LEGAL ENGAGEMENT AGREEMENT

THIS AGREEMENT is made and entered into this 3 April 2017, by and between Guiang &
Lacsina Law Offices, hereinafter referred to as the “Law Office”, and Mrs. Delia A. Guiang,
hereinafter referred to as the “Client”.

-WITNESSETH THAT-

WHEREAS, the Law Offices consists of two practicing attorneys, Atty. Conrad Smith C.
Lacsina and Atty. Francis Gil Guiang, hereinafter referred to as the “Lawyers”, with law offices
at Block 2, Macabulos Drive, San Roque, Tarlac City, hereinafter referred to as the “principal
address,” whose scope of service include litigation involving the present subject matter; and

WHEREAS, Client believes that she has a meritorious cause of action in a Petition for
Nullification of Marriage before the Family Court (RTC);

WHEREAS, the Client is desirous of hiring said Law Office as his Counsel.

NOW, THEREFORE, the Client and the Law Office do hereby mutually agree that the Law
Office will represent the Client before the City Prosecutor, the Family Court, and the Regional
Trial Court under the following terms and conditions:

TERMS and CONDITIONS

Section 1. Scope of Services.

a. The Law Office agrees to represent the Client in pursuit of his defense before the
Body from the time of the execution of this AGREEMENT until such time that
the Body has rendered its judgment, resolution, or order and there are no further
plain, speedy, or adequate remedy available before the Body in favor of the
Client, or until such time that this AGREEMENT shall have been terminated by
any other cause specified in Section 5 (a) hereof.

b. The Law Office further agrees to promptly and within the reglementary period
allowed by law file all appropriate pleadings, motions, petitions, and other
documents seeking relief or remedy in favor of the Client before
theBodycomplete with supporting documents thereto.

c. The Client agrees to furnish the Law Office with all evidence, object,
documentary, or testimonial, in the former’s possession or disposal that shall be
used and deemed necessary by the Law Office in drafting the pleadings, motions,
petitions, and other documents aforementioned as well as in the course of the
hearings, trials, and proceedings in the Body.

d. The Client further agrees to provide the Law Office its authorization whenever
required to procure on his behalf any evidence that shall be used and deemed
necessary by the Law Office for the purposes abovementioned.

e. The Law Office, in conforming with his obligations in this section neither
guarantees nor warrants certainty of success of Client’s defense but covenants to
perform and render its best effort having strict regard to the laws and rules of the
Philippines while adhering to the Cannons of the Code of Professional
Responsibility.
Section 2. Fee.

a. The Client agrees to pay to the Law Office the amount of TWO HUNDRED
FIFTY THOUSAND PESOS (PhP250,000.00), which shall be paid in the manner
stated below and which shall cover all the fees of the case until its completion:

i. First payment of ONE HUNDRED FIFTY THOUSAND Pesos


(PhpP150,000) shall be made upon the execution of this
Agreement;

ii. Second payment of FIFTY THOUSAND PESOS


(PhP100,000) shall be made on or before April 3, 2018;

Section 3. Communication with the client.

a. The Law Office agrees to maintain constant communication with the Client with
regard to the status of his case as practicality may dictate while the Client agrees
to contact the Law Office for business purposes, including but not limited to
inquiries with regard to the status of his case, by phone during normal business
hours (8am-5pm). Correspondence through email or text shall be answered by the
Law Office as soon as possible but in no case to be beyond twenty-four (24)
hours;

b. The Client further agrees to respond immediately and within reasonable time to
inquiries or requests sent by the Law Office through mail, email, facsimile,
telephone, or SMS messaging;

c. The effects of the repeated failure of the client to respond within reasonable time
to inquiries or request by the Law Officecausing great prejudice to the case shall
be governed by Section 5 (a)(3) hereof.

Section 4.Ownership and Possession of files and documents.

b. The client agrees to allow the Law Office to retain during and after the effectivity
of this AGREEMENT copies of all documents delivered by the client to the Law
Office;

c. After the termination of this AGREEMENT, the Law Office agrees to return all
documents and other objects delivered by the client to the Law Office during the
course of the effectivity of this AGREEMENT.

Section 5.Withdrawal from representation.

a. The following are grounds for the Law Office to withdraw from this
AGREEMENT:

1. Non-cooperation of the client in the procurement of essential documents


or other forms of evidence which are in his possession or within his
power to procure and which may have substantial effect on the outcome
of the case within reasonable time as to afford the Law Office sufficient
time to study such documents and prepare it for the relevant
proceedings. Non-cooperation of the client shall include his failure to
attend without justifiable cause hearings, trials, or proceedings before
the body concerned where his presence is required or where his absence
thereof will prejudice the success of his case; and
2. Repeated failure of the client to respond within reasonable time to an
inquiry or a request by the Law Office which causes great prejudice to
the client’s case;

3. Other analogous circumstances which, due to the client’s willful act or


omission, prejudice the outcome of the case to his disadvantage.

Section 6.Separability provisions. — If any provision or part of this AGREEMENT, or the


application thereof to any person or circumstance is held invalid, the remainder of this
AGREEMENT, or the application of such provision or part to other persons or
circumstances, shall not be affected thereby.

Section 7.Effectivity. – This AGREEMENT shall take effect upon its execution.
