COMPLAINT AFFIDAVIT OF PABLO A. SIDO

I, PABLO A. SIDO JR., of legal age, married, Filipino, and a


resident of Brgy. Bolilao, Mandurriao, Iloilo City, state under oath as
follows:

Preliminary Statement

The person examining me is Atty. Mayen Mar Gulmatico, with


office address at #31 Zerrudo Commercial Complex, E. Lopez St.,
Jaro, Iloilo City, where this examination is being held. I am answering
his questions fully conscious that I do so under oath and may face
criminal liability for false testimony and perjury.

Q1: Why are you here in my office?


A: I am here to give my testimony and file a complaint against
PAT. FRIDAY JESS NAVIGAR for frustrated homicide.

Q2: Do you know this PAT. Friday Jess Navigar?


A: Not personally.

Q3: What do you mean not personally?


A: At the time of that incident, I do not know his name. I only
knew his name in the police blotter report. But, I recognize
him as the one occupying the table near my brother’s at Paho
Restobar in Paseo de Arcengeles.

Q4: You mentioned that Mr. Jess occupied the table near your
brother’s table at Paho Restobar. Why were you at Paho
Restobar?
A: I was there to fetch my brother, Mark Martin A. Sido, who
was celebrating with his friends, Kristine G. Detayson, Jenicel
B. Palmes, a certain “Tomay,” and the uncle of Kristine and
Jenicel. I was accompanied by one of our household
members, Danilo D. Paredes.

Q5: Where specifically in the establishment were your brother


and his friends celebrating?
A: In the second floor.

Q6: How long were you in the second floor?


A: Long enough, because my brother offered me and Danilo
each a bottle of beer since he will not go home until they are
finished with their drinks.

Q7: While you were at the second floor, what happened, if any?
A: We were just drinking and talking to one another. I did not
finish my bottle however because my brother told me we
should go home already.

Q8: After your brother told you that you should go home, what
happened, if any?
A: We proceeded downstairs but we could not go home because
there was a heavy downpour. We then decided to wait until
the rain subsides.

Q9: Where did you wait?


A: Near the main door of the restobar.

Q10: While you were there, what happened, if any?


A: I saw Friday Jess walking towards us. He was glaring –
fiercely and aggressively – at Tomay. He did it twice. On the
second time, he was mouthing some words at Tomay.
Q11: What did Tomay do, if any?
A: During the first time, Tomay ignored him. But, on the second
time and after what he did to Tomay, Tomay punched him in
the face. In retaliation, he likewise punched Tomay.

Q12: What happened next, if any?


A: Tomay and Friday Jess had a brawl. Danilo, my companion,
tried to pacify them by pushing both of them away from one
another.

Q13: After Danilo pushed them away from one another, what
happened next, if any?
A: I saw Friday Jess pull out a gun from his waist and fired the
same. I was hit.

Q14: Where were you hit?


A: In my right or left hip.

Q15: After you sustained a gunshot wound, what happened next?


A: I fell to the floor (kay para frustrated homicide gid ya. Vital
organ daw natamaan). When my brother and Danilo saw
what happened, they tried to pin him down and remove his
gun from his control. I gathered my strength and tried to help
them because Friday Jess was just strong. With a gun and
under the influence of alcohol, he was dangerous.

Q16: What happened next, if any?


A: We were able to pin him down and remove the firearm from
his control.

Q17: After you pinned him down and removed the firearm from
his control, what happened next, if any?
A: We went outside to call for help but we were arrested instead
by the police officers.

Q18: You said that you were hit in your right or left hip. Did you
receive any medical attention?
A: Yes.
Q19: When did you receive medical attention?
A: When we were arrested. The police officer saw that I was
wounded. He thus brought me to the Western Visayas
Medical Center (WVMC).

Q20: While you were at WVMC, what happened, if any?


A: The attending physician checked on my wound.

Q21: What are the findings of the attending physician?


A: DESCRIBE CONTENTS OF MEDICO-LEGAL CERTIFICATE.
The findings are contained in a medico-legal certificate.

Q22: I have here with me a copy of a medico-legal certificate dated


__________ and prepared and signed by ____________. It
reads ______________. Now, I am showing this to you.

Is this the medico-legal certificate you were referring to?
A: Yes, Attorney.

Q23: I am marking and attaching this medico-legal certificate as


Annex “A” to your complaint-affidavit. Do you agree to my
actions?
A: Yes.

Q24: Do you have anything else to add?


A: Yes. I pray that Mr. Navigar pay me actual damages, moral
damages for P100,000.00, and attorney’s fees of P50,000.00.

Q25: Anything more?


A: No more.
