Sir:

This is to report to your Office on the conversation that this


Representation was able to have with the Civil Service Commission
Field Director, Director Rey Albert B. Uy, on the following issues,
to wit:

1. On the query regarding the issue if a to be created position of


Municipal Government Department Head I in the Municipal
General Services Office in the Local Government Unit bares no
Parenthetical Title even if the Local Government Code of 1991
specifically provides a Parenthetical T itle “General Services
Officer” for the said position?

Response:
The Local Government Code of 1991 provides a very specific
provisions to positions in the Local Government Units. Section
490 (a) of the said Code specifically provides that “No person
shall be appointed General Services Officer unless he is a
citizen of the Philippines, a residen t of the Local Government
concerned, of good moral character, a holder of a college degree on
Public Administration, Business Administration and Management from
a recognized college or university, and a first grade civil service eligible
or its equivalent. He must have acquired an experience in general services,
including management of supply, property, solid waste disposal and
general sanitation for at least three (3) years in the case of the Municipal
General Services Officer”. Section 490 (a) is so specific that no one can
appointed to the said position if not fully qualified as stipulated under RA
7160.

2. In the event that such position will be created, can the second ranking
personnel in the said Office be designated as Head of Office and qualified
to receive Representation and Travelling Allowance (RATA)?

Response:
Yes, provided that in the said creation of the new position, there was this
stipulation that such newly created position bares provision that holder of
such position is qualified to receive Representation and Travelling
Allowance (RATA). In the event the Appointing Authority decides not to
appoint somebody to this newly created position but decides to designate
somebody (a lower position Officer) to Head such Office, the designee is
fully qualified to receive the said Representation and Travelling Allowance
(RATA).
3. On the query regarding the Clearance Form (CS Form No. 7, Series of
2017) of former Mayor Rosa C. Meneses, MD dated May 29, 2019. As
backgrounder of the issue, then Municipal Mayor Rosa Meneses, MD
asked the Human Resource Management Officer who will sign her Final
Clearance (Form No. 7, Series of 2017). The Human Resource
Management Officer suggested to have it signed by the Provincial
Governor as her immediate Superior. And so right after the signing of other
Local Clearance Signatories (Supply and Property Procurement and
Management Services; Human Resource Welfare and Assistance; Agency-
accredited Union/Cooperative; Financial Services; Transaction,
Processing and Billing Services), the said Clearance was sent to the Office
of the Provincial Governor for Final Clearance. But the said Office
returned such clearance and said it cannot sign it for clearance for the
reason that Mayor Rosa C. Meneses has no accountability with the
Provincial Government. But since the document already bears the name of
the Governor and finding it unnecessary, Mayor Rosa C. Meneses then
erased the Governor’s name. without malice.

Response:
The current Local Chief Executive is the one authorized to sign clearances
for officials and employees of the Local Government Unit. As to the case
of the former Mayor, her term ends up to 12:00 o’clock midday of June 30,
2019. Thus, she need to have her clearance be signed up to that time, where
she is no more the Local Chief Executive by then. So it is but right that the
new Local Chief Executive has to sign such clearance on finality.

Recommendation:

Based on the above queries, the following actions are hereby recommended to be
taken;

1. Provide the parenthetical title of “General Services Officer” next to the


subject position’s generic title called “Municipal Government Department
Head I” in the Municipal General Services Office to fully comply with
Section 490 of the Local Government Code of 1991 which specifies its
qualification standards for appointment;

2. Recall the clearance of former Mayor Rosa C. Meneses, MD and inform the
former Mayor to prepare a new clearance and have it signed by the current
Local Chief Executive, as per advice by the CSC Satellite Office, Ormoc City.
