SUBJECT: Applicability of the Right to Fair Compensation and Transparency in

Land Acquisition, Rehabilitation and Resettlement Act, 2013 to land
acquisition under the National Highways Act, 1956 _ reg.

In continuation of this Ministry's letters of even number dated 29'h April, 2015 and
12lli August, 2015 on the subject cited above, I am directed to say that for acquisition of
land under the National Highways Act, 1956, in terms of the Right to Fair Compensation
and Transparency in Land AcqUisition, Rehabilitation and
Resettlement(RF CllARR)(Removal of Difficulties) Order, 2015, it has been decided
that the provisions of the RFCTLARR Act, 2013 relating to the detennination of
rehabilitation and resettlement in accordance with the Second Schedule and infrastructure
amenities in accordance with the Third Schedule to the RFCllARR Act, 2013 or as
specified by the concerned State GOVernment in pursuance of the provisions of the
RFCTLARR Act, 2013, whichever iSTDwer, shall be applicable.

2. This may be brought into the notice of all concerned authorities dealing with
acquisition of land under the National Highways Act, 1956 for compliance.
