Principle: Anyone under eighteen years of age is a minor in the eyes of the law. An agreement with a
minor is void.

147. John, Paul, George and Ringo are four orphaned brothers. John, the eldest of them at seventeen
years, handles their expenses. Wanting his brothers to get a good education, he pays hefty sums
to a local school to get his brothers admitted. On the start of classes, however, the brothers are
not allowed to study. When John approaches the school, he is informed that the contract
between them is void by virtue of his being a minor and he is offered his money back.
A. The school’s actions are justified as John would not have been able to afford their fees.
B. The school’s actions are not justified as they are jeopardising the education of three children,
which is forbidden under the Right to Education Act.
C. The school’s actions are not justified as the agreement is meant to supply a necessary good, in
which case such an agreement is not void.
D. The school’s actions are justified as the contract is legally void.

Principle: When a person agrees to save the other from a loss caused to him by the conduct of any
person, this agreement is called an agreement of indemnity. Loss caused by the conduct of a person
includes acts done inadvertently.

148. Shareef agrees to hire Noel as the treasurer in his business under the condition that Omer signs
an agreement of indemnity agreeing to make good any loss caused to the business by any
activity of Noel’s. A few weeks later, Noel disappears with several lakhs of the business’ money.
Shareef asks Omer to reimburse the money lost due to Noel.
A. Omer need not pay, as the loss was not caused inadvertently
B. Omer need not pay as Noel acted outside the course of his employment
C. Omer need not pay, as Noel’s act is a criminal one.
D. Omer must pay Shareef according to the agreement of indemnity signed by them

Principle: A contract is said to be induced by undue influence, where the relations subsisting between
the parties are such that one of the party is in a position to dominate the will of the other; and he uses
this position to obtain unfair advantage over the other. Contracts formed by undue influence are
voidable at the option of the aggrieved party.

149. X is an oncologist of whom Y was a patient. Before he died, Y sold his estate of over 10 acres of
prime land to X for a mere 50,000 Rs. Y’s son, Z challenged the contract as being obtained by
undue influence and claim that he wished to avoid it. Will he legally be able to do so?
A. The meagre compensation clearly shows that there is undue influence in the said contract.
B. There was no undue influence as Y acted in his own will to sign the contract.
C. There was undue influence as doctor-patient relationships are fiduciary and contracts made
within such fiduciary relationships are always obtained by undue influence.
D. The facts are insufficient to prove undue influence.

Principle: Fraud consists of a misrepresentation of an existing fact upon which the defendant intends
that the plaintiff will rely, and upon which the plaintiff justifiably relies to his detriment.

150. Shabana goes to Seth’s store to buy a microwave oven. Seth tells her that the oven has a grill
feature also, despite knowing that it doesn’t. Shabana tells the shopkeeper that she doesn’t care
if the oven has any such features as she needs it for simple heating, but she buys it anyway. A
month later, Shabana tries her hand at a new recipe which requires grilling, believing to be able
to do so in her oven. She then realises that her oven has no such feature. In the suit of fraud
brought by Shabana against Seth,
A. She will lose because at the time of buying the microwave, she did not rely on the
shopkeeper’s claims.
B. She will lose because she was caused no harm by the shopkeeper’s claims.
C. She will win because the shopkeeper’s claims proved to be detrimental to her.
D. She will lose because she should have known that microwaves do not come with the grilling
feature, and hence her reliance on the shopkeeper’s words was not justified

151. Principle: Consideration is the corner stone of a contract. Absence of consideration makes a
contract void It is defined as an agreement to form a valid contract should be supported by
consideration. Consideration means “something in return” (quid pro quo) . It can be cash, kind,
an act or abstinence. It can be past, present or future. However, consideration should be real
and lawful.
Facts: P wanted to sell off some chocolates in his shop. To increase sales he announced a 5%
discount on any article in his shop on producing a chocolate wrapper (of a chocolate brand
available exclusively in his shop) during the transaction. Later P gets embroiled in a law suit and
the main issue before the court is whether the chocolate wrapper is consideration flowing from

A. The wrappers are not consideration because they are of zero economic value.
B. The wrappers are not consideration because are of no value to even to P.
C. The wrappers are consideration because P attaches value to them because the action of the
customer boosts his sales.
D. The wrappers are consideration because consideration can be in kind also.

152. Principle: Lack of free consent makes a contract voidable at the option of the innocent party.
Coercion is one such thing that vitiates free consent. "Coercion" is the committing, or
threatening to commit, any act forbidden by the Indian Penal Code, or the unlawful detaining, or
threatening to detain, any property, to the prejudice of any person whatever, with the intention
of causing any person to enter into an agreement.
Facts: The government of Wommingland passed a legislation that no one would enter contracts
to buy marijuana in excess of 20 kgs at a time. Hanna had a particularly bad day at work. She
hence entered into a contract with a local dealer to buy 30 kgs of marijuana that night. After the
‘goods’ are delivered she refuses to pay the dealer claiming that the contract is voidable because
there is no free consent. The local dealer sues her. Which of the following is correct?
A. There is still free consent inspite of the regulations.
B. There is coercion and hence the contract is void
C. There is coercion because of the regulation.
D. None of the above.

153. Principle: A proposal made by one party and its acceptance by another, with the intention of
establishing legal relations, is an agreement.
Facts: During an auction Cass bids for a rare vase at 3000 dollars. There are no other bids. The
auctioneer refuses to sell the vase as the price had not matched his expectations. Cass sues the
auction house for breach of contract. Decide.
A. There is a valid offer by the auctioneer and the acceptance by Cass, so there is a valid contract
and Cass will win.
B. Cass will win because unless there is an intention to sell at the price, the auctioneer would not
have put the item up for bidding at the said price.
C. There is no valid offer from the auctioneer but just an invitation to offer.
D. None of the above.

154. Principle: Misrepresentation renders a contract voidable. It is defined as causing, however

innocently, a party to an agreement to make a mistake as to the substance of the thing which is
the subject of the agreement.
Facts: X had a watch which looked like a Rolex. X had been gifted the same by the wealthy
cousin of his. Sow openly admired the watch of his. She congratulated X several times over a
period of one week on his becoming the proud owner of a Rolex. Sow also told her friends how
she had always wanted to buy a Rolex. Later she offers to buy the watch from X, offering to pay
what is the usual amount for a used Rolex. X agrees. Later Sow finds out that the watch is not
actually a Rolex. She sues X for misrepresentation. Decide:
A. X will win because he did not know the about the authenticity of the watch himself.
B. Sow will win because X realized that it was the fact that the watch was a Rolex was the driving
factor behind her entering into the contract.
C. Sow will win because intention to deceive is not an essential part of misrepresentation.
D. Sow will win because misrepresentation only renders a contract voidable.

155. Principle 1: A contract, by which one party promises to save the other, i.e. promisee, from loss
caused to him by the conduct of the promisor himself, or by the conduct of any other person, is
called a “contract of indemnity”.
Principle 2: The promisee in a contract of indemnity, acting within the scope of his authority, is
entitled to recover from the promisor.
Facts: A enters into a contract of indemnity with (B) The terms of the contract specified that A
will be liable to indemnify B for the acts which will be carried out by B for the construction of A’s
house.
While construction was in place, C filed a suit against B for stopping the construction. B incurred
huge expenses for defending the construction of the house in the suit. B demanded the same
amount from A, but A denied his liability with respect to the suit. Decide whether A can be made
liable or not.
A. A can be made liable since it was his responsibility to indemnify B for the expenses incurred in
the suit.
B. A cannot be made liable since his liability was limited to the acts related to the construction of
the house.
C. A can be made liable since he is liable to indemnify B for the acts carried out for the
construction of A’s house.

D. A cannot be held liable since suit was not concerned with the construction of the house.

156. Principle 1: An "agent" is a person employed to do any act for another or to represent another in
dealings with third persons. The person for whom such act is done, or who is so represented, is
called the "principal".
Principle 2: An agent has authority, in an emergency; to do all such acts for the purpose of
protecting his principal from loss as would be done by a person of ordinary prudence, in his own
case, under similar circumstances.
Facts: X, A Kolkata based trader, authorised Y, his Mumbai based agent, to deliver 20 kg of Green
Apple to C, a Madras based consumer. X sent the consignment of apple to Y. Y, instead of
sending the same consignment to C, sold the same apples at a higher price in Mumbai. B did this
because of the bad weather, and being attentive of the fact that apples would get spoiled
entirely if he waits to send the same to Madras. Now, X sues Y for not sending the apples to (C)
Decide.
A. Y will not be liable since he sold the apples in Mumbai itself so as to save X from incurring
loss.
B. Y will be liable since he was obliged to send the consignment of apples to C, who was in
Madras.
C. Y will not be liable since he carried out and sold the apples in good faith.
D. Y will be liable since the contract to sell apple was between X and C, and Y should not have
exercised his will.

157. Principle: The making of a representation which a party knows to be untrue, and which is
intended, or is calculated, to induce another to act on the faith of it, so that he may incur
damage, is fraud in law.
Facts: A wanted to purchase a motorbike. In pursuance of this, A approached (B) B showed A his
motorbike. A, considering it be to be a good bike with excellent average, agreed to purchase it. B
was aware of the fact that the average of the bike was not goo(d) Later, A discovered that the
average of the bike was very poor. Now A wants to recover damages from (B) Decide whether A
will succeed in his claim or not?
A. A will succeed since it was a responsibility on the part of B to disclose the fact that the
average of bike is not goo(d)
B. A will succeed since there was a fraud on the part of (B)
C. A will not succeed since B did not act in manner which can be considered as fraud, and hence
cannot be held liable.
D. A will not succeed since it was A’s responsibility to enquire B about the motorbike.

158. Principle: Any person using force to obtain the consent of the other party, to a contract causes
coercion. If coercion is caused in a contract, the party against whom the coercion is committed
may terminate the contract.
Facts: A, a student of a National Law University, was asked by his professor, B, to enter into a
contract with him so that A will complete his assignments on time. In case of failure in complying
with the contract, B will not allow A to sit in the class. A agreed to the contract because of B’s
fear. Later, A decided to rescind the contract. Decide whether A would be able to rescind the
contract or not.

A. A can rescind the contract since the same was entered into under coercion, and A is not
bound to comply with the same.
B. A cannot rescind the contract since there was no coercion on the part of the professor.
C. A is expected to complete his assignments and any contract made in this regard cannot be
considered as invalid.
D. A can rescind the contract since a professor cannot bound him to complete his assignments
forcibly.

159. PRINCIPLE 1: A unilateral promise is a promise from one side only, intended to induce some
action by the other party. The promisee is not bound to act for he gives no promise from his
side. But if he carries out the act desired by the promisor, he can hold the promisor to his
promise.
PRINCIPLE 2: Past consideration is not valid.
FACT SITUATION: Alok Nayyar carried out certain improvements and repairs on a bungalow. The
bungalow formed part of the estate of his father who had died leaving the house to Alok and his
four brothers. After the work had been carried out, the four brothers signed a document stating
that since Alok had carried out the repairs work, each of them would pay him Rs. 10,000.
However, the payment was never made. Alok brings a case against them.
A. The four brothers would be held liable for their unilateral promise as the property was jointly
owned by them and they were also benefitting from the act performed by Alok in good faith.
B. The four brothers would not be liable as they said that they would pay the money only to
induce Alok to carry out the repair work and were not serious.
C. The four brothers would not be held liable as their promise to make the payment came after
the consideration had been performed.
D. The four brothers would be held liable as Alok carried out the work only after they promised
to give the money.

160. PRINCIPLE: In contracts, for the sale of goods and supply of services, certain basic provisions are
implied by statutes in order to provide protection to consumers. The most important provision is
that the goods sold by description must correspond to that description.
FACT SITUATION: A contract for the sale of 3000 tins of peaches were described that they will be
packed in cases of 30. When the goods arrived at the plaintiff’s house, they were packed in cases
of 24, although the agreed overall number of tins was supplied.
A. The plaintiff is entitled to refuse the goods as they were not as described.
B. The plaintiff is not entitled to refuse the goods as there is no difference. He received 3000 tins
of peaches.
C. The plaintiff is not entitled to refuse the goods as the error is not of something so essential
that would vitiate the contract.
D. The plaintiff is not entitled to refuse the goods as it would result in breach of contract.

161. PRINCIPLE: A contract involves reciprocal undertakings between the parties. As a result, there
cannot be a contractual obligation, when there is no reciprocity between the parties.
FACT SITUATION: Ankan is an old widower living alone in Mumbai. He wrote a letter to Sagar, his
nephew living in Hyderabad, requesting Sagar to come to Mumbai to visit him. He ended the
letter by saying that all the property of his late aunt would be his if he comes to Mumbai. Sagar

came to Mumbai and met Ankan. When he asked for the property, Ankan refused to give it to
him. Can Sagar get the property?
A. Sagar cannot get the property as it a gratuitous promise only.
B. Sagar cannot get the property as there is no reciprocity between the parties. He never replied
to the letter stating that he accepted the offer.
C. Sagar can get the property otherwise it would result in breach of contract.
D. Sagar can get the property as the promise was arising out of a domestic relationship and
hence there could not be an intention to create a legal obligation.
