THE RIGHTS OF HUSBAND AND WIFE AFTER DELIVERING TALAQ (THE WORD OF

DIVORCE) BASED ON ISLAMIC INTERPRETATION OF THE HOLY QURAN OF M. ALI ASH

SHABUNI IN RAWĀI’UL BAYĀN FI TAFSĪRI ĀYĀTIL AHKĀM MINAL QUR’ĀN BOOK

ABSTRAK

Allah described in the holy Quran that marriage is a great commitment or miiṡaaqon
gholiiẓoo (An-Nisa’(4): 21). But, not all marriage could be enjoyed peacefully and happily.
There will be some problems happened. In this case, Allah created a solution named talaq
under specific conditions and terms. Here, talaq means the word of divorce delivered by
husband in the Islamic separation process in marriage. Then, in Islam the wife will be in
iddat/ iddah period after his husband delivering talaq. In this period there are some rights and
obligations for husband and wife to do. This research focused on discussing the verses of the
Holy Quran talking about talaq based on Islamic interpretation of the holy quran in Rawāi’ul
Bayān fi Tafsīri Āyātil Ahkām minal Qur’ān book by M. Ali Ash Shabuni to obtain some
informations of the rights and obligations for husband and wife after delivering talaq. This
research belongs to library researh with descriptive approach. Two main data sources of this
research are the books written by M. Ali Ash Shabuni entitled Rawāi’ul Bayān fi Tafsīri
Āyātil Ahkām minal Qur’ān published by Maktabah Syuruq adDauliyah in 2007 and Kitab
Tafsir Ayat Ayat Ahkam volume 1 and 2 published in 2016 by Keira Pusblishing translated by
Ahmad Dzulfikar, et.al. The supporting data sources were Fiqs books, journals, research
papers, and etc which were appropiate with the theme of this research. In analyzing the data
mawdhu’iy method was used. The results of this research is the rights and obligations of the
husband and wife after delivering talaq in iddat period has explained in detail in the verses of
the Holy Quran talking about talaq, for example the wife should stay in his husband house
during iddat period, the husband has the right to accept wealth which belongs to him based on
Islamic law after his wife delivering khulu’ (the word of divorce delivered by the wife in a
marriage), and etc. If the rights and obligations among the husband and wife after delivering
talaq could be done it is possible for them not to continue the divorce process, so that they
could do ruju’ (the reconciliation of marriage after delevering talaq/ divore), so the
percentage of divorce in Islamic society will be decreased and the purpose of marriage which
is life in sakinah mawaddah wa rahmah will be built.
