Your Honor, we are calling the private
complainant to the witness stand.

whole truth, and nothing but the truth before

The witness is Ms. Angelika Maala, 20 years of
age, and residing at Oriental Mindoro. Fiscal,
your witness.
PROS. MARASIGAN:
Your Honor, this witness is being present to
identify, affirm and confirm her Sworn
Statement; she will also identify pertinent
documents and testify on all relevant matters to
prove the guilt of the accused beyond
reasonable doubt; she will also identify the
accused in open court. May I proceed, Your
Honor?

In relation to this case, Madam Witness, do you
remember having executed a Sworn Statement
consisting of two pages sometime in May 2017?

Your Honor, we no longer have any questions
for this witness and we request that this Sworn
Statement marked as Exh. “A” be considered as
part of her direct testimony.

Yes, Your Honor. Your Honor please, may I be
allowed to conduct the preliminary cross
examination, Your Honor, considering that I’m
not really the counsel of record, Your Honor.

Good afternoon, Madam Witness. Based on the
statement you identified earlier, you said that it
is “Nakapatay ang ilaw sa kwarto”, correct?
A: Opo.

Q: And you said that there is a light coming from

outside, is that correct?
A: Opo.
Q: How bright or how dark is the room when the

incident happened?
A: Sobra pong liwanag po sa loob. Galing po sa

labas iyong ilaw ng bahay po.
Q: And are the windows open at that time?
A: Hindi po bukas iyong bintana pero maliwanag

po iyong ilaw po sa labas po ng bahay at sinag
po ang kwarto po.
Q: And would you know what is the source of that

light?
A: Kitang kita ko po siya.
Q: Saan galing ang ilaw?
A: Sa labas po ng bahay, sa kabilang bahay po.
Q: How far is that house from the house where you

were at that time?
A: Magkadikit lang po, malapit lang po. Kumbaga

sa kabilang kalsada lang po.
Q: How far can you demonstrate from where you

are seated right now up to?
A: Ito lang po at saka po iyong kabilang…

Your Honor, may we ask the good prosecutor if
we could stipulate that the distance pointed by
the witness is 2 to 3 meters?

2 meters, Your Honor.

And you also said that the accused has a
brother?
A: May kapatid po siya.
Q: And they are sleeping in the same room,

correct?
A: Opo.
Q: And the room where you slept because they are

in the Sala?
A: Opo, sa Sala po siya kami po sa kwarto po.
Q: Where is the other brother when the incident

happened, if you would know?
A: Nasa labas lang po, wala po siyang ginagawa.

Nakaupo lang po.
Q: And he did not go to the room even if you

shouted?
A: Wala po siyang pakialam. Wala po siyang

pakialam kahit po magsisigaw na po ako sa
loob.

a seasoned litigation lawyer. So I think you are
more up right now to conduct the cross
examination.

Q: And you said that you did not leave the room
even if the accused is with you inside the room,
correct?
A: Opo.
Q: And why is that so?

A: Kinabukasan pa po.
Q: Why did you not leave the room when

something happened between you and the
accused?
A: Nanood pa po sila ng TV doon sa sala kaya

nagpaalam po muna ako na doon po muna ako
tutulog sa kwarto po nila at pinayagan naman
po ako nila.
Q: Yes, and after that he went upstairs after they

watch the TV?
A: Hindi ko na po namalayan kasi nakatulog na po

ako na doon na lang din po sila natulog sa loob.
Q: So both the accused and the brother slept

inside the room where you are? Sabi mo sila?
A: Isa lang po, siya lang po.
Q: And again, Ms. Witness, you said that

something happened when Alvin slept inside the
room?
A: Opo.
Q: And you did not leave after the incident,

correct?
A: Nakatulog na po ako doon sa loob ng siya po ay

hindi ko na po namalayan na natulog din po sa
tabi ko…

incident na ito, hindi ka raw umalis agad?

A: Takot na takot po ako at iyong kapatid niya po

ay nasa labas lamang po. Mga alas 3:00 pa po
nang madaling araw nang ako po ay umalis sa
akin pong inuupahang bahay. Ang isa po niyang
kapatid ay nasa labas lang po ng bahay kaya
hindi po ako agad nakalabas.
ATTY. BERNARDO:

Q: And you said even switched on the lights after
what happened, is that correct?
A: Binuksan ko po ang ilaw pagkatapos mangyari

po ang panghahalay sa akin ni Alvin Jepoy
Domingo.
Q: And you were scared?
A: Umiyak na po ako ng umiyak noon tapos noong

mga bandang alas 3:00 po ng madaling araw…
Q: Just answer yes or no, you are scared?
A: Yes, po.
Q: But you have the proper disposition, yes or no?
A: Opo.
Q: And would you agree with me that even if

you’re scared considering that you are in your
proper disposition, and considering that there’s

something happened, you should have left the

room immediately, yes or no?
A: Yes, po.
Q: And despite the fact that you are with the

accused inside one room, you did not leave,
correct?
A: Lumabas po ako sa sala lang po.
Q: And it means that the doors are not locked,

correct?
A: Yes, po.
Q: You went to the living room after the incident?
A: Yes, po.
Q: Can you kindly read your statement, No. 7?
A: “Opo, noong April 27, 27 oras humigit

kumulang alas onse ng gabi nang dumating ako
sa aming inuupahang bahay at nadatnan ko po
doon ang akin pong ka-board mate na si
Vandolf Domingo at si Alvin Jepoy Domingo na
nasa sala. Ang akin pong tinutulugan ay sa sala
at dahil nandoon pa po ang magkapatid ay
nagpaalam po muna ako kay Alvin Jepoy
Domingo na sa kwarto na po muna ako
matutulog dahil inaantok na ako at pumayag
naman siya. Hanggang sa nagising po ako dahil
nararamdaman ko na may lumalamas sa dede
ko at sa takot na nararamdaman ko ay hindi
ako agad nakagalaw. Hanggang sa
nararamdaman ko na ipinasok niya ang kamay
niya sa suot kong short at ipinasok niya ang
daliri niya sa pepe ko. Takot na takot po ako
pero hindi ko na napigilang sumigaw. Bigla po
akong tumayo at nagwala po ako. Umiyak po

ako ng umiyak at kahit nakapatay ang ilaw sa

kwarto ay tumayo po at nagwala po ako. Nakita
ko po na si Alvin Jepoy na siya ang taong
gumawa sa akin ng kahalayan dahil sa liwanag
ng ilaw sa labas ng bahay. Isinindi ko po ang
ilaw at pinagbabato ko siya ng kumot at
pagkatapos umupo po ako sa isang tabi at
umiyak po ng umiyak.”
Q: So would you agree with me that after the

incident, you did not leave the room based on
your statement, correct?
A: Yes, po.
Q: So which is true, your statement now or your

statement here?
A: Pareho po.

Madam Witness, earlier you describe the light
coming from the window, correct?

Q: And you said that it was bright?

Q: Can you describe how big this window is?
A: Mga ¼ lang po nito.
PROS. MARASIGAN:
Witness is pointing to the window of the left
side of the courtroom. ¼ of its size. What is the
window made of?
A: Parang kumbaga sa jalousie po ay malapad pa

po. Isang buo lang po siya.
Q: When you say dalawang ganoon, what are you

referring to? Two what?
A: Dalawa po siyang sarahan ng bintana na di-

ganoon po pero hindi po siya slide.
Q: It’s not a sliding window?
A: Opo.
Q: And you describe it two parts?
A: Opo.
Q: How do you open or close it that window?
A: Iyong hinihigit lang po.
Q: And at that time you said that light was coming

from the neighbor’s house or the house across
the street, is the window close or open at that
time?

Q: You said that there are two panels. Which panel

was opened?
A: Hindi po masiyadong nakabukas. Iyong konti

lang po.
Q: It was slightly opened.
A: Sarado po ng kaunti iyong isa po.
Q: One was slightly closed and the other one?
A: Medyo bukas lang po ng kaunti po.
Q: To clarify, there’s a two panelled window, and

the material of the window is made of the same
material as jalousie, correct?
A: Opo.
Q: And one window was closed and the other panel

was partially opened, correct? That’s why you
said that you were able to see clearly, is that
what you are saying?
A: Opo, at saka po ang bintana po nila ay kulay

white po kasi sinag po talaga sa loob.
Q: Let’s go to the brother. You made mentioned of

the brother of the accused outside. Can you
recall the name of this brother?
A: Vandolf Domingo po.
Q: How do you know this brother of the accused?
A: Matagal na po kaming magkakilala. Bata pa

lang po.

Q: Earlier you were asked where did the brothers

sleep because you said, as you stated in the
cross examination, the accused slept to the
same room where you were sleeping, correct?
Sabi mo kanina iyong akusado ay natulog kung
saan ka natulog, tama ba iyon?
A: Opo.
Q: How about the brother, iyong kapatid niya,

saan natulog?
A: Nasa sala po.
Q: And then when you said that the accused

touched you from the breast, starting with the
breast, correct?
A: Opo.
Q: And then it went up down your shorts?
A: Yes, po.
Q: Up to your vagina?
A: Yes, po.
Q: And you said na ipinasok niya?
A: Yes, po.
Q: How did you feel?
A: Masakit po.
Q: And then as the good counsel read in your

Sworn Statement that you shouted at him,
correct?

Q: You switched on the light and you hit him with

the kumot?

Q: Can you tell the Court, just to clarify, at what

point did you go to the living room because up
to the point where the counsel read, you merely
stayed in the room and cried there. When did
you go to the living room?
A: Mga alas 3:00 ng madaling araw po.
Q: And the incident, when the accused touched

you, around what time was that, if you know? If
you can remember?
A: Mga 12:00 po, 12:30.
Q: So you waited for three hours before you went

to the living room?
A: Opo.
Q: Why?
A: Umiyak po muna ako ng umiyak sa loob at

nagsi-sigaw lang po.
Q: While you were crying and shouting, what was

the accused doing then?
A: Nandoon lang po, nakahiga lang po ulit.
Q: Why did you have to wait for three hours before

going to the living room?
A: Natatakot po ako.

Q: You said that you said from 12:00 you waited

inside the room, and then at 3:00 you went to
the living room?
A: Yes, po.
Q: Can you describe to the Court how far was this

living room from the room where you are
staying?
A: Sobrang magkadais lang po. Wala pong pating

pinto. Ito lang at saka ito po ang sala. Wala
pong pinto ang kwarto.
Q: And then when you went to the living room,

what did you do there?
A: Umupo lang po.
Q: How long did you stayed there?
A: Mga isang oras mahigit po.
Q: You sat there for more than an hour. Why?
A: Natatakot po akong lumabas. Hindi ko po alam

kung saan po ako pupunta o ano…
Q: So aside from the accused and his brother, who

else was there in that place, if any?
A: Iyong kapatid po niya nandoon laang din po,

nakaupo lang din po.
Q: When you say nandoon din lang, where in

particular?
A: Malapit po sa TV.
Q: How far were you from the brother of the

accused at that time?

A: Mga ito lang po at saka sa box na iyan.
COURT INTERPRETER:
At this juncture, the witness pointed to a filing
cabinet on the right side of the courtroom up to
witness stand.
Q: And then after you said you stayed there in the

living room for about an hour or so, what did
you do after that?
A: Lumabas na po ako.
Q: Where did you go?
A: Sa kabila pong apartment nang iba ko pong

kababayan.
Q: Who is that kababayan that you are referring

to?
A: Kakilala ko lang ng mga taga doon po sa amin.
Q: Can you at least name them? Pakipangalanan

iyong kakilala mong iyon.
A: Camille Herrera po.
Q: So you’re trying to tell the Court that when you

went out you went to see Camille Herrera?
A: Opo.
Q: What did you do when you saw her?
A: Nagsumbong po ako.
Q: What did you tell her?

A: Sinabi ko po doon kay Ate Camille na

binabastos na po ako ni Alvin Jepoy Domingo.
Q: What was her response?
A: Pinuntahan po nila.
Q: When you say they, who went there with

Camille?
A: Madami pa po siyang kasama sa bahay.
Q: Around how many?
A: Four.
Q: Around four. While Camille her companions

went to the accused, what did you do?
A: Naghihintay po ako.
Q: How long did you wait?
A: Matagal pa po.
Q: Can you estimate the time?
A: Naghintay po ako hanggang alas 6:00 po ng

umaga.
Q: So you went to the living room 3:00, you

stayed there around 4:00 so for more or less 2
hours, what did you do in that place doon sa
kabila that you are referring to?
A: Tinatanong po nila.
Q: When you say nila, who are you referring to?
A: Sila Ate Camille Herrera po.

Q: Now you said that when you reported the

incident to Camille, Camille and four other
people went to the accused, correct?
A: Opo.
Q: And you said while they were there, you waited

for Camille and her group for two hours outside,
correct?
A: Bumalik po sila kaagad.
Q: How long did they stay?
A: Mga 10 minutes lang po bumalik po sila kaagad.
Q: And after that they went back and talked to you

for two hours?
A: Opo.
Q: And finally what happened after that two hour

period that you were talking with Camille and
the group?
A: Aantayin daw po namin mag-umaga.
Q: Why?
A: Nagsumbong po ako sa aking magulang. Sinabi

po namin iyong nangyari sa amin pong mga
magulang.
Q: Where were your parents at that time?
A: Nasa Oriental Mindoro po. Umuwi po ako ng

April 29 sa Oriental Mindoro po para magsampa
po kami ng kaso doon kaso po pinabalik po
kami dine.

Q: You said you went to Oriental Mindoro on April

29, this incident transpired sometime in 27
April?
A: April 28, 2017.
Q: And you went to Oriental Mindoro, 29?
A: Pinabalik po kami dito ng April 29.
Q: So the incident transpired on April 27, 2017 at

around 11:00 in the evening, correct?
A: Yes, po.
Q: And you went to Camille that’s around already

6:00 o’clock?
A: Opo.
Q: And you waited. And then you went to Oriental

Mindoro to report the incident to your parents?
A: Yes, po.
Q: You went to the police and then you were

advised to go back here?
A: Opo.
Q: In Cavite?
A: Opo.
Q: And that was already when? What’s the date?
A: April 29 po kami nagsampa ng kaso.
PROS. MARASIGAN:

Q: So you said earlier during your direct that you

were scared, correct?
A: Opo.
Q: And that you were scared of the sibling who

was outside the room, correct?
A: Yes, po.
Q: But you also stated that he does not care about

the incident, correct?
A: Opo.
Q: And in fact even if you shouted, he did not go

inside the room to check on you and his
brother, correct?
A: Yes, po.
Q: And in fact when you went out of the room and

went to sit in the sala, you sat with him there
watching TV, correct?
A: Yes, po.

the incident happened, he will not care, will you

A: May asawa po siya.

So nandoon ka sa bahay nila kasi nagbo-board

sa kanila, magkano ibinabayad mo?
A: Hati-hati po lang kami kung magkano po ang

naka-ano sa isang buwan sa kanila pong bahay.

Iyong tubig, naghahati rin kayo?

Magkano lahat ang inaambag mo sa isang
buwan sa kanila? Maaalala mo ba kung

A: May dala po kasi akong bigas noon tapos

nagbibigay bigay lang po kami ng pambili po ng
ulam.

Kaya nga iyong sinasabi mong pambili bili ng
ulam, mga magkano binibigay mo sa kanila
para makabili ng ulam? Mga magkano ang
inaambag mo?
A: Depende po sa bibilihin po.

Kaya nga. Gusto ko malaman, magkano ang
ibinibigay mo?
A: Kunyari po mga Php50.00, mga Php120.00,

Php30.00. Hati-hati po.

So nagbibigay ka roon. Araw-araw iyon o
paminsan minsan lang?
A: Minsan lang po.

of the doctor who examined her.

Dr. Roy Camarillo of the PNP Crime Laboratory
Region 4-A, Camp Vicente Lim.
COURT:
ORDER
In today’s trial, the accused is present, as

well as the private complainant is present.
Considering the absence of the Public Attorney’s
Office, this Court appoints Atty. Michelle
Bernardo for purposes of today’s trial.
The Public Prosecutor presented the
private complainant to the witness and
conducted his direct examination over said
witness and in the course of her testimony, the
witness was able to Exh. “A”, “B” which is a
common exhibit as Exh. “1”, and “C”. Atty.
Michelle Bernardo conducted her cross
examination over said witness. The Public
Prosecutor also conducted his re-direct
examination, and Atty. Michelle Bernardo also
conducted her re-cross examination over said
witness. This Court conducted some clarificatory
questions for which the testimony of said
witness is hereby terminated. The Public
Prosecutor manifested that they will be
presenting another witness in the person of Dr.
Roy A. Camarillo.

In view thereof, let the continuation of trial

in this case be held on September 11, 2019
at 1:30 o'clock in the afternoon, as
previously set. The setting on August 21, 2019
is hereby cancelled upon aforegoing.
Send subpoena to Dr. Roy A. Camarillo at
Regional Crime Laboratory Office 4-A, Camp
Vicente Lim, Calamba, Laguna to be present on
aforesaid date for purposes of trial in this case.
SO ORDERED.
