PI ga’. 8 5 ee GENERAL ORDER 1.03 EFFECTIVE DATE: January 13, 2016 1.03.01 PURPOSE The Burpose of this General Order isto set forth rules of personal conduct for members Ofthe New Haven Department of Police Service, These Professional Standards when Aambined with General Orders, Rules and Reguiatons, Training Buletine and Giy of New Haven policies comprise the governing policies ofthe Department 1.03.02 APPLICABILITY This General Order has applicabilty to all members of the Department. The fst section has applcablty to 2 swom personnel regardless of rank. Section One identiies general principles of Personal and professional conduct under the general heading ‘Prinoples® sed hac applicability to all sworn members ofthe Department. Section Two has applica to GENERAL ORDER 1.03 Page 2 0f12 OF both sworn and civilian personnel depending on the introductory term used (see Section Two - Applicability), 1.03.04 SECTION ONE ~ PRINCIPLES ‘The following principles of personal and professional conduct have their basis in the general propesition that police oficers hold their office in the pubic trust. Whenever a police officers actions, whether on or off duty, have a provable adverse relationship on, the officer's performance, or have a tendency to destroy confidence or respect for the profession, such action(s) form the basis for a charge of “Conduct Unbecoming an Officer” ‘This Section contains seven principles governing the conduct of officers. Each principle 's folowed by the rationale explaining the principle and a sel of rules descnbing that principle, ‘Section One of this General Order is linked in principle to General Order 1.01 (Department ilission and Values), Iti illusionan to believe that any organization can adopt a General Order, no matter hhow carefully crafted, that will encompass evety rule relating to the conduct of is: ‘employees. This is especially true when that group of employees are police officers. Police officers hold their office inthe public trust and therefore can and must be held to a higher stancard. Police officers will normally be able to determine what kind of ‘conduct indicates unfitness to perform the functions of a police officer. Therefore, following the seven principles outlined in Section One, officers will ind a general statement regarding specific rules of conduct. Violations of these rules are considered "Conduct Unbecoming an Officer’ 1.03.08 PRINCIPLE ONE ~ LAW ABIDING Police officers shall conduct themselves, whether on duty of when applicable, in ‘accordance wih the Constitution ofthe United States, the Constituton of the State of Connecticut, and all applicable laws, ordinances and rules enacted or established by legal authority RATIONALE, Police officers conduct their duties pursuant to a grant of limited authority from the ‘community, Trerefore, oficers must understand the laws defining the scope of theit enforcement powers. Police officers may only act in accordance with the powers ranted to them. (Refer to the General Order on Department Role and Authority) GENERAL ORDER 1.03 Page 3 of 12, RULES. 1.1 Police officers shall not knowingly exceed their authority in the enforcement of the law. 1.2 Plies officers shall not knowingly disobey the law or rules in such areas as interrogation, arest, detention, searches, seizures, use of informants, and preservation of evidence, 1.3. Police offcers shall not knowingly restrict the freedom of individuals, whether by arrest or detention, in violation of the Constitutions and laws ofthe United States and the State of Connecticut 1.4 Police officers whether on or of duty, shall not knowingly commit any criminal offense under any laws of the United States or any state or local jurisdiction Which the officer is present, except where permed in te performance of duty Under aroper authority. 1.5 Police officers are permitted to use force, to include deadly force, in the Performance of their lawful duties. Refer to General Order on Use of Force, No offizer has authority to abuse hisiher lawful authority to use force and shall uuse only that force necessary to overcome resistance to affect a lawiul arrest, or protect himsettierself or a third person from injury. 1.03.06 PRINCIPLE TWO — INTEGRITY Police officers shal! refrain from any conduct in an official capacity that detracts from the Public's faith inthe integrity of the eriminal justice system, RATIONALE Community ccoperation with the police is a product of ts trust that officers will act honestly and with impartalty. The police officer, as the public's inal contact with the: ‘riminal justice system, must act ina manner that insile such trust. RULES 2.1 Police efcers shall carry out their duties wih integrity, faimess, and impartiality. 2.2 Police cficers shall nat knowingly make false accusations of any criminal, brdinance, traffic or other law violation. This provision shall not prohibit thé use of deception during criminal investigations or interrogations as permitted under law 2.3 Police ofcers shall ruthfully, completely and impartially report, testy and resentevidence, including exculpatory evidence, in all matters of an official nature. If the misconduct is commited by the officer's lmmeciate supervisor, the officer shall repor the incident fo the next higher level of supervision 1.03.07 PRINCIPLE THREE - WITHOUT PREJUDICE OR DISCRIMINATION Police officers shall perform their duties and apply the law impartially and without Prejudice or discrimination, RATIONALE Law enforcement effectiveness requires public trust and confidence. Diverse Communities must have faith inthe faimess and impartiality oftheir police, Police officers must refrain from fostering disharmony in theit communities based upon diversity and perform thei duties without regard to race, color, creed, religion, national origin, sex, marital status, status with regard to public assistance, disabilly, soxual orientation, gender identiy or age, RULES 3.1. Police officers shal provide every person in our society with professional, effective and efficient law enforcement services. 3.2. A police officer shall not Feport or work with the odor of an alcoholic beverage on higher breath 43 Police affcers shall not use narcotics, hallucinogens, or other controlled substances except when legally prescribed, Where the employee has been informed that the use of a prescribed drug may pose @ risk to the employee or others, the employee shall so advise the shit supervisor. 44 No employee of the Department shall smoke (including the use of electronic Cigarettes and vaporizers) or use other tobacco products while in unvform and involved in @ complaint, aa crime scene, performing tratfic control, an foot patrol oF otherwise in contact with the public. Persons other than those transacting Police business shall not be permitted fo loiter in or about the police buildings, 4.8 Police offcers shall nt commit any acts which, as defined under Connecticut |aw, constitute sexual assaul or indecent exposure, Sexual assauit docs not include @frsk or other search done in accordance with proper police procedures, GENERAL ORDER 1.03 Page 6 of 12 49 Police officers shall not commit any acts which, as defined under Connecticut law, constitute: 1) Domestic abuse, 2) The violation of a court order restraining the officer from committing an act of domestic abuse or harassment, having contact with the patiioner, or excluding, the poice officer from the petitioner's home or workplace. 4.10 Police officers shail avoid regular personal associations with persons who are known o the officer to engage in criminal activity or those that are subject to an active police investigation where such associations will undermine the public, trust and confidence in the officer or Department. This rule does not prohibit those associations that are necessary to the performance of official duties, or ‘where such associations are unavoidable because of the offer’ family, relationships 1.03.08 PRI FIVE - COURTESY AND RESPECT Police officers shal teat all members ofthe public wth courtesy and respect. RATIONALE Police officers are the most visible form of the community they represent. Therefore, police officers must act in a courteous and professional manne when interacting with the public and each othe. RULES 5.1 Police officers shall exercise reasonable courtesy in their dealings with the. public, ‘ellow officers, superiors and subordinates, and non-swom members of the Department, 5.2 No pole officer shall ridicule, mock, deride, taunt, beitl, wilfully embarrass, humiliate. or shame any person to do anything reasonably calculated to incite a person violence, 5.3 Police officers shall promptly advise any inquiring citizen of the Department's Complaint procedure and shall folow the established Department policy for Processing complaints. Employees must jbtain approval to engage in off-duty employment by the Chief of Police, or his ot her designee. Requests must be submitted in writing. 1.03.11 PRINCIPLE SEVEN ~ CONFIDENTIALITY Police officers shall observe the confidentiality of information available to them due to their status as police officers, RATIONALE Police officers are entrusted with vast amounts of private and personal information, or access thereto, Police officers must maintain the confidentially of such information to Protect tne privacy of the subjects of tha information, and to maintain pubis faith in the officer's and Department's commitment to preserving such confidences, RULES 7.1 Police officers shall not knowingly violate any legal restriction for the release or dissemination of information. 7.2 Police officers shall not, except in the course of offcial duties or as required by law, pubicly disclose information likely to endanger or embarrass victins, witresses or complainants, 7.3 Police offcers shall not divuige the identity of persons giving confidential informaton except as required by law or Department palcy, GENERAL ORDER 1.03, of 12 7.4 Shalinot use Department letterhead for private correspondence out of the Department without the approval ofthe Chief of Police or his her designee, 1.03.12. SECTION TWO — RULES OF CONDUCT Police officers shall not commit any act or action constituting “Conduct Unbecoming an Officer’. Conduct unbecoming a police officer shall include conduct which indicates that the officer is unable or unfit to continue as a member of the Department, of tends to irmpair the operation ofthe Department or its other members, Although tis by no means ‘an exhaustive list, violations of the following rules of conduct shall be considered Conduct unbecoming a police office: RULES OF CONDUCT 1. Employees must be punctual in their attendance and shall not abuse sick leave 2. Emplojoes shall promptly obey, without reservation, the rules, drectives, Fegulations and orders of the Department and all lawful orders and dicecives of ¢ ‘superior officer. 3. Empioyees shail be courteous to each other and members ofthe general pubic, Employees shall not engage in any conduct that would cause to dered, lower ot injure the morale of any member ofthe Department or the Department in general, 4. Employees, except on a need to know basis, shall keep matters confidential and shall not divulge information that has come to their attention cegarting pending andior slosed criminal and intemal Affairs investigations and matters unless ‘authorized to do so by the Chief of Police or, in the Chief's absence, hisMher designee. With the exception of ‘speech” daemed by provailing sou decisions. to be protected by the First Amendment to the United States Consttution, of section3, 4 oF 14 of aticle frst ofthe Connecticut Constitution, or relevant state and federal statutes, employees shall not tak for publication, make public ‘Speeches on police business or impart information relating tothe offical business of the Department uniess authorized by the Chief of Police or, in the Chiet's ‘absence, hisiher designee. 5. Employees are prohibited from bringing into the workplace intoxicants or ‘areotcs substances, except in accordance to law or polcy or as may be prescrited by a licensed physician. Employees shall not render themselves unfit {for work due to intoxicants or narcotic substances. 5. Employees are expected to be truthful in all matters and shall not knowingly enter ‘r cause to be entered into any Department books, records or reporis, any inaccurate, false or improper information, 8. Employees shall have respect forthe property ofthe Department and the propery of others. To this extent, employees shall nat wilfuly damage or ‘misappropriate the property of the Department or the property of others. Employees shall not mark, mar or deface any printed or writen notice, ‘memorandum, general order, directive, of any notice posted on a bulletin board OF blaccbaard maintained by the Department. No employee shall post any item Which is derogatory or offensive to another employee. 8, Employees are expected to perform their respective assignments and tasks in a professional manner. Employees shall nat engage in personal business while working: however, the administration ofthe police department realizes that family or personal emergencies might occur that could affect the application of this rule, 10, Police ofcers shall not make recommendations for the disposttion of any case: pending in the courts without the knowledge and consent of the Chief of Police or histher designee. 11, Employees shail answer any duly issued subpoena or court directive prompty, and shall appear as required in their proper uniform or business atte as directes by ther supervisor or counsel. Employees shall testy wth strict ‘accuracy, confining themselves tothe case before the court or administrative ‘agency, neither suppressing nor overstating the facts, 12, Employees are expected to present themselves in a businessike manner. To this extent, police officers are expected to be in the proper uniform and present a ‘neat and professional appearance (except as otherwise authorized by the Chief of Police or histher designee). Cvilan employees are expected to wear ‘appropriate business attire and present a neat and professional appearance, 18. Police cficers shall properly patrol their beat while on duty. No police officer shall leave histher prescribed area of patrol without the full knowledge and approval of 4 supenisor except in exigent circumstances, Supervisory approval shall not be Unreascnably withheld, 14. Police officers, while on duty, shall carry onty the equipment on their duty belt that has been ether issued or authorized by the Department. Use of Unauthorized firearms is prohibited, 15. Employees are expected to show courtesy to supervisory Departmental personnal both on and off duty. 16, No employee of the Department shall commit any act contrary to good order and discipline or constituting neglect of duty. Any employee who has established a record based on written documentation or testimony, indicative of non-compliance with the rules Fegulatons and General Orders of the Department, or an inabilty or tunwillngness to propery fulfil the tasks as outlines in his/her job description shall bbe sutject o disciptinary action upto and including termination of employment. ‘The principle of progressive discipline shall normally apply in the implementation ofthis rule. 18, Employees of the Department shall not make for their own use any lst, found or stolen property nor convert to their own use any property ofthe City of New. Haven or property held by the Department for evidence, 19. Employees ofthe Department shall net fabricate, withhold or destroy any ‘evidence of any kind. 20. No employee of the Department shall commend to any prisoner the employment of any person as bondsperson, attomey or counsel, 21. No employee of the Department shail become bondsperson or surety for any ‘Berson arrested upon a criminal charge except a relative within the class of parent, child, bother, sister, husband, or wife 22, No employee of the Department shall influence or attempt to influence by threat ‘of otherwise the business of any citizen or group. 23. No-employees ofthe Department shall endorse any application fora license Permittng the sale of alcoholic iquor, become surety or bondsperson for any Person obtaining such license or have an interest in any such license, directly of indirecty. 24, _Allemployees of the Department shall remain in suficient physical condition to satisfactorily perform the duties and responsibilties ofthe position, 25. No employee of the Department shall under any citcumstances whatsoever loan money or borrow money from or otherwise become indebted to, drecty, or Indirect any other member of the Department. 28. No Swan members of the Department shall make an arrestin a quarcel in which they or a member of their immediate family are involved, except when there is no other ofcer avaliable to do so, 27, The Department has assigned lockers to each swom personnel to provide them with a piace to store Department issued equipment. The locker shall contain a, Department issued uniform appropriate to the season, The locker shal be kept in {a neat and sanitary condition. Itis understood that lockers are provided by the Department forthe convenience of the employee and that no right o privacy GENERAL ORDER 1.03 Page 12 of 12 ‘exists or should be expected. The Department reserves the right to have two ‘Supervisors enter an employee's locker without notice to inspect for sanitary conditions andor contraband. This will be approved by the Chief of Police or hiser designee and timely notification will be made tothe union except in Circumstances where such notification will hinder an investigation. No personal locks are permitted, 28. GENERAL ORDERS oe rok, (@} ee PATROL OPERATIONS 400.1 PURPOSE ‘The purpose ef this General Order is to establish administrative procedures that will ensure unifermty and compliance with regulations pertaining to the Operations Division. 400.2 POLICY Its the policy of the New Haven Department of Police Service to maintain order and to provide law enforcement, emergency response, and social service functions to the Ctizens who reside, work and Visi In the Gly of New Haven, 400.3 PROCEDURES A. PATROL FUNCTION + The Patrol Division is comprised of police districts. Each distct is @ {geographic area that is staffed with uniformed police officers responsible for providing 24-hour a day police service +The patrol component shall be responsible fo the following major activities: a. Preventative Patrol: Officers shail patrol in @ manner that may Prevent criminal activities, trafic accidents, traffic violations, maintain public order, and identify and remedy public hazards. Response to calls for service: Officers shall be dispatched to emergency and non-emergency calls to provide service in response to specific requests, ©. Crime prevention: Officers shall participate in activities designed to anticipate, recognize, and appraise crime risks and shall initiate action to remove or reduce such risks. Unike preventive patrol, crime prevention actives shal focus on a partnership between the police and the community. 4. Investigation of offenses: Officers shall conduct investigations into criminal offenses. This responsibilty includes preliminary investigation which inciudes but isnot limited to the following: iL secure the crime scene ii. determine the nature of the offense i identify and interview witnesses Iv. determine the circumstances of the offense v. collect evidence Vi. obtain statements vil identity and interrogate the offender vill. apprehend/arrest the offender ix. complete reports ©. Traffic accident investigation: Oficers shall investigate motor Vehicle accidents that result in damage to vehicles andior property, inuries to people, etc. and take the proper enforcement action. 1. Traffic enforcement: Officers shall wam, cite, or arrest persons alleged to have violated a trafic law, ordinance, or regulation, 9. Maintaining public order: Officers shall take action intended to identiy and correct situations that, while possibly not criminal in nature, may serve to disrupt public peace and order, tuations may include disorderly persons, civil disputes, public eyesores of annoyances, etc B. OPERATIONAL PROCEDURES Rall Calls 2. A formal roll call shall be conducted prior to each shit. The roll call wil be conducted by the Shit Commander, however, this ‘duty may be delegated to a Supervisor if appropriate, ». It is the responsibilty of each supervisor to monitor radio transmissions. and respond, as circumstances permit, to the scene of incidents in which supervisor involvement may be ‘required to expedite resolution ofthe incident. , Supervisors shall respond to all major crimes, injuries or accidents involving officers, complaints or inquiries involving officers, civil disturbances, natural or man-made disasters, and other incidents of a significant nature. Upon arival, the supervisor shall assess the situation, deploy personnel, notity proper specialized units or command staff, and take any other ‘appropriate action, + Assignments Requiring Preliminary Investigation by Officers. 8, Officers shall be responsible for the intial investigation of all incidents that they encounter, of to which they are assigned, Unless otherwise directed by a supervisor. The extent to which they continue the investigation shall generally depend upon the complexity of the investigation. Certain investigations may be transferred to the Investigative Services Division.
