Smith B/M Date of Birth 06-24-84 SWORN STATEMENT OF POLICE OFFICER The undersigned officer hereby states that on the 2nd day of January, 2020, at about 1:20(P.M.), a police officer of the Decatur Police Department (police agency) made a warrantless arrest of Eddie E. Smith (piace of arrest) in Macon County, Illinois upon the following grounds or cause (briefly state the facts or grounds for arrest) All events occurred in Macon County, IL: On 01-02-20, Decatur Police attempted to make a traffic stop on a maroon Cadillac CTS IL REG £LM 6 in the 1000 block of N Water Street. tur Police observed the driver of the Cadillac fail to activate their turn signal within required distance at the intersection of Marietta and Water. When the Cadillac turned northbound on Water, Detective Larner activated the red/blue emergency lights, thus initiating a traffic stop on the Cadillac. All four (4) windows on the Cadillac were rolled up. The driver of the vehicle did not yield and continued traveling northbound on Water, before making a subsequent west bound turn onto Leafland. At the intersection of Leafland and Main, the driver of the Cadillac blatantly disobeyed the STOP sign at the interseczion, traveling around 4 stopped vehicle and nearly causing traffic accidents with innocent motorists traveling southbound, The Cadillac along with ¢ occupants then fled westbound on Leafland at a high rate of speed. Based on the blatant disregard displayed by the driver, Detective Larner terminated the event and pulled to the side of the road. Detective Larner estimated the speed of the Cadillac to be approximately 80mph as it traveled west bound toward the intersection IN THE CIRCUIT COURT FO THE 6" JUDICIAL CIRCUIT MACON COUNTY DIVISION of Leafland and Edward. The driver of the Cadillac blatantly disregarded the STOP sign at Leafland and Edward. Detective Larner observed the Cadillac continuing to travel westbound on Leafland. Detective Larner observed the Cadillac making a northbound turn in the area of 1200 N College, Decatur Police Detective Chad Ramey observed the Cadillac pull into the west alley of 1200 N College. Detective Ramey observed all of the windows roll down as the vehicle traveled north bound through the alley. Detective Ramey then observed four (4) B/M subjects running west bound across Monroe, Detective Ramey observed the four (4) jumping the fence on the northeast corner of the Roosevelt Apartment located in the 700 block of W Grand. Detective Ramey identified Eddie 2. Smith as being one (1) of the four (4) subjects fleeing on foot. Detective Larner continued to the west alley of 1200 N College and located the abandoned Cadillac parked behind 1260 N Monroe. Detective Larner observed Jerry L. Bryson, B/M, Date of Birth 03-02- 94 running southbound along the east side of the Roosevelt Apt Town Homes. Bryson Jr committed the offense of Criminal Trespass to a Residence when without permission or authority he (Bryson Jr) entered and remained inside of 1225 N Monroe Apt 3 in an attempt to evade capture. The residence was occupied by two small children, and their mother who was entering the residence. Decatur Police Detectives surrounded the residence. The home owner confirmed that an unknown male matching Bryson Jr’s description was hiding inside of her residence. Bryson Jr subsequently surrendered without further incident and was taken into custody. Bryson Jr denied knowledge of being present inside of the Cadillac and refused offer an explanation for running from the Police. While pursuing Eddie E. Smith on foot, Detective Hockaday was injured. While jumping over an ircn fence, Detective Hockaday received lacerations and abrasions to his left shin and right wrist, Detective Hockaday located Eddie E. Smith near 625 W Grand Apt # 6 (Roosevelt Apt Complex). While taking Smith into custody, Detective Hockaday located the ignition key to the Cadillac in his (Smith's) pocket. During a Mirandized Interview, Smith admitted to being Present inside of the Cadillac, but denied being the driver and denied a reason for fleeing on foot. Sergeant Timothy Maxell located Leon A, King, B/M, Date of Birth 08~ 31-92 on the parking lot of the Roosevelt Apt Complex. King was taken into custody. During a Mirandized Interviex, King admitted to being a passenger in the Cadillac, but stated he was “sleeping.” King stated he only fled on foot because he is currently wanted IN THE CIRCUIT COURT FO THE 6” JUDICIAL CIRCUIT MACON COUNTY DIVISION through the Macon County Sheriff's Office for traffic related charges. The fourth passenger was unaccounted for. A black cotton ski mask was located next to the passenger side of the Cadillac. The ski mask was in “like new” condition. It was not wet and appeared to have not been there very long. Detective Larner deployed his K-9 partner, LEFROY JENKINS, in the west alley of 1200 block of N College St. LEEROY conducted an article search (a search for items of evidentiary value). During the article search, LEEROY located two (2) handguns. * Handgun #1 located by LEEROY on the west side of the alley: one (1) 9mm semiautomatic (make: Taurus / model: G2C 9mm caliber The serial number was obliterated/defaced. This firearm contained an inserted, extended magazine. The magazine is capable of holding approximately 30rounds. The magazine contained numerous live/unspent rounds. A live/unspent round was discovered to be chambered inside of the firearm. The condition of the firearm was conducive to it not having been there for a considerable time. The firearm contained no apparent rust. On one side of the firearm, streaks of fresh mud and dirt were present. The condition of the firearm, along with the K9 indication, provided credence to the fact that the firearm hed not been present at this location for very long. * Handgun #2 located by LEEROY on the east side of the alley: one (1) .38 caliber revolver (make: Ruger / model LCR (serial 4 $4358291 confirmed STOLEN through NCIC). This firearm contained five (5) live/unspent rounds of ammunition. The condition of the firearm was conducive to it not having been there for a considerable time. The firearm contained no apparent rust. The condition of the firearm, along with the K9 indication, provided credence to the fact that the firearm had not been Present at this location for very long. Smith, Bryson, and King all possess significant criminal histories. All three (3) are convicted felons. The following are only convictions in Macon County, IL for the three (3) subjects: Eddie E.
