AFFIDAVIT OF ADVERSE CLAIM

We, SPS. A., of legal ages, Filipinos, legal spouses and residents of
____________________________________, after having duly sworn to in
accordance with law, depose and state that:

1. We are the present occupants of a portion of the properties covered by Tax

Declaration Nos. ____________________________, with a total area of
_____________________________ square meters, more or less
(______sq.m.);
2. The aforementioned properties were formerly registered in the name of SPS.
B;
3. On January 1, 2000, the said properties were mortgaged to the Land Bank
of the Philippines in the amount of TEN MILLION PESOS (₱10,000,000.00);
4. Due to financial difficulties, SPS. B could not settle their obligations from the
bank;
5. To prevent foreclosure of the said properties, we were persuaded by SPS. B
to pay their obligation and to secure the release of the said mortgage, in
exchange for the transfer of the properties to our names;
6. Out of respect and consideration to SPS. B, we did not bother to have the
properties transferred to our names, despite our agreement;
7. However, upon verification with the City Assessor’s Office, we have found
out that the said properties were already sold to a certain Mr. C without our
knowledge and consent and despite our agreement, and that the latter have
caused its transfer in 2002;
8. We were hurt and disappointed with SPS. B’s doing;
9. As we were from the same organization, we would like to settle this matter
with them amicably, but we are now left with no recourse but to take legal
action against them;
10. After filing a complaint in the barangay, sadly and unfortunately, we did not
come into terms with SPS. B and are now constrained to file a case against
them in court;

11. We are executing this affidavit to attest to the truthfulness of the foregoing
and for the purpose of having the same annotated on the tax declaration to
protect our interest on the subject properties.
