to fund its expansion plans but
does not rule out going to the
market in the future, its chief
executive told Al Arabiya news
channel on Tuesday.
Mohammed Sharaf said the
company did not need additional
liquidity until the end of 2012 but
was studying ways to finance

imported or exported goods is
the value actually paid or
payable for the goods. While,
as a matter of rule, the
transaction value has to be
adopted for purposes of
assessment, the customs do
have the powers to question
the correctness of the
declared value. The proper
officer of customs must have
reasons to doubt the declared
value and such doubts should
be on some strong basis. Only
then, the correctness of the
declared value can be
questioned. Rule 12 of the
Customs Valuation
(Determination Of Value Of
Imported Goods) Rules, 2007

officer to reject the transaction

doubted, but such grounds,
shall, as said above should be
on strong footing; a mere
doubt or suspicion is not
enough. In fact, the moment
the proper officer raises doubt
on the declared value, the
importer can insist the proper
officer to give the grounds of
his suspicion in writing. This
rule itself clarifies that it only
provides a mechanism and
procedure for rejection of the
declared value; it does not
provide the method for
determination of the value.
The various judicial forums
have ruled that the first step
in determining the value of the
goods, where the declared
value is doubted, is to first
reject the transaction value.
Without rejecting the
transaction value on a legally
sustainable basis, one cannot
proceed to determine the
value of the goods. In the
context of the erstwhile rule
10A of the Customs Valuation
Rules, 1988 which is similar to
rule 12 of the Imported goods
rules, the Kolkata Bench of the
Appellate Tribunal held that the
application of the rule itself
does not require proof with
hard evidence; it only talks of
reason to doubt the truth and
accuracy of the declared
value, vide the judgment
reported in 2009 (238) E.L.T.
95 (Tri.-Kolkata).
In another ruling, namely,
2010 (252) E.L.T. 523 (Tri.-
Kolkata), the same Bench has
held that rule 12 of the
Imported Goods rules does
not empower the proper
officer to reject the
transaction value without
establishing that the
transaction value was not
genuine. The Apex Court has

rejected, the value can be
determined under the other
rules, by proceeding
sequentially.
Rule 12(2)(iii) of the
Imported Goods rules states
that the proper officer shall
have the powers to raise
doubts on the truth or
accuracy of the declared
value based on certain
reasons; this clause also lists
some of the grounds on
which the doubt could be
entertained. The list given
here is only illustrative. The
grounds given here are (i)
importation of similar or
identical goods at a why the article could not be
significantly higher price in
comparable quantities and at
around the same time; (ii) the
sale involves an abnormal
discount or abnormal
reduction from the ordinary
competitive price; (iii) the sale
involves special discounts
limited to exclusive agents;
(iv) noticing misdeclaration in
respect of description, quality,
quantity, country of origin,
year of manufacture or
production; (v) failure to
declare brand, grade,
specifications relevant to
value; and (vi) production of
fraudulent or manipulated
documents. Most of the
grounds given above are easy
to understand. If the proper
officer finds any one or more
of the above grounds, he is

entitled to entertain doubts
on the truth or accuracy of
the declared value. Once he
gets a doubt in this fashion,
he will have to call upon the
importer to explain and
produce the documents in
support of the declared price.
It is possible that in some
cases the lower price is
justifiable on account of
many factors. For instance,
an article manufactured on
the basis of a specific order
to suit only the customer
who placed the order may be
sold to him at a lower price,
after a long passage of time,
because there is no other
customer. Ofcourse, even
here the importer has to
convincingly explain as to
imported soon after placing
the order. After receipt of the
explanation and perusal of
the documents, if any
produced as evidence, the
doubt may still persist in the
minds of the proper officer.
In that event, he can
continue with the enquiries or
investigation; but ultimately,
the burden is on the
department to prove that the
declared value is not correct.
The transaction value can be
rejected and then comes the
question of what should be
the value or what should be
the deemed value. When the
transaction value is rejected
in the aforesaid method, the
value has to be determined
for purposes of assessment.
