DEED OF SALE

KNOW ALL MEN BY THESE PRESENTS:

This DEED OF CONDITIONAL SALE OF A REGISTERED LAND made


and entered into by and between:

JAIME B. BAYYA, married to MARINA BAYYA, of legal age, Filipino


Citizen, with residence at Roque St. Ext., Purok 5, Brgy. Plaridel, Santiago City,
hereinafter referred to as the VENDOR;

-and-

JAYSON R. BAYYA, married to SHAELYN V. BAYYA, of legal age, Filipino


citizen, residing at Brgy. Orence, Narvacan, Ilocos Sur,hereinafter referred to
as the VENDEE;

W ITNESSETH:

WHEREAS, the VENDOR is the owner of a subdivided portion of a land


covered by Original Certificate of Title No. 5036 located in Brgy. Buenavista,
Santiago City, also known as LOT 1260. He acquired a portion of such land
through the extrajudicial settlement of the estate of spouses Ambrocio and
Florencia Bayaua that the latter’s heirs had executed in 2012. LOT 1260 is
described as follows:

A certain parcel of land, identified as Lot No. 1260, of the


Cadastral Survey of Santiago, located in Buenavista, Santiago,
Isabela (now City), Bounded on the NE by lots no. 1259 and 1261,
on the SE., by lot no. 1262, on the SW., by Road, and on the NW., by
lot no. 1251, containing an area of NINE THOUSAND SEVEN
HUNDRED THIRTY EIGHT (9738) square meters, more or less

Thus, by virtue of the extrajudicial settlement and the Subdivision


Plan of Lot No. 1260 pursuant to the survey conducted on March 3, 2010
by Engr. Andres P. Tagarino, the VENDOR has acquired the FIVE
HUNDRED THIRTY (530) square-meter lot designated as Lot No. 1260-
Q in the said plan.

WHEREAS, the VENDOR has agreed to sell unto and in favor of the
VENDEE, and the VENDEE is willing to buy from the VENDOR, its ownership,
rights and interest of the above-described land with an area of FIVE HUNDRED
THIRTY (530) SQUARE METERS with a total consideration of FIVE HUNDRED
THOUSAND PESOS (Php500,000.00), Philippine Currency, under the terms
and conditions provided hereunder;

Now in consideration of the foregoing, they do hereby agree as follows:

1. That upon signing of this Deed of Sale, the VENDEE shall pay the full
amount of FIVE HUNDRED THOUSAND PESOS (Php 500,000.00).

2. Upon the Vendee’s payment of the purchase price, he undertakes to have


the extrajudicial settlement published and the outstanding realty taxes
paid, in order to comply with the laws governing the issuance of a
transfer certificate of title in his favor.

3. That the Vendee undertakes to help the other heirs in their application
for the Estate Tax Amnesty program of the Government through the
Bureau of Internal Revenue (BIR).

4. That the realty taxes and special assessments on the subject property on
or before the date of sale, cost of operation of the documents of sale, and
notarial fees shall be for the account of the VENDEE, as well as those that
shall accrue after the date of this Deed of Sale, capital gains tax,
documentary stamps, costs of registration, transfer tax, and all
incidental expenses for the issuance of the new title.

IN WITNESS WHEREOF, the parties have hereunto set their hands, and
affix their signatures this ______ day of August 2019 in the City of Santiago,
Philippines.

have satisfactorily proven to me their identity through their

same persons who executed and voluntarily signed the foregoing Deed of Sale
which they acknowledged before me as their free and voluntary acts and deeds.

This instrument consisting of THREE (3) pages, including the page on


which this acknowledgment is written has been signed on the left margin of
each and every page thereof by the parties and their witnesses.
