CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This Contract of Lease made and entered into this ___ day of _________ 2019 in
Taguig City, Metro Manila, Philippines, by and between:

JAMES BUNDA and _________________, married of legal age, Filipino and


with postal address in Marikina City hereinafter referred to as the LESSOR.

- and -

ALEXANDER CALIHAN and ANGELINA CALIJAN, married of legal age,


Filipino and with postal address in Taguig City hereinafter referred to as the LESSEE.

WITNESSETH THAT-

Whereas, the LESSOR is the absolute and registered owner of a THREE


BEDROOM UNFURNISHED UNIT situated at Unit 1409 of Bldg. Jade, Rosewood
Pointe Acacia Estates Taguig City, hereinafter referred to as the LEASED
PREMISES.

NOW, THEREFORE, for and in consideration of the foregoing and mutual


covenants herein contained, the LESSOR has let and by these presents does hereby let
and lease unto the LESSEE, the aforesaid LEASED PREMISES, under the following
terms and conditions:

1. TERM OF THE LEASE – The lease shall be for a period of TWO YEAR/s
commencing on MARCH 01, 2019 to FEBRUARY 29, 2020, renewable upon
mutual agreement of both parties.

2. LEASE RATE – The parties herein agreed that the monthly rental of the
Leased premises shall be TWENTY THREE THOUSAND PESOS
(23,000.00), inclusive of association dues only.

a. Upon signing this Contract of Lease, the Lessee shall pay the Lessor the
amount of “NINETY TWO THOUSAND Pesos” (92,000.00) for two
months advance and two months deposit plus twenty post dated ckecks.

b. FORTY SIX THOUSAND Pesos applied as Security Deposit. The security


deposit shall answer for any unpaid bills such as water, gas, electricity, etc.,
and the balance if any, shall be refunded to the Lessee within sixty (60) days
from the date of termination or upon presentation of proof of settlement of
all accounts herein. It is further understood that the deposit shall in no case
be applied as rental and is non-interest bearing. This deposit will be applied
first for all the damage on the leased premises incurred during the terms of
the lease.

c. FORTY SIX THOUSAND Pesos to be paid as TWO month/s advance


rental fee to commence on March 01, 2019 to April 30, 2019 and February
01, 2020 to February 29, 2020.

d. The Leased Premises shall be used for residential purposes only and must
not be subleased without the written consent of the Lessor. The maximum
number of people allowed to live in the Leased Premises is seven (7)
including children and house helpers.

e. All expenses for water, electricity, telephone, internet and common area
dues shall be for the account of the LESSEE.
f. Upon signing of the Contract of Lease, the monthly rental will be paid
through checks dated every end of the month.

3. IMPROVEMENTS – The LESSEE shall not make any structural changes,


alterations or improvements in the Leased Premises without the written
consent of the LESSOR and the Condominium Association. However, any
major alterations or improvements made and introduced by the LESSEE, shall,
upon the termination of this Contract, automatically insure to the benefit of the
said premises and become the property of the Lessor without any obligation on
the latter’s part to pay or refund its value or cost to the Lessee. The Lessee may
remove all the improvements introduced with the consent of the Lessor
provided such removal will not cause any damage to the Leased Premises.
Furthermore, if the removal of such things should cause damage or defacement
to the property or structure, the Lessee shall fully compensate the Lessor for
such damage. The Lessee is allowed to drive nails, screws, hooks, or other
abutments on the walls as long as a proper drill gun is used to drill the walls to
avoid damage.

4. SANITATION AND REPAIRS – The LESSEE shall keep the premises clean
and in sanitary condition. The LESSOR shall NOT be responsible for all the
major repairs on the premises and on the water, electrical and sewage
installations caused by fault or negligence of the LESSEE, members of his
household, guests or visitors. Minor repairs costing Three Thousand Pesos
(P3,000.00) and below, shall be for the account of the LESSEE. Control of
pests, such as cockroaches, rats and the likes are for the LESSEE’s account.

5. FIRE HAZZARD and OBNOXIOUS SUBSTANCES – The LESSEE shall


not keep, deposit or store in the premises any obnoxious substances, illegal
drugs or inflammable materials or substances may constitute a fire hazard.

6. TAXES and INSURANCE – Real Estate Tax, Government Assessments and


fire insurance charges shall be for the LESSORS’s account.

7. THIRD PARTY LIABILITY – The Lessee, during his occupancy of the


Leased Premises shall hold the Lessor free and harmless from any damages,
liability or responsibility to any person or property arising out of or as a
consequence of the use of the Leased Premises by the Lessee, her family, her
agents, employees, domestic help and guests. The Lessor has no liability in case
of damage or liability caused by fortuitous events or acts of God, such as
typhoons, earthquakes, explosion, flood, and the likes. If the Leased Premises
should be damaged or destroyed to such an extent as to make it untenantable,
without the fault or neglect of the Lessee, either party may demand termination
of this Contract of Lease. As a consequence thereof, all advance but unused
rentals shall be refunded by the Lessee.

8. RULES AND REGULAIONS – The LESSEE of the LEASED PREMISES


agrees to abide by the existing rules and regulations promulgated by the
Condominium Corporation as well as those promulgated during the period of
this Contract of Lease.

9. INSPECTION OF PREMISES – The LESSEE shall maintain the LEASED


PREMISES in good and tenantable condition and for such purpose the
LESSOR reserves the right at reasonable times and with the prior consent of
the LESSEE, to enter and inspect the premises and to make the necessary
repairs thereof. The LESSEE likewise agrees to cooperate with the LESSOR in
keeping the said premises in good and tenantable condition.

10. SUBLEASE and ASSIGNEMENT of RIGHTS – The Lessee is leasing the


Leased Premises for the use of his/her family. The LESSEE shall not assign,
sell or transfer her lease or rights of the Leased Premises or any part thereof
without the prior written consent of the.
11. FAILURE to PAY on TIME – In case of failure to pay the monthly rental on
time, the Lessee shall pay a penalty of 3% per month and shall confer upon the
Lessor, without the necessity of a court order/decision, the right to disconnect
all utility facilities such as electricity, water, telephone, and others, to the leased
unit w/in 72 hours from receipt by the Lessee of the written demand to pay such
utilities. If there is a bouncing check, the Lessee is obligated to replace it within
seven (7) days or else the unit will be padlocked. Any bank charges encountered
by the Lessor as a result of a bouncing check, shall be paid by the Lessee to the
Lessor.

12. RENEWAL OR TERMINATION – The LESSEE shall notify the LESSOR


of its intention to renew or terminate the Contract of Lease by giving sixty (60)
days notice prior to the expired date of lease, otherwise, the LESSOR is
automatically authorized by the LESSEE to rent out the said premises to third
parties and show the unit to prospective clients at reasonably pre-arranged times
within the last sixty (60) days of the Contract of Lease.

13. SALES, TRANSFER, OR MORTGAGE – In the event of sale, transfer,


mortgage or any other encumbrances of the LEASED PREMISES, the
LESSOR shall warrant that the purchaser, mortgage, encumbrance shall respect
the terms and conditions of this contract.

14. RETURN of PREMISES – Upon termination of this contract, for any reason
whatsoever, the Lessee shall immediately vacate the premises and return the
possession there of to the in good/satisfactory, tenantable condition. The
inspection of the Leased Premises by the Lessor shall be conducted within
seven (7) days from the time of notification by the Lessee that the said premises
have been completely vacated. The Lessee also reserves its right to be present
during the inspection of the Leased Premises.

Cost of the general cleaning upon surrender of the LEASED PREMISES will
be for the account of the LESSEE. If the said premises be not surrendered at the
expiration of the lease, the LESSEE shall be responsible to the LESSOR for
ALL damages which the LESSOR may suffer by reason thereof.

15. INTERRUPTION OR HINDRANCE – Any interruption or hindrance in the


use by the LESSEE of the LEASED PREMISES due to repairs as may be made
therein or interruption or services of any public utility shall not entitle the
LESSEE to any damage or compensation whatsoever nor shall it be a cause for
the deduction of rentals.

16. BREACH or DEFAULT – Any violation of the terms and conditions of this
Contract of Lease on the part of the Lessee or the Lessor shall be sufficient
ground for the termination of this Contract of Lease. In the event of such
termination by breach of contract on the part of the Lessee, the security deposit
shall be forfeited in favor of the Lessor and be considered damages.

17. VENUE – Venue of all suits actions arising out of or in connection with this
contract shall be in Taguig City.
