Thesis Title: Application of the Three-Fold Rule in the Imposition of Penalties in


the Determination of the Amount of Bail.

This survey may be answered by litigation practitioners, Judges, Justices,


Prosecutors and Public Attorneys.

Article 71 of the Revised Penal Code contains the provision on the three-fold rule
in the service of sentence of a convict. Specifically, it states: “the maximum duration of
the convict’s sentence shall not be more than three-fold the length of time corresponding
to the most severe of the penalties imposed upon him.”

1. Considering the application of the three fold rule to convicted individuals


having been found guilty of committing four or more counts of crimes or four or more
crimes of different nature, is it fair or justifiable that the three-fold rule be also applied in
the determination of the amount of bail of those who are merely charged of four or more
counts of crimes or four or more crimes of different nature? Why? or Why Not?
