Agreement of Policies and Procedures

Overview

We invite you to experience our unique banquet facilities. Whether hosting a small
business meeting or gourmet dinner party in our Private Dining Room, or an all day
conference, luncheon, or dinner dance in our Banquet Hall, we can accommodate your
individual needs and delight your guests.

Specializing in plated dinners and lunches, we can also prepare buffets to suit your tastes.
Our Banquet Hall overlooks Marquette’s Lower Harbor of Lake Superior and
comfortably seats 300 with a stage for musicians and a dance floor. Attention to detail is
our specialty and we will create for you an event to exceed your expectations. We can
also provide concentrated seating for up to 600 guests for lectures, concerts, or
presentations.

Deposits

A $200 deposit is required to confirm a function in the Banquet Hall. At the time the
deposit is paid, you will receive a “Booking Agreement” which states the overview of
your function (see attached). At a later date, you will go into a detailed “Function Sheet”
(with a banquet representative) the will walk you through the event step by step (see
attached). Our policy permits you to be “penciled” in for a particular date until you pay
your deposit. If someone requests the same date, you will be contacted to make your
decision and provide the deposit or the room will be given to the other party. Upfront &
Company makes no guarantee of a date’s availability unless a deposit is paid.

Deposits must be paid at the time the booking agreement is signed. Deposits are Non-
Refundable from the day received.

Room Rentals

Every group using a banquet room will be assessed a room rental fee. The room charges
are as follows:

Wedding functions will be available to decorate after 2:00 p.m. Decoration earlier than
2:00 pm will be considered a full day usage of the room. Upfront & Company staff may
be available to assist with the decorations of the room for a nominal fee.

If both the private dining room and the banquet hall are required to accommodate your
function, room charges will apply for both rooms.
Upfront & Company reserves the right to move your function between the rooms based
on changes in party sizes without prior notification.

Menu Selection

Our experienced banquet staff will assist you in selecting a menu to suit your occasion.
Our specialty is plated entrees: however, we do serve buffets as well. To ensure food and
health safety of all buffet-style banquets, food will not be maintained longer than 2 hours.
Many variables should be considered and discussed in order to choose the best option for
yourself and your guests.

Menu selection for all parties of 100 guests or more are requested one month in advance.

For parties of 100 to 200 guests, a choice of three entrees, e.g. chicken, beef, or fish, may
be offered. For parties of 200 to 300, a choice of two entrees works well, e.g., chicken or
beef, or a combination plate, which can be created with the banquet chef.

Offering your guests a choice requires you to request responses and keep a record of
names and choices. You will turn in those responses to us one week prior to your
function. The night of the function, your guests will stop at a registration table and upon
providing their name will receive an entrée card with their pre-selected dinner choice.
They place the card at their setting so the servers can identify what to serve.

We are happy to offer breakfast meetings, brunches, or dinners even when it is not within
our regular operating hours within the following guidelines:

All breakfast functions have a 20 person minimum


All lunch functions have a 20 person minimum
All dinner functions have a 30 person minimum

We offer a variety of menu choices on our Select Menus, which may be used for parties
of fewer than 35 people. Your guests may order from select menus as they arrive, saving
you the work of offering a choice of 3 entrees and requesting and recording RSVP’s. For
groups over 35 people, you must pre-order.

Please note that our kitchen staff if happy to work with dietary concerns. Please notify us
of any special menu needs.

Timing Your Function

In order to provide the finest service to your group, the timing of your dinner is very
important. Our experienced banquet staff will assist you in organizing the entire evening.
Our banquet staff will be ready to serve your meal at the time designated by your on your
function sheet. This time should be carefully selected with your banquet coordinator
according to scheduled time for the social hour, arrival of the bride and groom, or timing
of the presentation or speaker, as well as any other planned activities. There is room for
some adjustment, however, any significant change in your meal time can only be adjusted
prior to the day of your event.

Function space will be accessible 30 minutes prior to the start time unless other
arrangements have been made with the banquet coordinator.

Guaranteed Attendance

Your guaranteed number for banquet functions is required at last one (1) week prior to
your function. However, initial numbers are requested one month in advance. The
number of guests that you guarantee will be the minimum number charged for billing
purposes. If the number of guests exceeds your guarantee, you will be responsible for
payment of full attendance. We will make every reasonable effort to accommodate the
extra number of guests with same or comparable arrangements.

Upfront & Company does not allow food to be taken off the premises.

Payment Policies

It is important that you make an appointment with the banquet planning staff the week of
your function to go over final details. Once you have provided the guarantee of the total
number of guests attending, payment is expected for the food portion of your bill. We
understand that several parties may be contributing to the total bill and we can separate
the bill accordingly.

We accept local checks, certified checks, and credit cards. Because it is difficult to arrive
at an exact total for the bar bill prior to the function, unless everything is pre-ordered, you
may pay for that portion of the bill the night of your function. You can pay an estimated
amount in advance and the balance the night of the event.

Payment in full is due for the entire function at the completion of each function. You will
receive a receipt that will show you an itemized list of everything purchased.

In the event that total payments made in advance exceed the total bill for the event, our
corporate office will refund the excess portion to the host within 7 business days.

All payments under this agreement shall be paid in the legal currency of the United
States. If any payment obligation under this agreement is not paid when due, the host
promises to pay all costs of collection, including reasonable attorney fees, whether or not
a lawsuit is commenced as part of the collection process.

Food and Beverages (Cakes)

No food or beverages will be allowed to be brought onto the premises. We do allow an


exception for cakes to be brought in for special occasions, such as receptions, birthday
parties, showers, etc. If you choose to bring in a cake, our staff will cut and serve the cake
at no additional charge.

Any cake remaining after the function is completed must be taken home the same day of
the function. We recommend, especially for receptions, that someone is designated to
take home the wedding cake top to prevent the top from being discarded.

Alcoholic Beverages

No alcoholic beverages other than that provide by Upfront & Company and purchased
from authorized Michigan resellers will be allowed on the premises. No exceptions.

All applicable liquor laws must be observed at all times during your function.

Cases of wine can be purchased for your function. All wine purchased specifically for
your function must be purchased. Unopened bottles of wine my be taken with you since
Upfront & Company has an off premise license.

Banquet Bar

Each function has individual needs for bar set-up; this allows you to customize the bar
according to your individual desires. For example, if the host bar is serving beer, wine
and select liquors, the bar will be stocked with those selected liquors. Upfront &
Company will also maintain premium liquors behind the bar. Any sales, other than
selected liquors, will be sold as cash sales not charged to the host. The only time other
liquors are added is when there is a cash bar (guests paying for their own drinks). We
recommend a tasteful table tent to be set at the bar telling your guests what you are
hosting. If you are hosting beer and wine, but all liquor is cash, then our experienced bar
staff will stock the bar according to what is generally sold at functions.

There is a $50.00 set-up fee for the stationary bar used during your function, and a $30.00
set-up fee for each portable bar. (There are two portable bars available and we will help
you to determine if the additional bars are needed according to what you are hosting, the
number of guests, length of social hour, etc.)

Beer is paid for by the keg or case (if you are serving bottled beer); wine is purchased by
the case or bottle, and cocktails are charged by the ounce, e.g., $2.50 per standard ounce,
$3.50 per premium ounce, and upward. Prices include ice, glasses, napkins, straws,
mixes, and garnish.

When hosting an open bar, a professional bartender will be provided at no additional


charge provided that the total alcoholic beverages consumed total a minimum of $300.00.
If the total alcoholic beverages consumed are less than this amount, a charge of $50.00
per bartender will be assessed to the host.
Decorating or Altering Banquet Rooms

Upfront & Company reserves the right to inspect the decorations of all functions. The
affixing of anything to the walls, doors, floors, or ceiling of the room with nails, staples,
tape, or any other substance will not be permitted. Our staff will assist you in utilizing the
nails that have been strategically placed. No crepe paper or confetti is to be placed on the
table linens. All balloons must be weighted. Any damages incurred to the property will be
the financial responsibility of the host. Upfront & Company reserves the right to remove
or alter any decorations which may cause damage to our facilities or equipment.

Rental items available from Upfront & Company include chair covers, octagon mirrors
for the center of the tables, elegant table candles, champagne or punch fountain, lead
crystal votives candle holders, and more. While candle light for ambience is highly
recommended, Upfront & Company requires the wax candles reside on a base to prevent
candle wax from spilling onto the table cloths. Colored candles will only be permitted if
the candles are contained.

Damages

Any damage, theft, or loss to the property, building, company equipment, decorations, or
fixtures due to the activities of the host or its guests will be the responsibility of the host.
Upfront & Company will be held harmless for any loss or damage to any property of any
third party.

Security

Upfront & Company will not assume responsibility for any damage, injury, loss of
merchandise or articles of the host or its guests left on the premises prior to, during, or
following a banquet or meeting. The host assumes all responsibilities for any actions and
any liabilities of self or guests that may occur. Upfront & Company may request or your
may provide your own security for exhibits, articles, or merchandise set up for display
prior to planned events. Not providing your own security is the risk of the host.

Pricing, Taxes, and Gratuity

All functions are subject to 20% service (gratuity) charge an all applicable state and local
sales taxes (6%). All prices are subject to change at any time. For all food items,
alcoholic beverages, non-alcoholic beverages, rentals, gratuities, etc., the prices charged
will be the current rates at the time of the function.

Personal Articles

Upfront & Company is not responsible for personal articles left on the premises. We
strongly recommend that you designate someone that would be responsible for collecting
all personal articles at the end of your function.
Disclaimer

Upfront & Company’s obligation under this agreement are contingent upon its ability to
perform and accordingly are subject to labor disputes or strikes, restrictions upon travel
or acts of God or any circumstances beyond the control of Upfront & Company which
prevent Upfront & Company from performing its obligations. Upfront & Company will
in good faith provide all items and services agreed upon, but reserve the right to make
substitutions with similar items or service fro any item or service not readily available in
the open market with the prior consent of the host, and at a reasonable price.

Signature

The person executing this agreement at the Organization’s representative expressly


represent that he or she is over eighteen (18) years of age. Where the Organization is a
corporation, an unincorporated association, partnership, or other legal entity, this
agreement shall be binding on such legal entity, its successors and assigns. The person
executing this agreement as Organization’s representative expressly represent that he or
she is authorized to execute said agreement on behalf of the Organization. The
Organization will therefore be considered the host of the function as referred to
throughout this Agreement.

Note: Signing this agreement designates that you are in agreement and understand the
terms set forth herein. Changes to the agreement as stated must be in writing and signed
by both parties.
