 MOOT PROPOSITION

1. Mr. Dhiren Rameshbhai Tadvi, Age 24 Years, residing at: Mandvi,

District- Surat, against whom criminal case has been registered by Mrs.
Sheela Kalubhai Vasava residing at Kamrej, District- Surat.

2. Mrs. Sheela Kalubhai Vasava is a divorced women and she has twin’s
daughter namely Avantika and Ananya. Date of birth of her daughters is
22/06/2002. In year 2015, she sends both the daughters for study at Surat.
Both were residing at Swati hostel, Surat where Mr. Dhiren Rameshbhai
Tadvi was working as a grihpati at that point of time Mrs. Sheela’s
daughter namely Avantika and Mr. Dhiren were fall in love with
eachother.

3. On dated 28/10/2017, Ms. Avantika had left Swati hostel and came back
to her mother house and inform her mother about her relation with Mr.
Dhiren and she also stated that Mr. Dhiren many times took her with his
motorcycle at various places and committed many times sexual
intercourse with her and due to relation with Mr. Dhiren, Ms. Avantika
was pregnant.

4. But to save image in the community on dated 09/01/2018 as per their

customary law marriage ceremony was taken place in which community
peoples were invited and large number of gathering of community
people were present at the time of marriage.
 5. After marriage Ms. Avantika started residing with Mr. Dhiren and both
were residing peacefully as a husband and wife. On dated 25/06/2018 she
delivered a baby boy.

6. On dated 03/06/2019, Mrs. Sheela had given complaint against Mr.

Dhiren with the allegation of sexual intercourse with her minor daughter,
Therefore the impugned complaint came to be lodged. Thereafter Mrs.
Sheela had preferred searched warrant application to get custody of his
daughter from Mr. Dhiren before Kamrej Lower court and Lower court
had ordered custody of minor daughter to women protection home at
Kamrej village and said order came to be challenged by Mrs. Sheela
before this Honb’le Court and this court set aside order of lower court and
custody of her daughter had been given to Mrs. Sheela.

7. After that Ms. Avantika had given complaint against her mother on
allegations to pressurize her to broken down marriage life, to collect
money and also to grab dowry articles including gold ornaments from her
husband.

4. After filing of the F.I.R against Mrs. Sheela, Mr. Dhiren has preferred
anticipatory bail application before Additional Sessions Judge, Bardoli
place and same had been rejected by the learned judge.

5. Therefore Mr. Dhiren humbly prays to the Hon’ble High Court of

Ahmedabad to grant him anticipatory bail.
