Cermak Rd. Agreement No Chicago, IL 60623 15-016-134N-00 Dear Mr. Smith and Mr. Cunningham. This letter concerns our July 29, 2016, Notice of Proposed Termination and Proposed Disquaiifications in which this agency proposed to terminate New Life Community Ministries’ agreement to participate in the Child and Adult Care Food Program (CACFP) In that letter, we also proposed to disqualify New Life Community Ministries, Clarence ‘Smith, and Eric Cunningham from further CACFP participation. These actions were based on the determination in our July 21, 2016, Serious Deficiency Notice that New Life Community Ministries is seriously deficient in its operation of the CACFP and that Clarence Smith, and Eric Cunningham are responsible for the serious deficiency. TERMINATION AND DISQUALIFICATION Because the time to request an appeal has now expired, this agency is taking the following actions: "= Terminating New Life Community Ministries’ agreement to participate in the CACFP effective August 20, 2016, * Disqualifying New Life Community Ministries from future CACFP participation effective August 20, 2016, * Disqualifying Clarence Smith and Eric Cunningham from future CACFP participation effective August 20, 2016. Upon disqualification, New Life Community Ministries, Clarence Smith, and Eric Cunningham will be placed on the National Disqualified List. While on the list, New Life Community Ministries will not be able to participate in the CACFP as an institution or facility. Clarence Smith and Eric Cunningham will not be able to serve as a principal in any institution or facility or as a day care home provider in the CACFP. They will remain on the list until such time as USDA's Food and Nutrition Service, in consultation with our agency, determines the serious deficiency has been corrected, or until seven years after disqualification. However, if any debt relating to the serious deficiency has not been repaid, they will remain on the list until the debt has been repaid. A review of our records indicates that you owe $3,309,578.09 for Fiscal Year 2016. We are requesting that you send a cashier's check to our office for the total amount owed. Please submit your check within 30 days payable to the llinois State Board of Education, Funding and Disbursements Division (E320). Enclose a copy of this letter with your remittance. These actions are being taken pursuant to CACFP regulations 7 CFR 226.6(c)\(3). ‘SUMMARY We are terminating New Life Community Ministries’ CACFP agreement and disqualifying New Life Community Ministries, Clarence Smith, and Eric Cunningham. New Life Community Ministries may not appeal the termination of its agreement. In addition, New Life Community Ministries, Clarence Smith, and Eric Cunningham may not appeal the disqualifications. New Life Community Ministries may continue to participate in the CACFP through August 19, 2016. We will pay any valid claims within 60 calendar days of the last day of the month covered by the claim, In addition, we will deny any portion of a claim we determine is invalid. if we deny payment of any portion of a claim, that action would be appealable.
