MEMORANDUM OF DEPOSIT OF TITLE DEEDS

This Memorandum of Deposit of Title Deeds executed at Chennai on this


the day of December, 2019 by (1) Mr.RAJESH KUMAR SINGH
[PAN CEHPS4964J], aged about 33 years, Son of Mr.Kunj Bihari Singh,
(2) Mrs.AMITA KUMARI RAJ [PAN DGEPR7241R], aged about 26 years,
Wife of Rajesh Kumar Singh, both are residing at No.6B, APN Nagar, Selaiyur,
Chennai – 600 073, (hereinafter called the PARTY OF FIRST PART which term
shall include his/her/their legal heirs and anyone claiming under him/her/them).

TO AND IN FAVOUR OF

Housing Development Finance Corporation Ltd. (HDFC) having its office at


2nd Floor I.T.C centre 760, Anna Salai, Chennai-2 (hereinafter called the PARTY
OF SECOND PART which expression shall unless excluded by or repugnant to the
context be deemed to include its successors and assigns).

Whereas, the party of the first part have been sanctioned a loan of Rs.16,60,000/-
(Rupees Sixteen Lakhs and Sixty thousand only) at Chennai. Whereas the
PARTY OF FIRST PART has agreed that the repayment of the said loan of
Rs.16,60,000/- (Rupees Sixteen Lakhs and Sixty thousand only) shall be
secured by deposit of the Deeds of immovable property belonging to
him/her/them.

Whereas, the party of the first part have agreed to create the security interest to
secure the sanctioned loan to be advanced/agreed to be advanced by Housing
Development Finance Corporation Limited THE LENDER as the secured creditor
in accordance with the provisions of Section – 58(f) of Transfer of Property Act,
1882.
Whereas, the party of the first part is authorized to deposit the said Title
Documents with intent to create a mortgage on the said Immovable Property.

Now this agreement relating to Deposit of title deeds witnesseth.

That in consideration of the sum of Rs.16,60,000/- (Rupees Sixteen Lakhs and


Sixty thousand only) sanctioned by Housing Development Finance
Corporation Ltd to Mr.RAJESH KUMAR SINGH and Mrs.AMITA
KUMARI RAJ and as security for due payment of the said sum of Rs.16,60,000/-
(Rupees Sixteen Lakhs and Sixty thousand only) together with interest that may
become due and payable, the Party of the First part have this day deposited with
the Housing Development Finance Corporation Ltd. the Title Deeds more fully
described in Schedule ‘A’ relating to his property more fully described in
Schedule ‘B’ hereunder with intent to create an equitable Mortgage by way of
Deposit of Title Deeds of the said property owned by the party of the first part,
including interest, commitment charges, cost charges and other monies and may
become due and payable from time to time by them to Housing Development
Finance Corporation Ltd.

Powers given by Member Secretary, C.M.D.A. Chennai – 600008, vide Planning
Permit No.1059/2017, D.Dis.No.5227/2017, dated 03.08.2017], in LAKSHMI
NAGAR, having an extent of 1321 Sq.ft., comprised in Old Survey No.181/2 and
Old Patta No.748, New Patta No.7810 the New Sub-Division S.No.181/2B,
situated at Old No.180, New No.57, Agaramthen Village, Tambaram Taluk,
Kancheepuram District and

Bounded on the
North by - Plot No.G1,
South by - Plot No.G3,
East by - Private Property,
West by - 22 Feet Wide Road.

Measuring on the:
East to West on the Northern Side - 54’- 11” ,

within the Registration District of Chennai-South and Sub-Registration District of

THE SCHEDULE ‘C’ REFERRED TO HEREINABOVE
(Description of the immovable property)

230 Sq.ft., UNDIVIDED LAND SHARE in the property described in


Schedule ‘B’ above. To be constructed Built-up area 480 square feet R.C.C.
Terraced Building in Second Floor, bearing Flat No.S1 ‘SHENBAGA FLATS’
“A” Block, including Car Parking and all its amenities.
