General Provisions

Article (1): The Purpose of This Regulation
This regulation describes the authority, responsibilities, الغرض من الالئحة:)1( مادة

Civil Aviation and Meteorology Authority Which is known in أٔظّشٚ حػذٛك ٌم١حٌظطزٚ حأل٘ذحف حٌّظؼٍمش رخالِظؼخيٚ ش١ٔٛٔحٔذ حٌمخٛحٌـ
this regulation as the (CAMA). It is intended to be a guide in خٙ١ ِخخٌفخص ِئوذس ال طغطٞأٚ ،حألسفخدٚ ٟٔشحْ حٌّذ١جش حٌؼخِش ٌٍط١ٌٙح
the exercise of discretion by the various CAMA personnel ش٠ طمذ،ُٙ رلىُ خزشط،جش١ٌٙٓ رخ١لغ ِٓ حٌّخظقٛ فبٔٗ ِٓ حٌّظ،٘زٖ حٌالثلش
involved. It is recognized that this regulation does not cover
زحٙجش ر١ٌٙخعش ح١ز ع١ ِغخس طٕفٟ لذِخ فٟكخٌش وً ِخخٌفش ٌٍّن
every situation, and there will be cases where deviation is

warranted. It is expected that CAMA personnel will use their

Article (2): Enforcement Objectives and Policy أهداف وسياسة الضبط واإلنفاذ:)2( مادة
The central mission of this regulation is to promote compliance ش حٌغالِش١٠ض حالِظؼخي ٌّؼخ٠ طؼضٛ٘ ِٓ افذحس ٘زٖ حٌالثلشٟذف حألعخعٌٙاْ ح
with safety standards and the rules of air transportation. Through :ٍٟ٠ ِٓ خالي ِخ،ٞٛحػذ حٌٕمً حٌـٛلٚ
the following:
ٓش ِخ أِى١ّ١حٌّظطٍزخص حٌظٕظٚ ش١٠ز حٌفؼخي ٌظٍه حٌّؼخ١(أ) مّخْ حٌظٕف
(a) To ensure the effective implementation of standards and
regulatory requirements whenever possible. خدحصٙ حٌؾٍِٟحألٔظّش ِٓ لزً كخٚ حثقٌٍٛ(ب) مّخْ حالِظؼخي ٌىخفش ح
ٞٚ وخفش حألفشحد رٍٝػٚ .جش١ٌٙـ حٌقخدسس ػٓ ح١ حٌظشحخٚحإلؿخصحص أٚ
(b) To ensure compliance with all regulations. This obligation is ٓ حٌغالِش١ًِ طؤ١ عزٟٔٗ فٚئد٠ ٞس حٌلخعُ حٌزٚؼخد حٌذ١ حعظ،حٌؼاللش
especially critical as it applies to the holder of CAMA

certificates, licenses or authorizations. All individuals must
clearly understand the crucial role they play in achieving جش فشك حالِظؼخي١ٌٙ حٍٝػٚ ،حألٔظّشٚ حثقٌٍٛ رّظطٍزخص حٟػٛ(ج) حالٌظضحَ حٌط

(c) While compliance can be compelled where necessary, civil ٟحٌّخخٌفخص حٌّلظٍّش فٚ خوخصٙ وؾف حالٔظٍٝ حٌؼًّ ػ:ٛ(د) اىَشاقجخ ٗاىتحش
aviation safety depends primarily on voluntary adherence to ِخخٌفخص ِلظٍّشٞـذ حعظمزخي حٌزالغخص ػٓ أ٠ وّخ.ٓلض ِّىٚ أعشع

(d) Surveillance and Detection: It is essential that violations and .لض حٌّٕخعذٌٛح
potential violations be discovered at the earliest possible ك حٌؼخدي١سس ٌنّخْ حٌظطزٚ مشٞسٛؼذ حإلؿشحء حٌف٠ :ٛ(ه) اإلخشاء اىف٘س

promptly rests equally with each of the personnel involved in

Regulations governing the transportation of hazardous رييييييييخصٛش رخٌؼم١ييييييييخص حٌمنييييييييخثٙنييييييييخ حٌشفييييييييغ ٌٍـ٠جييييييييش أ١ٍٙ ٌ ييييييييض١طـٚ
material by air are enforceable by means of civil and criminal ٟٔييييييشحْ حٌّييييييذ١ْ حٌطٛٔييييييخ رمييييييخٙ١ٍؿ ػٛحٌـييييييشحثُ حٌّشطىزييييييش حٌّٕقييييييٚ

(h) Enforcement Processing: When violations occur, firm action ش١ش حٌمنيييييخث١حٌظيييييذحرٚ ّش١ٍفميييييخ ً ٌإلؿيييييشحءحص حٌغيييييٚ رٌيييييهٚ ،ٛػزيييييش حٌـييييي

Article (3): Applicability Scope and Principles ُييييييييٙحٌظؼخِييييييييً ِؼٚ ٓ١حطخييييييييخر اؿييييييييشحءحص فييييييييخسِش رلييييييييك حٌّخييييييييخٌف
َٓ حٌلييييييييييض١حصْ رييييييييييٛيييييييييك حٌظيييييييييي١ طلمٝشحػيييييييييي٠ ْ أٝ ػٍيييييييييي،َرليييييييييض
(i) The enforcement requirements described in this regulation are

equally applicable to all activities regulated by CAMA. When

Operator, the performance of aircraft maintenance, or the

enforcing those regulations shall investigate, report, and ًخص حٌّؾغ١ٍّخ ػاللش رؼٌٙ ْحء وخٛ ع،ع ِخخٌفخصٛلٚ ػٕذٚ .حءٛكذ ع
address such matters for appropriate enforcement-action ٟظفِٛ ٍٝ فبْ ػ،ً حٌطخثشحص١ رظؾغٚخٔش أ١ش حٌق١ٍ فخػٜ رّذٚ أ،ٞٛحٌـ

(j) Air Operator Compliance: Air Operators shall perform their

services with the highest possible degree of safety.
Achievement of that goal requires a concerted effort by CAMA ٍٝفك أػٚ ٗ خذِخطٞئد٠ ْ أٞٛ حٌّؾغً حٌـٍٝ ػ:ٛ٘(ب) اٍتثبه اىَشغو اىد
and the air operators. Special efforts should be undertaken to د ِظنخفشسٛٙظطٍذ رزي ؿ٠ ،ذفٌٙك ٘زح ح١ٌظلمٚ .دسؿش ِّىٕش ِٓ حٌغالِش
keep air operators apprised of the methods by which CAMA جش رزي١ٌٙ حٍٝ وّخ أْ ػ.حءٛ كذ عٍٝ حٌطخثشحص ػٍِٟؾغٚ جش١ٌِٙٓ ؿخٔذ ح
inspections are carried out and of any recurring incidence of جش١ٌٙخ حٙ طٕفز رٟ ػٍُ رخٌطشق حٌظٍٝ حٌطخثشحص ػٍٟد خخفش إلرمخء ِؾغٛٙؿ
non-compliance discovered in those inspections. Air carriers لخثغ ِظىشسس طىظؾف أػٕخءٚ ٞ ؿخٔذ أٌٝ ا،يٚال رؤٚش أ١ؾ١خ حٌظفظٙخط١ٍّػ
are encouraged, in turn, to utilize such information to evaluate ٓ١ٍظُ دفغ حٌّؾغ٠ ً حٌّمخرٟفٚ .ٔخطـش ػٓ ػذَ حالِظؼخيٚ ؼ١خص حٌظفظ١ٍّػ

(k) Policy: Compliance with the regulations is promoted through .ش١ٍ١ُ حٌظؾغٙخط١ٍّػٚ

i. Prevent future actions which would violate ٟش ف١ّش حٌشع١ّٕٔٛٔخ ططزك حإلؿشحءحص حٌمخ١ ر.ُش ِالث١ غٚ أٞسٚمش

ii. Impose punitive sanctions, after the act, to

Article (5): Enforcement Principles. : مبادئ الضبط واإلنفاذ:)5( مادة
In setting sanctions, the following basic principles apply- :ش١ٌـذ ِشحػخس حٌّزخدة حٌظخ٠ ،رخصٛحٌؼمٚ ذ حٌـضحءحص٠ػٕذ طلذ
(a) The initial enforcement action should reflect CAMA's best ٟييش حٌظيي١ حٌخٍفٝ ػٍييٟييذ حٌـييضحء ِزٕيي٠ ٌظلذٌٟييْٚ حالؿييشحء حألٛىيي٠ ْـييذ أ٠ )أ
assessment of a fair sanction for the violations alleged. ًلمييك ؿييضحء ِٕقييف اصحء ويي٠ رّييخٚ ،جييش١ٌٙ حُٟ ِخظقيي١يي١ييخ طمٙ١ٌ حٝأفنيي

(b) Significant enforcement actions shall be coordinated with the
Chairman of CAMA or his delegate to ensure consistency of ظ١ك ِيغ سثي١ـيذ حٌظٕغي٠ ،َيخٌٙك اؿشحءحص حٌـضحءحص رحص حٌؾؤْ ح١د) ػٕذ ططز
sanctions and national policy. .ش١ٕهٌٛخعش ح١ ٌنّخْ ططخرك حٌـضحء ِغ حٌغ،ٍّٗؼ٠ ِٓ ٚجش أ١ٌِٙـٍظ ادحسس ح
(c) CAMA Inspectors considers the following violations the most ،خوييخصٙييخ أخطييش حالٔظٙٔ أٝ ػٍيي،ييش١ٌجييش حػظزييخس حٌّخخٌفييخص حٌظخ١ٌٙ حٟ ِفظؾييٝؽ) ػٍيي
serious violations that warrant the most severe sanctions: - :سٛرخص لغٛ فشك أؽذ حٌؼمٟخ طغظذػٙٔ فبٌٟرخٌظخٚ
(1) Falsification of records, logs, or documents; .ش١ٕحألدٌش حٌفٚ حٌغـالصٚ ػخثكٌٛش ح٠ٚطض )1(
(2) Negligent, careless or reckless manner by ٓ١ٌٛظخس ِييٓ لزييً حألؽييخخؿ حٌّخييٙ حالعييظٚحإلّ٘ييخي أٚ ش١حٌظمقيي )2(
licenced/authorized personnel, .حٌشخـٚ حإلؿخصحصٍِٟكخٚ
(3) Denial / obstruction of access to premises, facilities, ٟيييُ فيييٍّٙٓ ِيييٓ أدحء ػ١ٌٛجيييش حٌّخييي١ٌٙ حٟظفٛػشلٍيييش ِيييِٕٚيييغ أ )3(
records, aircraft and aircraft equipment to the CAMA ُٚ أٙويزح ِيٕؼٚ ،يخٌُٙٛ دخٙ١ٓ ػٍي١ظؼي٠ ٟحٌّشحفك حٌظيٚ ٓ حألِخوٌٝي اٛفٌٛح
authorized personnel; .خٙؼ عـالط١طفظٚ خٕٙش ِؼذحط٠ِؼخٚ ي حٌطخثشحصُٛ ِٓ دخٙػشلٍظ
(d) Voluntary reporting of violations is a factor to be considered in ٓ ِيي، حٌّخخٌفييخصٝييش حٌـييضحء حٌّٕخعييذ ػٍيي٠ييش رؼييذ طلش١ػٛد) حػظزييخس حٌزالغييخص حٌط
assessing an appropriate sanction. .خ حػظزخسٌٙ ْٛى٠ ْـذ أ٠ ٟحًِ حٌظٛحٌؼ
(e) Except as otherwise specifically noted in this regulation or ريشٛػيخثك ِىظٚ ٟيٗ في١ٌ ِؾيخس اٚ أ، ٘يزٖ حٌالثليشٟيٗ في١ٌ ِؾيخس اٛ٘ـ) رخعيظؼٕخء ِيخ ٘ي
