MANAGEMENT COUNCIL

MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This agreement made and entered into this ______ day of _________ 2019 at
Magallanes Agusan del Norte by and between:

The MUNICIPAL GOVERNMENT OF MAGALLANES, Agusan del Norte, a local

government entity duly organized and existing under the laws of Republic of the
Philippines with the principal office at the Municipal Hall, Magallanes, Agusan del Norte,
represented in this Act by its Municipal Mayor, HON. DEMOSTHENES H. ARABACA,
pursuant to SB Resolution No._________ and hereinafter referred to as the
MUNICIPALITY.

MAGALLANES DISTRICT SCHOOLS, used as the TEMPORARY EVACUATION

CENTER in the Municipality of Magallanes, Agusan del Norte, represented by the District
Supervisor, MRS. MARIA VICTORIA GAMUTAN, of legal age, Filipino, married herein
referred to as MAGALLANES DISTRICT SCHOOLS.

WITHNESSETH, THAT

WHEREAS, the promulgation of R.A 10121 provided the strengthening of the Philippine
Disaster Risk Reduction Management System and providing for the NDRRM framework
and institutionalizing the NDRRM plan, appropriating funds thereof and for other
purposes;

WHEREAS, the promulgation of R.A 10121 has also provided the strengthening of the
Philippine Disaster Control Capabilities and the establishment of the National Program on
Community Disaster Preparedness;

WHEREAS, the implementation of a vigorous disaster preparedness program at the

community level is required with the full support and cooperation of the local officials and
committed individuals;

WHEREAS, in the past, the region was hit by flood which brought enormous suffering to
its people and destruction of properties, public and private. Every time disaster happens,
the community, its leaders and institutions shows inadequate in coping with the disaster
situation;

NOW THEREFORE, for and in consideration of the foregoing contingent disaster situations
and in the interest of public safety and necessity, both parties do hereby mutually commit
to bind themselves through the principle of volunteerism and reciprocity under the
following terms and conditions:

FOR THE LOCAL GOVERNMENT:

1. That the Local Government Unit of the Municipality of Magallanes will shoulder
the repairs and damages to schools used as the evacuation centers during the
occurrence.
FOR THE MAGALLANES DISTRICT SCHOOLS:
1. That during the occurrence of the municipal calamity or disaster, the Magallanes
District Schools of the Municipality of Magallanes, Agusan del Norte shall provide
the designated school and rooms used as the evacuation for the evacuees.
FOR THE EVACUEES:
1. That the evacuees is mandatory to maintain the cleanliness of the following, to wit:
a. Rooms
b. Toilet
c. Kitchen
d. Other facilities
IN WITNESS WHEREOF, the parties have hereunto affixed their signatures this _________
day of ________________________, 2019 at Magallanes, Agusan del Norte, Philippines.
