JUDICIAL AFFIDAVIT

I, JOSEPHA GWAPA ALYAS "INDAY", Filipino, of legal age,

married, and with residence at #88 Mangaranon Village, Silay City,
Negros Occidental, currently staying in Brgy. Maoy, Municipality of
Maisog, Iloilo, after having been sworn to in accordance with law, do
hereby depose and say that:

This examination is being conducted by Atty. Aria W. Stark in

Winterfell Compound, La Pazzi, Iloilo City. I hereby state that I
understand that I am answering the questions under oath, and do so
fully conscious that I may face criminal liability for false testimony or
perjury;

That the following questions were advanced to me by Atty. Stark in

English, and I have given my answers in English as well, having fully
understood the same and likewise being fluent in the use of the said
language.
1. Question: Please state your name, age and your address.
Answer: I am JOSEPHA GWAPA ALYAS "INDAY", Filipino,
34 years of age, married and a resident of #88 Mangaranon
Village, Silay City, Negros Occidental, currently staying at
Brgy. Maoy, Maisog, Iloilo.

2. Q: Do you understand why you are here right now?

A: Yes.

3. Q: Why are you here today?

A: I am here to testify regarding the threats made by a Man
with a dragon tattoo on his left arm to Beauty Contes
Delgado.

4. Q: You said that you are really from Negros Occidental. May
I ask what is the reason why you are currently here in Iloilo?
A: I am only here for vacation, Sir.

5. Q: How long have you been staying for vacation here in

Iloilo?
A: Almost three months, Sir.

6. Q: For almost three months, did you have any chance of

having a conversation with the victim, Ms. Delgado?
A: Just a couple of times sir, mostly when we see each other
in the market.

7. Q: Since both of you had the chance to talk to each other,

does that mean that you can recognize her face very well?
A: yes, sir.

8. Q: Can you tell me where did you witness the incident?

 A: Near the sari-sari store of Mang Bong, Sir.

9. Q: How Come?
A: I was on my way home at that time when I saw a man
holding the arms of Ms. Delgado and it seems to me that he
is forcing her to come with him.

10. Q: What did you do at that time?

A: Because I was curious, I pretended to buy softdrinks at
the store of Mang Bong to be able to hear clearly their
conversation.

11. Q: Can you tell me, what did you hear, if any?
A: The man told Beauty that he will kill her boyfriend and
her if Beauty will not go with him.

12. Q: So what is the response of Beauty?

A: Beauty told the man to leave her alone because she
does not love him.

13. Q: What happened next?

A: The man continued to threaten Beauty and this time,
he held on to forcefully to the arm of Beauty.

14. Q: After that, what happened next?

A: Because I can no longer take what the man is doing to
Beauty, I told him to get his hands off the lady or else I will
call the Police.

15. Q: Did you succeed in asking the man to take his hands
off Beauty?
 A: Yes Sir. But before the man left, he told Beauty the
words “Hindi pa ta tapos, patyon ta gid kamo.”

16. Q: Do you have anything to add? What happened after?

A: That’s it, I have nothing more to add, Sir.

17. Q: Do you confirm the truthfulness of your statements in

this affidavit?
A: Yes, Sir.

I, ARIA W. STARK, of legal age, Filipino, with residence at

Barangay North, Winterfell, Iloilo and with office address at Winterfell
Compound, La Pazzi, Iloilo City, under oath states that:

1) I am the legal Counsel for the Plaintiff in this case.

2) I faithfully recorded or caused to be recorded the questions
I personally asked and the corresponding answers that the above-
named witness gave;
3) Neither he nor any other person then present or assisting
him coached the witness regarding the latter’s answers; and
4) I conducted the examination of the witness at my office
address at Winterfell Compound, La Pazzi, Iloilo City.

proven his identification through his Identification Card issued by the
