architecture design shall
remain the property of the consultant.

2. Under R.A. 9266, stipulates that all designs, drawings (original copy), specifications, prepared by the
consultant as instruments of services, are the property and documents of the consultant whether the
work for which they are made may be executed or not, and it shall be unlawful for any person to copy,
duplicate said documents for use on other works except by written consent of the consultant.

XII. CONFORME

If CROWN ASIA agrees to all the terms and conditions mentioned in this proposal, please affix the
signature on the space below. This will serve as our Notice to Proceed with our proposed services for the
project.
