Circumstantial Evidence supporting the accused

1. Witness deposition of Ms. Shabnam Khan (DW-1) herein referred as (‘Complainant’)


undoubtedly raises a reasonable doubt about her deposition due to following mentioned
incidences and circumstances as mentioned below :
 DW-1 has stated in the Cross Examination that “I do not know the name of the said shop. I
do not know the name of the shopkeeper” despite being located just opposite to the
complainant’s hut.
 DW-1 has stated in the Examination in Chief that “I can identify the knife. It is marked as Art.
A.” It is submitted that DW-1 in her cross examination accepted that “I did not give any
description of the knife.” Moreover, P.I Mr. Sunil Salave did not submit any forensic report
validating that the same knife has been used by the accused in committing the alleged
crime.
 DW-1 mentioned in her cross that “I did not take any receipt of purchase from the shop.”
Moreover, the prosecution has failed to produce the statement of the shopkeeper before
the Hon’ble Court further substantiating the flaws in the narrative of the Complainant.
