Dear Fellows,

This brochure was prepared by the Commission on


Elections to present profile of the candidates for the 2014
officials for the Philippine Orthopaedic Association and
the Philippine Board of Orthopaedics.

The Elections shall be held on Thursday, November 14,


2013 at the EDSA Shangri-La Hotel, Mandaluyong City
during the 64th POA Annual Convention.

There are 15 candidates for 11 positions to the POA


Board. Voters must fill up all 11 slots otherwise votes will
be invalid. Please be informed that there are no more
regional representatives and all seats are for At-Large
position based on the newly ratified By-Laws.

For PBO, there are 8 candidates, 5 at-large and 3 regional


representatives. Voters must fill up 4 at-large candidates
for 4 winners for a valid vote. The PBO By-Laws allows
regional representation.

Univote from Unilab will assist in the electronic voting


together with the Comelec members.
POA ELECTION CODE
TITLE I
GENERAL PROVISIONS
SECTION 1 Name
This Code shall be known as the Election Code of the Philippine
Orthopaedic Association, Inc.

SECTION 2 Declaration of Policy


The preservation of the sanctity of suffrage is the responsibility
of the Association. Electioneering for the position of the Board of
Trustee is an affront to the dignity of the office and shall not be
tolerated at all.

TITLE II
IMPLEMENTING BODY
SECTION 1 Commission on Elections (COMELEC)
This Code shall be implemented by an independent commission
as provided in ARTICLE X of the POA By-Laws, known as the
Commission on Elections.

SECTION 2 Composition and Tenure


a. The Commission shall be composed of five (5) members
from past presidents and senior fellows in good standing
appointed by the current Board, who have not been
candidates for any elective position one year prior to their
appointment. They will serve for a period of one (1) year
subject to reappointment by the Board.
b. The Chairman shall be elected by the members.
c. Any vacancy in the Commission due to incapacity or removal
for cause shall be filled up by the Board of Trustees to serve
the unexpired term of the position.

SECTION 3 Qualification
The members of the COMELEC shall be Past Presidents, and/or
Senior Fellows of the Association (60 years old and above) in
good standing.

SECTION 4 Powers and Responsibilities


a. The COMELEC shall have full power in implementing the
provisions of this Code. It shall have the authority to
promulgate rules and regulations to facilitate its functions
and enforce its disciplinary powers.
b. The COMELEC shall have the power to suspend or disqualify
candidates for violation of this Code. It may suspend,
postpone, or cancel an election when deemed necessary.
c. The COMELEC shall be responsible for the preparation and
supervision of orderly elections, plebiscites and referenda of
the Association.
SECTION 5 Removal from Office
A member of the Commission may be removed from office for
cause by two-third (2/3) vote of the POA Board of Trustees.

TITLE III
SELECTION OF CANDIDATES
SECTION 1 Nominations Committee
a. The Board of Trustees shall appoint a Committee on
Nominations composed of five (5) Past Presidents of the
Association and the concurrent POA President as non-voting
member. They shall serve for 3 consecutive years to ensure
continuity.
b. The Chairman shall be elected amongst themselves. The
Nominations Committee shall function as a search
committee and will submit names to the COMELEC not later
than 2 months prior to the election date.

SECTION 2 Selection Process


a. The Nominations Committee will screen applicants and will
submit a maximum of 15 candidates to the COMELEC
b. Subspecialties and chapters can recommend candidates for
consideration by the committee.
c. Direct Nominations
1. Direct Nominations should be received by the
Nominations Committee to accept or reject the
nominations.
2. Any five (5) fellows in good standing may nominate
a candidate for Trustee in writing with the consent
of the nominee
3. The nominee shall complete the requirements and
submit to the Nominations Committee before the
deadline.

SECTION 3 Qualifications of Candidates


a. A candidate shall be in good standing and a member for at
least five (5) years from the date of induction.
b. The candidate should not be a concurrent PBO Board
Member, POA Chapter president or subspecialty president.
c. The candidate must be of good moral character
d. An application letter must be submitted indicating the
following:
1. Intent to run for office
2. Statement on how he can be an asset to the Board
3. Sworn statement of Conformity that the candidate
will abide by the provisions of this Code
e. A standard candidacy form will be accomplished together
with the application letter. (Attached)
SECTION 4 Final Lists of Candidates
a. The COMELEC shall approve a maximum of fifteen (15)
candidates to vie for the eleven (11) elective seats of the
Board of Trustees.
b. The COMELEC shall circulate a brochure to announce the
final list of official candidates.

SECTION 5 Voters
Only Fellows in good standing shall be allowed to vote in person
during the Annual Election. The Secretary of the Association
shall provide the COMELEC with the list of Fellows in good
standing based on the criteria as determined by the Board of
Trustees. Payments of dues, fees, and assessments, and
compliance with the attendance requirements of the Association
shall be pre-requisites to be in good standing.

TITLE IV
PROHIBITED ACTS AND PENALTIES
SECTION 1 Conduct of Campaign
The Commission shall have the sole authority to determine what
the proper conduct of campaigning is and to impose
corresponding sanctions for violations thereof.

TITLE V
THE ELECTION
SECTION 1 Date, Time, and Place
Elections, amendments, referenda and plebiscites of the
Association shall be scheduled by the Board of Trustees unless so
provided in the By-Laws.

SECTION 2 Manner of Voting


a. Voting for elections shall be in person and by secret ballot
and shall not allow any proxy voting.
b. Voters shall be required to vote eleven (11) candidates for
Trustees, otherwise the ballot shall be declared invalid.
c. Proxy votes not allowed.

SECTION 3 Canvassing and Proclamation


The canvassing of votes shall be conducted by the Commission
immediately after the election. Proclamation of winners shall
follow thereafter.
