JOB ORDER CONTRACT

Name: CHARD ELEVERT R. ALBANIA Effectivity: January 1 to June 30, 2020

Office: Asset Management Group Rate per Day: PHP 636.36

CONDITIONS

1. This Job Order (JO) Contract authorizes CHARD ELEVERT R. ALBANIA to render work as
Scanner/Clerk and perform the duties enumerated in the Terms of Reference (Annex “A”),
which shall be the basis for payment of services rendered.

2. This JO Contract shall take effect on January 1, 2020 until June 30, 2020, unless sooner
terminated as herein provided under paragraph 9 hereof.

3. The Scanner/Clerk shall report to PMO Central Records and observe a five (5) days a week
eight (8) hours-a-day work schedule, which may be rendered from 8:00 a.m. to 5:00 p.m. of a
working day. Work attendance for less than eight (8) hours a day shall be considered absence,
except when the Scanner/ Clerk is on official business outside the assigned property. The
Scanner/ Clerk shall not be paid for his absences. The Scanner/ Clerk shall be entitled to full
payment on all public holidays and overtime pay, subject to the internal guidelines of PMO.

4. The rate per day of Six Hundred Thirty Six and 36/100 (Php636.36.00) is subject to applicable
withholding tax.

5. The Scanner/ Clerk shall submit a Weekly Accomplishment Report of assigned tasks, as
stated in Annex A, as a pre-requisite for payment of compensation. Failure to do so would
mean holding in abeyance his compensation until submission of his report.

6. It is understood that services rendered under this JO Contract are subject to the following
guidelines:

- there is no employee-employer relationship between PMO and the Scanner/ Clerk;

- any of the services rendered pursuant to this JO Contract shall not be considered
government service and accordingly not to be accredited as such;
- Scanner/ Clerk is not entitled to the benefits normally given to regular PMO personnel;
and,

7. The Scanner/ Clerk shall not undertake work, or render service to other clients, if the work or
service to be undertaken are or will be in conflict with his duties or obligations under this
Contract, or shall otherwise place him at a conflict of interest position by virtue of this Contract.
In case the Scanner/ Clerk foresees that an outside work or engagement may conflict with his
obligation with PMO, the said work and client shall be fully disclosed to PMO, to afford the
latter the opportunity to decide whether or not to continue his engagement. Should PMO
determine that, by reason of the Scanner/ Clerk’s other work related concerns, he can no
longer perform his duties to PMO satisfactorily, PMO can pre-terminate this contract in
accordance with paragraph 9 hereof. Non-disclosure of such other engagements and work
related concerns shall be a ground for pre-termination of his contract.

8. The Scanner/ Clerk shall hold in full and absolute confidence, any and all information
concerning technical data, project data and other confidential information (whether in written,
oral, electronic or other form) obtained by him or which comes to his knowledge in connection
with or by virtue of this Contract.

9. PMO may pre-terminate this Contract for any reason, by serving a written Notice of
Termination to the Scanner/ Clerk at least fifteen (15) days before the effective date of
termination. Should PMO exercise the right of pre-termination, the Scanner/ Clerk shall be
entitled to a proportionate fee for services completed as of the date of termination.

10. From the effectivity of this JO Contract and until its automatic termination as provided for in
paragraph 2, the Scanner/ Clerk shall strictly comply with all the Office Rules and Regulations
of PMO, and shall be subject to any and all of its Orders or Memoranda that may be issued
from time to time. Violation of any of PMO’s Rules and Regulations shall warrant automatic
termination of this JO Contract.

11. In the event that this Contract is not renewed, or PMO avails of the provision of paragraph 9
hereof, PMO may withhold payment of Scanner/ Clerk’s final compensation and defer
issuance of any Certificate of Clearance from Accountabilities, until such time that he has
accounted for documents and other properties which may be in his possession, as well as
submission of reports requested.
