CHARGE: NEGLECT OF DUTY

COMPLAINANT

1. The Complainants alleged that Punong Barangay Lectura excluded them from other employees
whose contracts were renewed for the month of July 2018.

2.The Complainant accuses the Punong Barangay Zenaida P. Lectura of neglect of issuing them
contracts of renewal. Hence, no contracts of renewal was issued arising from the agreement of 02 July
2018. The contracts of renewal issued were for former employees included in the Agreement of 05 July
2018. The Complainants are among those included in the said Agreement.

3. On August 7, 2018, Complainants visited the Commission on Human Rights to seek legal advice on
the alleged act of Punong Barangay Zenaida Lectura in excluding them from other employees whose
contracts were renewed for the month of July 2018. They claimed that during the First Regular Session
of the Sangguniang Barangay on July 2, 2018, the Sanggunian agreed on the renewal of contracts of all
employees whose employment were until June 30, 2018. Thus, the complainants continued to render
their services based on their understanding of the abovementioned event.

4. The Complainants claim for wages for services allegedly rendered by them.

RESPONDENT

1.Respondent, Punong Barangay Zenaida Lectura was elected during the local election of May 2018.
Prior to her assumption of office she sought advice from DILG on what was the proper thing to do
when she assumes office.

2. The Respondent was advised to issue an Executive Order for the extension of those who she deemed
can best help her ensure the continuity of barangay services.

3. Considering the above, the Complainants are not entitled to any wages or honoraria.There was no
neglect of duty because the willingness of the Punong Barangay to give the honoraria to the
complainants for the alleged services they rendered provided they submit their Accomplishment Report
(AR) which is the basis for the release.

4. This offer was given to the Complainant. Sadly they refused to submit the Accomplishment Report.
The Complainants reasons was becuase submitting an AR was not established practice fo the previous
barangay administration.
5. Despite this grave doubt, the Respondent, Punong Barangay Lectura is willing to give the
complainants a reaosnable amount commensurate to the services they rendered provided they present
some proof which a reasonable person can accept.
