MOTION FOR EXECUTION


WITH RECOMPUTATION OF MONETARY AWARD

Complainant, by himself, and unto this Honorable Court most


respectfully states:

1. That on 09 August 2019 the Honorable Special 15th Division of the


Court of Appeals rendered a Decision, the dispositive of which states:

“FOR THESE REASONS, the assailed Decision dated


31 March 2017 and Resolution dated 27 June 2017
rendered by the Fifth Division of the National Labor
Relations Commission (NLRC) in NLRC LAC No. 03-
001164-17 (NLRC Case No. 11-14694-16) are
AFFIRMED WITH MODICATION. Petitioners, jointly and
severally, are ORDERED TO PAY Richard de Torres
Condeno the following:

a) Backwges, including the 13th month pay and


Five Thousand Pesos (P5,000.00) –monthly
allowance, computed from the date petitioners
constructively dismissed Condeno on 29 December
2015 until the finality of this Court’s Decision;
b) Separation Pay computed from Condeno’s
first day of employment on 01 August 2015 until the
finality of this Court’s Decision;

c) Thirty thousand Pesos (P30,000.00) moral


damages and Thirty Thousand exemplary damages;
and
d) Legal interest at the rate of six percent (6%)
per annum of the total monetary awards from the
date of finality of this decision until full satisfaction.

The NLRC is hereby ORDERED to make a


RECOMPUTATION of the total monetary awards from
the date of finality of this decision until full
satisfaction.

SO ORDERED.”

2. That respondents failed to file a Motion for Reconsideration before


the Court of Appeals.

3. That on January 2020, the Honorable Court of Appeals issued an


Entry of Judgment in this case. certified true copy of the said
Decision and Entry of Judgment are hereto attached respectively and
made as integral part hereof.

4. As such, complainants prayed for the issuance of a writ of execution


after the honorable NLRC makes a recomputation of complainant’s
monetary award in conformity with the aforementioned CA’s
decision.
