THE PROCESS OF BUYING AND SELLING REAL ESTATE IN SPAIN
In Spain, there are no restrictions on property rights. Non-EU citizens own property with the same rights as Spanish citizens.
These are the documents that must be obtained by a non-resident who wants to own a home in Spain:

• Valid passport of the country of origin: In the case of foreigners, not members of the EU, for entry into the territory of Spain
it is necessary to obtain a visa, which can be formalized at the Consulate General of Spain. The visa is not essential for the
purchase of the property.

• Foreigner Identification Number: The Foreigner Identification Number (N.I.E), is a personal, unique and exclusive number

GENERAL CONDITIONS FOR
OBTAINING RESIDENCE FOR INVESTORS
Those foreign investors who meet the requirements (that we will list in the following sections) may request a residence visa for
one year once the investment is made. Once the visa has been obtained, they can apply for a residence permit that has
a validity of two years and can be renewed every 5 years as long as the investment is maintained. Neither the investment
residence visa nor the authorization require residence in Spain for a minimum period to be renewable. In the case of
applying for permanent residency (validity of 5 years), a minimum period of residence in Spain must be met.

a) Not have any past immigration issues within Spain.

b) Be over 18 years of age.

c) Lack of criminal record in Spain and in the countries where he has resided during the last five years,

for crimes foreseen in the Spanish legal system.

d) Not appear as rejected in the territorial space of countries with which Spain has signed an agreement in this regard.

e) Have a public insurance or private health insurance arranged with an insurer authorized to operate in Spain.

f) Have
 sufficient financial resources for themselves and their family members during their period of residence in Spain.

g) Pay the fee for processing the authorization or visa.

The applicant can be a single person, or can apply family unit. In the case the applicant wants to apply with their family,
they must take the role of ´main applicant´ and the rest of their family members must apply as co-applicants and meet
compliance.

Family Unit
The family unit is definied as the spouse (or person with an equivalent relationship), children under age of 18, or older who,
depending economically on the main applicant, may request , jointly and simultaneously or successively, the authorization
and, where appropriate, the visa. For this, the fulfillment of the requirements foreseen in the previous section must be
accredited.

RESIDENCE VISA FOR INVESTORS
Non-resident foreigners who intend to enter Spanish territory in order to make a significant capital investment may apply for
a stay visa or, as the case may be, residence for investors. The granting of the residence visa for investors will constitute a
sufficient title to reside in Spain for at least one year. A significant capital investment will be understood as one that meets
any of the following assumptions:

a) An initial investment for a value equal to or greater than


a. Two million euros in Spanish public debt securities, or

b. O
 ne million euros in shares or social participations of Spanish capital companies with a real business activity, or

c. O
 ne million euros in investment funds, closed-end investment funds or venture capital funds set up in Spain, or

d. O
 ne million euros in bank deposits in Spanish financial institutions.

b) The acquisition of real estate in Spain with an investment of value equal to or greater than 500,000 euros for each applicant.

c) A business project that will be developed in Spain and that is considered and accredited as of general interest.

It will also be understood that the foreign visa applicant has made a significant capital investment when the investment is
carried out by a legal person, domiciled in a territory that is not considered a tax haven according to Spanish regulations,
and the foreigner possesses, directly or indirectly, the majority of its voting rights and has the power to appoint or dismiss the
majority of the members of its administrative body.

Residence visas for investment will be issued by the Diplomatic Missions and Consular Offices of Spain. Visa applications will
be resolved and notified within a period of 10 business days, except in the case of applicants subject to the consultation
provided for in article 22 of the Visa Code, in which case the resolution period will be as general said Code.

Effects of the visa


The granting of the residence visa for investors will constitute sufficient title to reside and work in Spain during its validity.

RESIDENCY AUTHORIZATION
Foreign investors wishing to reside in Spain for a period exceeding one year may be provided with a residence permit for
investors, which will be valid throughout the national territory.

To apply for a residence permit for investors, the applicant must meet, in addition to the general requirements,
the following requirements:

a) Be a holder of a residence visa for investors in force, or be within the period of ninety calendar days after the expiration
of this.

b) In the event of obtaining the visa through the investment in a property valued at 500,000 euros, the investor must
demonstrate that he has maintained the investment of a value equal to or greater than the minimum amount required:

The processing of residence authorizations for investment will be carried out by the Large Companies and Strategic
Collectives Unit, will contemplate the use of telematic means and its concession will correspond to the General Directorate
of Migrations. The maximum term of resolution will be twenty days from the presentation of the request. If it is not resolved
within that period, the authorization will be deemed estimated by administrative silence.

The holders of an authorization regulated in this Section may request its renewal for periods of five years as long as they
maintain the conditions that generated the right. Said authorization may be made even if there are absences of more than
six months per year.

It´s important to bear in mind that the period of preparation and translation of all the documentation to present the
application is approximately three weeks.

Article 67 Duration of residence authorization for investors

in article 66.3 for purchases of non-formalized properties.
