MANIFESTATION WITH MOTION TO RESET HEARING

COME NOW, Respondents, by and through the undersigned


counsel, and unto this Honorable Office, most respectfully files this
pleading and aver, that:

1. Respondents received the Summons from this Honorable Office


dated 20 January 2020 only on 07 February 2020 ordering
them to appear before this Honorable Office on 11 February
2020 and 18 February 2020 at 10:00 o’clock in the morning;

2. The undersigned counsel was only informed of the receipt of the


said Summons only on 08 February 2020;

3. Unfortunately, the undersigned counsel, who is the retaining


counsel of the Respondents, has a prior scheduled hearing at
Municipal Trial Court in Cities – Malaybalay City for People vs.
Joseph Balinas (under Criminal Case No. 5638-19 at 1:30
o’clock in the afternoon on 11 February 2020. Attached
herewith is a copy of the Order of the Honorable Municipal Trial
Court in Cities – Malaybalay City scheduling the said case on
the said date;

4. The travelling time from Malaybalay City to Cagayan de Oro,


and vice versa, makes it impossible for the undersigned counsel
to appear before this Honorable Court on 11 February 2020;

5. In view of the foregoing, Respondents respectfully move that the


11 February 2020 setting of the above-cited complaint be
cancelled and another date set in lieu of the same.
6. This motion is not intended to delay the proceedings of this case
but based solely on the above-stated reasons.
PRAYER

PREMISES CONSIDERED Respondents respectfully pray that


the 11 February 2020 setting of this case be cancelled and another
one be set in lieu of the same.

Other reliefs just and equitable under the premises are


likewise prayed for.
