I. INTRODUCTION
This case analysis discusses the situation of the police force of poor
seaside town in Sorsogon and the proposal of a private company to their
commander C/Insp. Cesar Cruz. The company, Windy Corporation, is
willing to provide financial assistance to the police department by
repairing and upgrading the police station and providing the police with
additional equipment in exchange for the security services during project
construction. Options and issues that may arise were discussed in the
following sections in order to arrive at the best decision for C/Insp. Cruz
for his team and the company planning to invest in his area of
responsibility.

II. ENVIRONMENTAL ANALYSIS

a. General Environment
C/Insp. Cesar Cruz and his men are working in a simple and relatively
peaceful environment located in a poorly-developed seaside town in
Sorsogon. The general population is poor because economic growth and
social progress have been hampered by the frequent onslaught of
typhoons and the town’s relative distance to major cities. However,
despite the inadequate opportunities, the community in general remains
law-abiding.

b. Operating Environment
The policemen providing peace and order has maintained good
reputation throughout their years in service and has smoothly integrated
and respectfully ingratiated themselves into the community. Most of the
policemen are locals and are related with members of the community.

c. Internal Environment
Despite the diligent performance of their duties, the town police force
headed by C/Insp. Cruz is very poorly equipped and inadequately funded.
The police have to do with a dilapidated police station and a rotting jail
sell, not to mention outstanding electric bills and insufficient budget for
maintaining inmates. The poor water source also adds a major health
concern for the policemen since they get it from brackish water thru a
shallow well.

III. PROBLEM DEFINITION

a. Problem 1 & Evidence


The current situation of the town police force wherein they are
experiencing scarcity of resources. For years, they have managed to
perform their job under these circumstances and perhaps have already
gotten used living in a rundown police station and managing a rotting jail.

However, these will eventually cause further burden to the policemen,


leading to lowering of morale especially when police facilities further
deteriorates and electrical connection disconnected by the electric
cooperative due to outstanding debts.

Health issues regarding their water source also needs to be addressed


since they are consuming brackish water derived from the shallow well.
Brackish water has lower salinity than saltwater but has higher salinity
compared to fresh water. The high sodium intake forces the body to
release more water in attempting to normalize the sodium balance of the
body. Long term side effects of drinking brackish water will lead to
hypocalcaemia and hyperphosphataemia suggestive of parathyroid
hypofunction. They also have a low urinary pH, massive urinary sulphate
excretion, and a compensated metabolic acidosis.

b. Problem 2 & Evidence


The proposal of Windy Corp. and JP Constra Inc. presents a very timely
opportunity for C/Insp. Cruz to address the present and long-term
difficulties his police team is undergoing. The problem however is that
acting in the capacity as security guards for a private company is not part
of the mandate of the police. The main duty of the police is to maintain
peace and order by implementing and enforcing laws in their area of
responsibility which also includes the construction site whereas a private
security guard focuses on implementing the company’s security
protocols. Acting as private security guards will be a conflict of interest on
the part of the police and can be seen as a form of corruption especially
if there are favors involved in the deal. This issue may tarnish the good
reputation C/Insp. Cruz and his men have established through the years.

IV. ALTERNATIVE SOLUTIONS

a. Description of Solution (Problem 1)


To address the resource scarcity of the policemen, it is urgently necessary
to source out funds. These funds can come from the local government
and line agency thru the written requests of C/Insp. Cruz to the municipal
government as well as to the Philippine National Police head office and
Department of Interior and Local Government.

i. Strengths
Funding from the government to address their insufficient
resources enables the police to remain neutral and not indebted
to any organization or individual. Impartiality of the police is
necessary for them to uphold their sworn duties and gain the
respect of the community.

ii. Weaknesses
It would usually take time to acquire the necessary funds from
the government because of political, financial and bureaucratic
constraints.

b. Description of Solution (Problem 1)


Agree to the proposal forwarded by Windy Corp. and JP Constra Inc.
The funds will be readily available and when acquired can be
immediately used to resolve the problems on insufficient resources.

i. Strengths
The funds will be readily available and can be used urgently to
repair and improve the police station, jail facility, water source
and maintenance cost for the inmates.

ii. Weaknesses
The impartiality and neutrality of the police force can be put in
question especially if there arises conflicts involving the
company and the labor force and/or the local community. This
option has the tendency to oblige the police in favor of the
private company. It also gives the perception that the police will

be biased in favor of the company when it comes to
accomplishing their duty.

c. Description of Solution (Problem 2)


It is ethically questionable for policemen to assume the role as private
security guards for private companies because it will result in conflict
of their sworn mandate and company interest. However, as part of the
police force maintenance of peace and order, enforcement of laws and
implementation of legal orders of the duly constituted authorities,
they can be requested to provide peace-keeping assistance. Upon the
receipt of the formal request, C/Insp. Cruz can assign two policemen
at any given time 24/7 monitor peace and order provide police
visibility. He can also request for additional policemen from the PNP
head office in order to augment the police force to be able to
accommodate the expanding responsibility.

i. Strengths
This option will accommodate the security requirements of the
company since there will be police visibility 24/7 during the
construction without compromising the role and integrity of the
policemen. It also opens the policemen to the proposal put
forward by the company which they urgently need.

ii. Weaknesses
This option in a way will test the integrity of C/Insp. Cruz since
all the financial and operational benefits of the situation will be
under his command. The challenge for him is to properly
manage the growing responsibility of the police and to
appropriately the resources to upgrade the police facility and
overall health of his policemen.

V. RECOMMENDED SOLUTION

a. Description of solution
The best option for C/Insp. Cruz is to accept the proposal of Windy
Corp. However it should be clear that a formal request must be
submitted by the company and that the policemen will be there not in
the capacity as private security personnel reporting to the company,
but as policemen providing police visibility and maintaining peace and
order 24/7 as they are mandated to do. Clear definition of
responsibility is important since the designated policemen are
essentially in there to provide security without them being drawn into
the internal affairs and concerns of the company.

b. Justification for alternative chosen


This opportunity to improve and upgrade the police facilities,
equipment and way of life by essentially doing what the police are
required to do without compromising their role is not only ideal but
also extremely necessary for the police to keep up with the increasing
responsibility within their area of jurisdiction. As the town is
expanding and industries start to grow, the police force needs to catch
up and upgrade. Increase in the number of policemen and
improvement of facilities and equipment is highly critical.

c. Implementation specifics
As requested by Windy Corporation, six policemen (2 policemen per
shift) will be on duty at 8-hour shifts, to monitor the peace and order
and maintain police visibility at the construction site deterring
criminality. The policemen assigned at the project will be rotated
every week to avoid over-familiarity and collusion.

Based on the formal request from the company, C/Insp. Cruz will
justify to the PNP head office the need for augmentation of additional
policemen in his area of responsibility.

VI. SUMMARY OF ANALYSIS
For a number years, the police force headed by C/Insp. Cesar Cruz has
been steadfast in performing their duties in the poverty-stricken seaside
town in Sorsogon despite the shortage and inadequacy of resources and
equipment. Meanwhile, Windy Corporation a private company came to
town with the intention of constructing a wind farm. The company
proposed to improve the police facilities and provide additional police
equipment in exchange for security services from the police during the
project construction.

Although the role of the police is parallel to that of the company security
guard with regards to maintaining peace and order, the police cannot
assume the role since it will cause conflict of interest with their sworn
mandate. The police however can still provide security to the project
construction site by maintaining police visibility and peace and order as it
falls with their area of responsibility. This can be achieved with the
company making a written request to the police for peace-keeping
assistance. With this request from the company, the police can justify
additional personnel to augment its police force. The upgrading of the
police facilities and equipment thru the support of the company will
greatly help the police to keep up with the growing police responsibility
within their area of jurisdiction.
