CONTRACT TO SELL
KNOW ALL MEN BY THESE PRESENTS:

This contract to sell is made and entered into between:

MARY JANE G. TAMPARONG, of legal age, single, and a resident


of Barangay 11, Impalambong, Malaybalay City, Bukidnon, hereinafter
called as the VENDOR;

-AND-

GECELLE GIN GALLOGO CRUSIO, of legal age, married to RUNY


CHAMEN CRUSIO, and a resident of Purok 6, Kalasungay, Malaybalay
City, Bukidnon, hereinafter referred to as the VENDEE;

-WITNESSETH-

Whereas, the VENDOR is the absolute owner of a parcel of land


identified as Lot 725-B, Bsd-10-101312-001866 (AR) registered under
the name of Ramon F. Jaculbe, embraced and covered under Transfer
Certificate of Title No. AT-3492, situated in San Jose, Malaybalay City,
Bukidnon, more particularly described as follows:

“A parcel of land identified as Lot 725-B, Bsd-10-101312-001866


(AR) being a portion of Lot 725, Pls-800, Malaybalay Public Land
Subdivision) situated in the Barrio of San Jose, Municipality of
Malaybalay, Province of Bukidnon, Island of Mindanao. Bounded on the
N., along line 5-6 by Lot 723, Pls-800, Malaybalay Public Land
Subdivision; on the E., along line 6-1 by Lot 725-A; on the S., along line
1-2 by Lot N (road); on the W., along lines 2-3-4 by Lot 725-C; and
along line 4-5 by Lot 725-M, all of the Subdivision plan Psd-10-101312-
001866 (AR).

Beginning from a point marked “1” on the plan being S., 06 deg.,
36 W., 4,819.20 M. from BLLM No. 1, Municipality of Malaybalay.

referred to are indicated on the plan and marked on the ground by Olt
Cyl. Conc. Mons. 15x40 cm.

Bearings true.

Date of Original Survey on October 27, 1931, and that of the


Subdivision June 2-19, 1990, executed by Ricarte V. Obriol. Geodetic
Engineer and approved on October 19, 1992.

That the parties have agreed on a contract to sell a portion of the


above-described parcel of land including whatever improvements are
found therein with an area of TWO HUNDRED THREE (203) square
meters, more or less, which are indicated as Lot 725-B-4-G, PSD-10-
075743, in the amount of FOUR HUNDRED THOUSAND PESOS (Php
400,000.00), Philippine Currency, including the improvements therein,
under the following terms and conditions:

1. The total consideration shall be FOUR HUNDRED THOUSAND


PESOS (400,000.00), Philippine Currency, payable as follows:

a.) The amount of TWO HUNDRED THOUSAND PESOS


(200,000.00) shall be payable by the
BUYER/VENDEE to the SELLER/VENDOR upon
signing of this Contract to Sell;

b.) The amount of FIFTY THOUSAND PESOS


(50,000.00) shall be paid in Cash upon the approval
of the PAG-IBIG Loan (used for land purchased) of
the BUYER/VENDEE;

c.) That the remaining balance of ONE HUNDRED


THOUSAND PESOS (150,000.00) will be paid upon
the arrival of the check from PAG-IBIG.

2. That upon the receiving of the check from PAG-IBIG, the terms
are as follows;
a.) The SELLER/VENDOR will take ONE HUNDRED
FIFTY THOUSAND PESOS (150,000.00) only;
b.) The land purchased will be declared as fully paid;
c.) The remaining money from the check will be paid
back to the BUYER/VENDEE.

3. That the BUYER/VENDEE may use the land upon the signing
of this Contract for any purpose that may fit the
BUYER/VENDEE.

4. That payments shall be made to the VENDOR only and any


receipt not acknowledged by the VENDOR shall not be honored
or valid for this purpose;

5. The VENDOR shall sign and execute and/or deliver any and all documents
necessary for the Transfer of Ownership;

6. That the Capital Gains Tax and other taxes due shall be paid by
the VENDEE or BUYER upon registration of the final deed of sale;
7. Documentary Stamps Tax, Registration Fee, registration expenses, this Contract
to Sell, and all other miscellaneous fees and expenses shall be to the account to
the VENDEE.

8. That the VENDOR cannot rescind the sale for whatever reason
such as increase of the value of the property. However, if both
parties agree to terminate this Contract through a legal agreement, the
VENDOR may rescind the contract and may sell the lot subject of
this contract to any other interested buyer. The VENDOR shall
refund the payments made by the VENDEE less any
documentation charges already paid by the VENDORS, which
amount must be taken from the payment made by the next
interested buyer until fully refunded;
9. That the final delivery of the land shall be done only upon full payment
of the price agreed upon and documentation CHARGES shall be borne
by the VENDEE.

IN WITNESS WHEREOF, the parties hereto have affixed their

This instrument refers to a CONTRACT TO SELL consisting of
