2. There are two main Sessions in each academic year, Autumn Session runs from March to the beginning of July. Spring
Session runs from July to the end of November. Some courses at UTS run on an alternative Calendar B.
Calendar B Autumn Session runs from the end of February to the beginning of July. Calendar B Spring Session runs
from the end of July to the beginning of December.
UTS has other Sessions with varying durations in addition to the Autumn and Spring Sessions. UTS reserves the right
at any time to change the UTS Academic Calendar including but not limited to the organisation of Sessions.
3. Tuition Fees are charged on a per-credit-point basis. The above quoted Tuition Fee per Session assumes you will
enrol in a standard 100% Credit Point load for your chosen course, which is normally 24 Credit Points per Session.
Your actual course cost per Session may differ from this figure depending on the course and the number of credit
points taken per Session. UTS reserves the right to change the number of Credit Points per Session that constitute a
standard 100% Credit Point load.
4. Tuition Fees for core subjects within the course or major are quoted for 2020 and are subject to annual
increase. For more information regarding fees and fee refunds, you must read the attached UTS Statement of Protocol
on Fees and Refunds for International Students Studying in Australia . You must factor in the likelihood of an annual
tuition fee increase into your overall budgeting, as well as considering the impact of fluctuating exchange rates if you
are using funds from an overseas country. Note that the deposit does not include the cost of non-tuition fee items,
including but not limited to, administrative fees, accommodation, accommodation and welfare levy (if applicable),
including but not limited to, administrative fees, accommodation, accommodation and welfare levy (if applicable),
travel, living expenses, books, other study items, OSHC and the SSAF. You should be prepared to meet these
additional costs. Please refer to the attached ‘General Estimate of Annual Costs for International Students’ for further
information.
5. The quoted SSAF is based on the rate applicable for each Autumn and Spring Session in the year stated and is subject
to annual increase. You will be liable to pay the SSAF applicable for each Autumn and Spring Session in which you
enrol, however, you will only be charged the SSAF after the census date. UTS reserves the right to vary the method of
charging the SSAF
6. You are required to purchase OSHC for yourself and any accompanying dependants for the entire time you are in
Australia on a student visa. OSHC is payable upfront as a lump sum for the full length of your stay on a student visa.
Medibank is the UTS preferred provider for OSHC but you may purchase OSHC from an authorised provider of your
choice. The cost of cover may differ between insurers and the plan you choose. You are responsible for paying any
additional charges required by your health insurer to ensure you have health cover while in Australia on a student visa.
Please note that you will need to submit evidence of your OSHC arrangements when you lodge your visa application

7. The amount stated above in the Offer Summary is an estimate based on the visa grant period published by Department
of Home Affairs, for more information visit

8. This Offer Summary is an estimate only. It does not take into account the impact of likely annual increases in tuition
fees, OSHC and the SSAF. It does not include the cost of accommodation, living expenses, transportation, books and
other study expenses. For more information on these additional costs please refer to the attached General Estimate of

9. You should complete your course within the standard duration for that course. Any change to your enrolment that may
increase the length of time you need to complete your course can only be made in special circumstances and with
official approval by UTS. If you apply for and receive Recognition of Prior Learning (RPL) after acceptance of this
offer, appropriate adjustments will be made to your course duration.

b. Prior to finalising your admission to UTS and upon receipt of the acceptance of this offer, UTS reserves the right to
undertake an assessment of "Genuine Temporary Entrant" (GTE) and "Genuine Student" (GS) requirements set by the
Department of Home Affairs. For further information please refer to www.homeaffairs.gov.au

The assessment may be carried out directly by UTS or by a UTS Authorised Representative. For a list of the UTS

As part of the assessment you may be required to provide further documentation or to participate in an interview
relating to GTE and GS criteria.

Failure to provide the requested documentation or failure to participate in the interview will result in UTS
withdrawing this offer.
On receipt of the requested documentation and completion of the interview, if UTS is not satisfied that you have met
the GTE or GS criteria, UTS reserves the right to withdraw this offer.

As part of the assessment process, UTS or its Authorised Representative will also authenticate all documents provided
with your application to date.

If you provide false or misleading documentation or information with your UTS and/or your Australian visa
application, you will be considered to be a non-GTE applicant and UTS reserves the right to withdraw this offer
c. If you are under the age of 18 on arrival to Australia you must have welfare arrangements in place for the length of
your student visa or until you turn 18 years of age. Prior to accepting this offer, you must advise UTS if you wish for
UTS to be your nominated welfare and accommodation provider by issuing a CAAW letter or if the Department of
Home Affairs has approved alternate arrangements for you. UTS reserves the right to terminate the CAAW where the
student breaches the terms of this offer and UTS’s policies and procedures. Termination of a CAAW may lead to
cancellation of your student visa by the Department of Home Affairs.
d. This offer is made under the Simplified Student Visa Framework (SSVF) and all visa applications will be processed
under the SSVF. UTS reserves the right to take any action it deems necessary under the SSVF process including
without limitation requiring the production of further documentation. Students wishing to transfer courses should note
that under the SSVF and student visa condition 8202, they are expected to maintain enrolment at the same or higher
level of Australian Qualifications Framework (AQF) study. You will be required to apply for a new visa if you wish to
transfer to a course that is at a lower AQF level. (Please see UTS Release Protocol attached to this document).
UTS cannot give visa or immigration advice.
You should seek your own immigration advice if you wish to change course and/or provider, as these changes may
impact your visa including cancellation. You must take this important information into account when accepting this
offer and if you are considering a course change or a possible move to another provider.
If you are under the age of 18 and you intend to transfer to a new provider, the request must be authorised by your
parent(s)/ guardian. It is your responsibility to make arrangements with the new provider to ensure there are no gaps in
your welfare and accommodation arrangements.

e. UTS may, at any time, assess whether this offer and any subsequent enrolment by you to study at UTS complies with
all Australian Commonwealth and State laws and regulations (including without limitation those relating to sanctions
regimes). UTS reserves the right to take any appropriate action to comply with all such laws, including without
limitation withdrawing any offer made to you, cancelling your enrolment in a UTS degree course (or any part of that
course) or applying for a sanctions permit.
f. If you are unable to commence your study for the intake specified on your letter of offer you may be able to apply to
defer your degree. You can request to defer your offer for up to twelve (12) months. To be considered, you will need to
state the intake you wish to commence your studies at UTS and the reason you wish to defer. Please note that any
deferment will be subject to the entry requirements, the deposit and any new tuition fees applicable to the new

How to Accept this Offer:
1. Read the Letter of Offer including this Offer Summary, all attached documentation and web-based information
carefully.
2. Read, complete and sign the attached Acceptance Form. If you are under the age of 18, a parent or guardian must sign
your Acceptance Form.
3. If you haven't already done so, provide a copy of the page from your passport with your signature and personal details
or official identification card with signature.
4. If you and your sponsor/s wish to pay more than 50 per cent of tuition fees up front before you commence your
course, please contact UTS to arrange this.
5. Organise payment of the required deposit by the due date. Please contact UTS International if you require further
information.
6. Add the accommodation and welfare levy to your deposit if you require UTS to organise approved accommodation
and issue a CAAW. UTS Insearch provides international students under the age of 18 with accommodation and
welfare arrangements on behalf of UTS.

7. Purchase your own OSHC for you and any accompanying dependants. All student visa holders (except Belgian,
Norwegian and some Swedish students) are required to purchase OSHC. You will need to show OSHC cover for the
full duration of your studies in Australia to apply for your Student Visa. For students from Norway, Belgium and
Sweden please refer to http://www.homeaffairs.gov.au/ for eligibility to have OSHC waived.
Medibank is UTS’s  preferred provider.  If you wish to purchase OSHC with Medibank, go to

Please read the information carefully before purchasing OSHC. Ensure that you are aware of the coverage and any
exclusions under the policy.
8. Please note that, after enrolment, you will be billed for the remaining amount of fees (if any) for the first Session (i.e.
the first Session fee less the deposit already paid). You will also be required to pay the SSAF as described in the Offer
Summary.
9. Upon acceptance of this offer, UTS may conduct a GTE/GS check and you may be requested to provide additional
documentation as required.

1. In order to be admitted to UTS, I must satisfy the Genuine Temporary Entrant (GTE) and Genuine Student (GS)
requirements as set by the Department of Home Affairs.

2. I am fully responsible for payment of my tuition fees, living expenses and all other related costs and expenses incurred
by me and any dependants during my enrolment  at UTS;
3. UTS will not be responsible for payment of any fees, costs or expenses set out in the paragraph above;
4. Tuition fees, accommodation fees (if applicable) and the Student Services and Amenities Fee (SSAF) increase from
year to year and I accept that it is my responsibility to pay the increased fees as required;
5. If I fail to pay all my tuition fees, UTS will cancel my enrolment;
6. I will not be able to enrol at UTS after the session commences. If I enrol online, I must obtain my student ID card by
the last date to enrol in a subject for that session. Failure to do so may result in UTS withdrawing me from the course;
7. If I intend to bring school-aged dependants to Australia, I will be required to pay full fees if they are enrolled in either
a government or non-government school;
8. The personal information collected on this form and during my enrolment at UTS may be disclosed to the
Commonwealth including the TPS or State or Territory agencies and designated authorities where required for
compliance with the Education Services for Overseas Students Act 2000 (Cth) (ESOS Act) and associated legislation
with which UTS must comply. Personal information will be handled in accordance with the UTS Privacy Management
Plan and the Privacy Act 1988;
9. While on a student visa I am required to inform UTS of any change to my personal details including changes to
residential address, mobile telephone number, or email address as well as who to contact in emergency situations
within 7 days;
10. UTS reserves the right to withdraw an offer of admission and/or cancel my admission or enrolment at any time if: 
UTS is not satisfied that I meet the GTE and GS requirements set by the Department of Home Affairs;
if I have provided or cause to be provided, false, inaccurate or misleading information to UTS and/or the
Department of Home Affairs at any time;
if for any reason I am unable to obtain or maintain a student visa; and/or
where UTS considers in its absolute discretion that my admission or enrolment in the course or part of the course
would be in breach of, or would risk being in breach of any Australian Commonwealth or State legislation.
UTS will apply the Refund Protocol as appropriate.
11. This written agreement, and the right to make complaints and seek appeals of decisions and action under various
processes, does not affect any consumer rights I may have under the Australian Consumer Law;
12. I am required to complete my course within the standard course duration and if I fail to do so UTS may cancel or
refuse to extend my enrolment;
13. My student visa may be cancelled by the Department of Home Affairs if I do not maintain enrolment at the required
AQF level under the Simplified Student Visa Framework (SSVF), as applicable.
14. In accordance with the requirements of the National Code under the ESOS Act, if I wish to transfer to another provider
during the first 6 months of my course at UTS, I must obtain a release letter from UTS. The request will be assessed
under the UTS Release Protocol which is compliant with the National Code.
15. It is my responsibility to keep a copy of the offer letter, acceptance, payment receipts and all relevant attachments for
my records.
16. If I am under the age of 18: 
I am responsible to arrange and maintain approved guardianship, welfare and accommodation arrangements and I
must ensure that I have adequate arrangements in place for the length of my student visa or until I turn 18 years
of age
I am required to inform UTS of any changes to the contact details of my parent(s)/ guardian or any adult
responsible for my welfare.
I must not arrive in Australia prior to the commencement date of my welfare arrangements
My parent(s)/ guardian must sign or otherwise approve any variations to my enrolment, including but not limited
to course or provider transfer, deferral and changes to accommodation and welfare arrangements.
Comply with the UTS U18 Protocol for International Students.
17. Where UTS agrees to issue a CAAW letter: 
I must not arrive in Australia prior to the start date listed on my CAAW letter.
I am not permitted to change my approved accommodation and welfare arrangements without approval from UTS
I agree to comply with any applicable policies and procedures of UTS and approved third parties who provide all
or part of accommodation and welfare services on behalf of UTS.
I must not travel interstate or outside Australia without seeking approval from UTS.
I must ensure that I pay my accommodation and welfare fees as required.

4. The quoted SSAF is based on the rate applicable for each Autumn and Spring Session in the year stated and is subject

charging the SSAF
5. Tuition Fees are charged on a per-credit-point basis. The above quoted Tuition Fee assumes you will enrol in a
standard 100% Credit Point load for your chosen course, which is normally 24 Credit Points per teaching Session.

6. Tuition Fees for core subjects within the course or major are quoted for 2020 and are subject to annual

UTS must ensure it meets Commonwealth and NSW legislation and other regulatory requirements relating to the welfare
and protection appropriate for enrolled students under 18.
UTS is a university environment and in accepting a UTS Letter of Offer you understand and acknowledge that if you are
under the age of 18 years when you commence study at UTS, you will be mixing with adults as part of general university
life and are expected to participate in all usual activities and events that are part of your course of studies including, without
limitation, enrolment, payment of fees, full internet access, laboratory or other technical work, research, field studies and
work experience placements.
If you will be under the age of 18 when you arrive in Australia, your visa conditions require that you maintain adequate
arrangements for your accommodation, support and general welfare until you turn 18 years of age. For more information,

Commencing your Course
Orientation and Preparation week is compulsory and is an essential activity for all new international students. You are
required to fully participate to ensure a smooth transition to university life. There will be a subject induction period prior to
the start of formal classes. It will include transition to study activities that may require attendance on campus and/or
provision of course/subject information via UTS Online. Students are expected to arrive at their first formal lesson having
completed the preparatory work in this period.
Late arrivals for Commencing Students
Late arrivals may not be accommodated in classes. If you are unable to arrive in Sydney before your required start date, you
are advised to request deferment (in writing). You can request a deferment for up to twelve (12) months. Please note that any
deferment will be subject to the entry requirements, the deposit and any new tuition fees applicable to the new requested
intake session.

Staying in Touch
You must notify the University of your Residential Address, email address, local mobile/ telephone number in Australia and
who to contact in emergency situations within 7 days of arriving in the country. If you are under the age of 18, you must
notify the University of any changes to the contact details for your parent(s)/ guardian or any adult responsible for your

number in Australia and who to contact in emergencies 7 days of the change. If you are moving to another institution, you
must notify the University of a change of education provider within 7 days of receiving the electronic Confirmation of
Enrolment certificate or evidence of enrolment. Your local telephone contact (e.g. mobile phone) is required, in case we
need to contact you urgently.
Student Services and Amenities Fee (SSAF)
Australian Universities charge the SSAF, which ensures the maintenance of a range of student services at universities. You
will be required to pay the SSAF in each Autumn Session and Spring Session in which you enrol. Payment of the SSAF will
be due after the census date in each Autumn Session and Spring Session. Please note that the SSAF is only refundable if it is
paid and you withdraw prior to the census date. The SSAF is subject to annual indexation. UTS reserves the right to vary the
method of charging the SSAF.

At UTS, the SSAF funds provide support to Students’ Association sponsored activities such as the second-hand bookstore,
as well as the UTS Union food, beverage and retail outlets, support for skills and language development and the UTS
Student Legal Service.
Overseas Student Health Cover (OSHC)
You must maintain your health insurance during your stay in Australia. This means that you must have OSHC for the entire
time you are on a student visa.
Completing Your Course on Time
In accepting a UTS Letter of Offer, you accept the terms of that letter, including the requirement that you must make your
best attempt to complete your course within the standard course duration.
Children
You must maintain adequate schooling arrangements for your school-age dependants who join you in Australia on a student
dependent visa for more than 3 months.

Transfer to other registered providers
International students who have been accepted into a course at UTS and wish to transfer to another registered provider in
Australia must be granted release from UTS if they have not yet completed 6 months of their principal course at UTS.
Where a student has obtained a Confirmation of Enrolment for multiple courses, the principal course is the final course in a
package of courses. Where a student is under the age of 18, a release request must be signed or otherwise approved by the
student’s parent/ guardian. If there are any gaps in the welfare and accommodation arrangements in between the transfer of
providers, the student may be required to return to their home country until the new approved arrangements take effect.
The University has procedures for assessing release requests. The procedures specify the grounds on which release requests
will and will not be granted and the procedures for appealing where a request is not granted. Release requests are assessed in
accordance with these procedures, which are set out in the UTS Release Protocol attached to this document.
Tuition Protection Service (TPS)
International students are protected by a Tuition Protection Service under Australian Government legislation. This
legislation sets out what happens when a registered provider or an overseas student or intending overseas student defaults
(that is, when a provider fails to start or finish providing a course to a student, or a student fails to start or finish a course
with a provider). The TPS ensures that students have the option to either complete their studies in another course or with
another provider or receive a refund of their unspent tuition fees.

Statement of Protocol on fees and refunds for


international students studying in Australia
PURPOSE
The purpose of this Protocol is:
1. to establish procedures and guidelines on the charging of fees for international student
admission and enrolment and for the refund of course- related fees for international students;
2. to establish the terms and conditions associated with fees and refunds to which international
students agree when accepting an offer for a UTS course;
3. to ensure that UTS fee and refund procedures for international students comply with the
Education Services for Overseas Students Act 2000 (Cth) and associated legislation and with
other relevant laws and regulations.

SCOPE
This Protocol covers all fee and refund information for international students who apply for admission
to UTS and who will reside in Australia for the duration of their course of study. For further information

payment/understanding-fees. It supplements Section 4 of the UTS Student Rules.

TERMS AND CONDITIONS FOR FEES AND REFUNDS FOR


INTERNATIONAL STUDENTS
These terms and conditions apply to all international students who have accepted an offer of
enrolment to a course of study by the University and all international students who are enrolled in a
course of study at the University.

DEFINITIONS
Acceptance Form means the acknowledgement that a student accepts the terms and conditions to be
admitted to a UTS course.

Accommodation and Welfare Levy means the non-tuition fees for the arrangement of
accommodation and welfare services for international students under the age of 18 payable at the time
of acceptance of the offer.

CAAW means Confirmation of Appropriate Accommodation and Welfare.

Census Date (for the purposes of this Protocol) means the date after which no Tuition Fees for that
Session will be refunded to Students who withdraw from a course.

Commencement Date means the first date of a Session or any other date decided by the University
from time to time.

Commencing Student means an international student who has returned a valid and signed
Acceptance Form to the University and will commence study at the University in the near future or who
is undertaking the first Session.

Continuing Student means an international student who has completed at least one Session at the
University.

Credit point means the unit of measure of workload for individual subjects. Credit points are gained by
students enrolled in award courses when subjects are passed and, when accumulated, credit points
form one measure of the total requirements of a course. As a standard measure at UTS, one academic
year of full-time study is equivalent to 48 credit points.

Deposit means the tuition fee amount specified in a Letter of Offer and payable by a Commencing
Student upon acceptance of an offer of enrolment.

Distance Students means a Student who will or does undertake their University course of study away
from the University campus and who resides outside Australia for the duration of the course of study.

GS means a person who satisfies the genuine student criteria and intends to obtain a successful
educational outcome and has the language, educational and material background to have a reasonable
chance of achieving this educational outcome.

GTE means a person who satisfies the genuine temporary entrant criterion for a student visa
application as administered by the Department of Home Affairs. For further information, visit the

Homestay means a UTS Insearch approved third party contracted by UTS Insearch to provide
accommodation, meals, transportation and welfare services for Students through a Homestay
Provider’s host/s.

Letter of Offer means the letter of offer including the terms and conditions of a Student’s enrolment to
study at the University.

Original Cohort Year means the year of intake listed in the most recent Letter of Offer accepted by the
student.

OSHC means Overseas Student Health Cover.

Protocol means this Statement of Protocol on Fees and Refunds for International Students together
with Section 4 of the UTS Student Rules and any schedules.

Session means a period of study of up to 6 months (or as otherwise determined by UTS).

Special Circumstances means the circumstances described in conditions 8.5and 8.12.

Sponsor means the entity that is responsible for the payment of a Sponsored Student’s application
fees, Deposit and/or Tuition Fees in accordance with a sponsorship agreement between the Sponsor
and the Sponsored Student.

Sponsored Student means a Student whose application fees, Deposit and/or Tuition Fees are paid for
by a Sponsor.

Student means an international student enrolled in a course of study through the University who will
reside in Australia for the duration of the course of study. Student includes Commencing Students
and/or Continuing Students of the University.

Student Residential Accommodation Provider means a UTS Insearch approved third party, other
than a Homestay Provider, contracted by UTS Insearch to provide residential accommodation to the
Students.

Student Services and Amenities Fee (SSAF) means an amount that a higher education provider
requires a person enrolled, or seeking to enrol, to support the provision to students of amenities and
services not of an academic nature, regardless of whether the person chooses to use any of those
amenities and services.

Study Abroad Program means a period of study (up to one year) which may be undertaken at the
University by a student from a higher education institution outside Australia and that may be counted
towards the requirements for an award at their home institution.

Study Abroad Program Fee means the fee payable by a Study Abroad Student described in condition

Study Abroad Student means a Student enrolled in a Study Abroad Program.

Third Party Provider means an organisation or service approved by UTS Insearch to provide all or
part of any welfare, accommodation and support arrangements on behalf of UTS.

Tuition Fees means the fees payable by a Student for each Session and may include any applicable
Study Abroad Fees.

University means the University of Technology Sydney.

UTS Insearch (for the purpose of this Protocol) means UTS’s partner provider UTS Insearch Limited
that arranges, monitors and manages the accommodation and welfare arrangements on behalf of UTS
for students under 18 years of age.

Welfare Provider means a UTS Insearch approved third party contracted by UTS Insearch to provide
welfare and support services to the Students.

1. APPLICATION FEES
1.1. There is a non-refundable application fee for all applications for full-award courses except
where otherwise authorised by the Director, UTS International
1.2. There is no application fee for Study Abroad Programs and Higher Degree by Research (HDR)
programs.
1.3. There is a non-refundable administration fee for UTS packaged courses except where
otherwise authorised by the Director, UTS International.

2. DEPOSIT FOR ACCEPTANCE OF AN OFFER


2.1. Acceptance of an offer of enrolment into a course of study will be completed once the
University has:
2.1.1. Received a valid and signed Acceptance Form;
2.1.2. Received full payment of the Deposit; and
2.1.3. Assessed that the student has met GTE/ GS requirements.
2.2. The amount of the Deposit will be specified in the Letter of Offer.
2.3. The Deposit will not be accepted from a Student or otherwise processed until a valid and
signed Acceptance Form is received from the Student.
2.4. The Deposit amount will be credited towards the Student’s first Session Tuition Fees. If Tuition
Fees are more than the Deposit amount then the balance is required to be paid by the due
date in the Student’s first Session.
2.5. If a Commencing Student defers commencement or changes a course of study, the Deposit
will be retained by the University. Any credit balance of the Deposit will be carried forward and
credited towards the Student’s next Session Tuition Fees or towards the fees of the new
course. Students are liable for any fee differences as a result of deferring or transferring their
course.

Exceptions
Non-Student-Visa Holders
2.6 Students who provide a certified copy of a temporary resident visa (including bridging visas and
temporary business visas with no study restrictions) permitting them to study in Australia for at
least the first Session of their course are not required to pay a Deposit to accept their offer.
First Session Tuition Fees must be paid by the due date. Non-Student-Visa Holders who do not
provide a certified copy of their visa must pay the full Deposit in accordance with condition 2.1
above.

Sponsored Students
2.7 Sponsored Students who provide a financial guarantee from their Sponsor that is acceptable to
UTS at the time of acceptance of an offer for enrolment at the University are not required to pay
a Deposit to accept their offer. Sponsored Students who do not provide a guarantee must pay
the full Deposit in accordance with condition 2.1 above.

3. OVERSEAS STUDENT HEALTH COVER (OSHC)


3.1. It is the Student’s responsibility to purchase and maintain valid OSHC for themselves and any
dependents while in Australia on a student visa for the full/entire duration of their student visa.

4. STUDENT SERVICES AND AMENITIES FEE (SSAF)


4.1. The SSAF is invoiced each Autumn session and Spring session and must be paid by the due
date, which will be after the census date in each Autumn session and Spring session.
4.2. The SSAF is indexed each academic year.
4.3. UTS reserves the right to vary the method of charging the SSAF.

5. ACCOMMODATION AND WELFARE LEVY


5.1. The amount of the Accommodation and Welfare Levy will be specified in the Letter of Offer.
5.2. The Accommodation and Welfare Levy will not be processed until a valid and signed
Acceptance Form is received.
5.3. The Accommodation and Welfare Levy is subject to annual increase, as determined by UTS.

6. TUITION FEES
6.1. Tuition Fees must be paid in advance for each Session.
6.2. A student may choose to pay more than 50 per cent of their Tuition Fees before their course
commences.
6.3. Tuition Fees are liable to increase at the commencement of each academic year. For students
who commenced in a course between 2016 to 2018, the fee increases will be as follows:
Students in a postgraduate coursework program: increase of no more than 5% per year for no
more than 3 years post Original Cohort Year. Students in undergraduate programs: increase
of no more than 5% per year for no more than 5 years post Original Cohort Year. For students
commencing in a course in 2019 and beyond, the fee increases will range each year from 4%
to 7% respectively.
6.4. For any students that change courses via an internal course transfer, clause 2.5 above will
apply.
6.5. All fee payments must be made in Australian dollars.
6.6. Credit balances of Tuition Fees will automatically be carried forward to the next Session.
6.7. Under UTS Student Rule 4.4.1, Students who do not pay Tuition Fees by the due date may
have sanctions imposed upon them including the cancellation of their enrolment and
consequent notification to the Department of Home Affairs.
Full-degree coursework Tuition Fees
6.8. Tuition Fees are charged for each enrolled subject and are determined by the credit point
value of the subject and the course of study in which the Student is enrolled.
6.9. When a Student enrols in a subject the Tuition Fee for that subject will be charged to the
Student and must be paid by the due date for that Session.
6.10. A Student’s final Tuition Fee liability for each Session is determined by the amount of subjects
in which the Student is enrolled at the Census Date for that Session.

Study Abroad Program Fees


6.11. Study Abroad Students are charged a Study Abroad Program Fee for each Session, which
covers an enrolment of up to 24 Credit Points for that Session. If a Study Abroad Student
enrols in more than 24 Credit Points in one Session, the Study Abroad Student will also be
charged Tuition Fees for each additional subject.

Research Student Tuition Fees


6.12. Tuition fees for postgraduate research degrees are charged on a pro-rata basis, based on the
number of days that the student is enrolled in each research degree session and whether the
student is enrolled after the research census date. Autumn session is from 1 January to 30
June. Spring session is from 1 July to 31 December. Tuition fees will be calculated as the

number of days of candidature/number of days in research degree session x 0.5 annual


tuition fee rate. This daily rate calculation applies only up until the research census date. Full
tuition fees will be incurred if the student remains enrolled past the relevant research Census
date.

6.13. Students enrolled in research courses part-time are charged 50% of the relevant full-time
Tuition Fee.
Tuition Fees for Sponsored Students
6.14. The University will charge a Sponsor directly for each Session in which the Sponsored
Student is enrolled in accordance with the Sponsored Student’s sponsorship agreement.
6.15. In accordance with UTS Student Rules 4.2.3, the Sponsored Student remains liable for the
payment of any outstanding Tuition Fees if the Sponsor does not forward payment to the
University by the due date for a Session.

7. TUITION PROTECTIVE SERVICE (TPS)


7.1. International students are protected by a Tuition Protection Service under Australian
Government legislation. This legislation sets out what happens when a registered provider or
an overseas student or intending overseas student defaults (that is, when a provider fails to
start or finish providing a course to a student, or a student fails to start or finish a course with a
provider). The TPS ensures that students have the option to either complete their studies in
another course or with another provider or receive a refund of their unspent Tuition Fees. For
more information students can refer to the TPS website at: https://tps.gov.au.

8. REFUNDS
A. Tuition Fees

Refund of Deposit for Commencing Students


Refunds where a course cannot be delivered (Provider Default)
8.1. After a Commencing Student has accepted an offer of enrolment at the University, if:
• UTS fails to start providing the course to the student at the location on the agreed starting
day; or
• after the course starts but before it is completed, it ceases to be provided to the student at
the location; and the student has not withdrawn from the course before the default day.
UTS will refund any Tuition Fees paid by the Commencing Student within 14 days of default.
8.2. Alternatively, a Commencing Student may be made an offer by the University to enrol in an
alternative course for a cost no greater than the cost of the originally offered course of study.
Refunds where a Commencing Student withdraws from a course (Student Default)
8.3. Where a Commencing Student withdraws from a course during the Commencing Student’s
first Session, the Commencing Student is entitled to a partial refund of any Deposit paid. The
amount of the Deposit retained by the University is determined by reference to the date at
which the Commencing Student withdraws, as follows:

i. Prior to the Commencement Date: the University will retain an amount equal to 10% of
the Deposit.
ii. On or after the Commencement Date but on or before the Census Date, the University
will retain an amount equal to 40% of the Deposit.
iii. After the Census Date, the University will retain the entire Deposit.
8.4. For a Non-Student-Visa Holder who is a Commencing Student and who did not pay a Deposit,
the Tuition Fees paid for the first Session will be considered a Deposit for the purposes of this
Protocol and will be refunded in accordance with condition 8.3 above.
8.5. An application for a refund of the Deposit by a Commencing Student must be made in writing
directly to the Director, UTS International or the Director of Graduate Research School for
HDR students.
i. Where a Commencing Student applies for a refund of the Deposit without making an
appeal for Special Circumstances, the refund will be assessed by the Compliance
Team and approved or rejected by the Manager, Admissions. For HDR students, the
refund will be assessed by the Manager, Research Growth and Capacity.
ii. Where a Commencing Student applies for a refund of the Deposit and makes an
appeal for Special Circumstances, the decision will be made by the Director, UTS
International or the Director of Graduate Research School for HDR students. Special
Circumstances may include, but are not limited to:
a. A Commencing Student’s application for a student visa is refused;
b. Serious illness or misadventure, or other compassionate grounds such as
death in the immediate family; and/or
c. Political, civil or natural events in the Student’s home country, which could
compromise the Student’s ability to commence the course.
8.6. Any refunds will be paid to a Commencing Student. If the Commencing Student wishes the
payment to be made to a third party, the Commencing Student must provide evidence that the
initial payment was made by that third party. If requested, UTS may pay the refund to another
Australian institution if the student is released by UTS to that institution.
8.7. Approved refunds will be paid to the Commencing Student in the Commencing Student’s
home country unless the Commencing Student can demonstrate grounds for the refund to be
made in Australia. Such grounds may include:
i. The Commencing Student is released by UTS to another Australian education
institution (copy of letter of offer) from the other institution must be provided);
ii. The Commencing Student has obtained or applied for another kind of visa to remain in
Australia (copy of visa or application must be provided); and/or
iii. The Commencing Student has a fee credit, due to overpayment, for the session.
8.8. Refunds to a Commencing Student will be paid to the Commencing Student within four weeks
of the date of receipt of their completed application for a refund.
No refund of Deposit for Commencing Students
8.9. A Commencing Student will not be entitled to a refund of the Deposit where:
i. an offer of enrolment is withdrawn by the University because the Commencing
Student has breached the terms and conditions of their application or Letter of Offer,
including through the provision of fraudulent or misleading documents or information

to UTS, to a UTS student recruitment agent or to the Department of Home Affairs,


regardless of whether the application for student visa is refused; or
ii. the University refuses to provide, or continue providing, the course to the
Commencing Student because of one or more of the following events:
a. the Commencing Student failed to pay an amount he or she was liable to pay
the University, directly or indirectly, in order to undertake the course;
b. the Commencing Student breached a term of his or her student visa; and/or
c. the outcome of a student misconduct review including any appeal processes
(as defined in the UTS Student Rules at Rule 16.2).

Refund of Tuition Fees for Continuing Students


8.10. Where a Continuing Student withdraws from a course on or before the Census Date of a
Session, they are entitled to a refund of all Tuition Fees paid for that Session, excluding the
Deposit amount paid which is refunded in accordance with conditions 8.3and 8.5 above.
8.11. An application for a refund of Tuition Fees by a Continuing Student must be made in writing
directly to the Student Administration Unit.
8.12. A Continuing Student may apply for a full refund of Tuition Fees where they have withdrawn
from a course due to Special Circumstances. Special Circumstances include, but are not
limited to:
i. A Continuing Student’s application for a student visa is refused;
ii. Serious illness or misadventure, or other compassionate grounds such as death in the
immediate family;
iii. Political, civil or natural events in the student’s home country, which prevent full
payment of fees; and/or
iv. Where a Continuing Student is excluded from their course of study and has already
paid fees for the first Session of their period of exclusion.
8.13. Refunds to a Continuing Student will be paid to the Continuing Student within four weeks of
the date of receipt of their completed application for a refund.
8.14. Any refunds will be paid to a Continuing Student. If the Continuing Student wishes the
payment to be made to a third party, the Continuing Student must provide evidence that the
initial payment was made by that third party. If requested, UTS may pay the refund to another
Australian institution if the student is released by UTS to that institution. Refunds will be paid
to the Continuing Student in the Continuing Student’s home country unless the Continuing
Student can demonstrate grounds for the refund to be made in Australia. Such grounds may
include:
i. The Continuing Student has enrolled in a course at another Australian education
institution (copy of letter of offer from the other institution must be provided); and/or
ii. The Continuing Student has obtained or applied for another kind of visa to remain in
Australia (copy of visa or application must be provided).
iii. The Continuing Student has a fee credit, due to overpayment, for the session.

8.15. A Continuing Student will not be entitled to a refund of Tuition Fees where the University
refuses to provide, or continue providing, the course to the Continuing Student because of

i. the Continuing Student failed to pay an amount he or she was liable to pay the
University, directly or indirectly, in order to undertake the course;
ii. the Continuing Student breached a term of his or her student visa
iii. the outcome of a student misconduct review including any appeal processes (as
defined in the UTS Student Rules at Rule 16.2).
8.16. A Continuing Student will not be entitled to a refund of Tuition Fees if the student withdraws
after the Census Date.

B. Other fees
Refund of Overseas Student Health Cover (OSHC) fees
8.17. International Students who qualify for an OSHC refund should contact their OSHC provider or
UTS (if organised via UTS).
Refund of the Student Services and Amenities Fee (SSAF)
8.18. The SSAF for a given Session is only refundable if a Student has paid and withdraws prior to
the Census Date in that Session.
Refund of Accommodation and Welfare Levy
8.19. The University will retain the entire Accommodation and Welfare Levy except in the following
circumstances listed below.
8.20. The airport pickup fee is fully refundable only where a Student has paid and:
i. A Student’s application for a student visa is refused and the student provides UTS at least
two (2) business days written notice prior to the scheduled pick up; or
ii. Where a Student cancels their accommodation and welfare arrangements and provides
UTS with written notice at least two (2) business days’ prior to the scheduled pick up time
from the airport; or
iii. UTS Insearch is unable to provide the airport pickup service.
8.21. The UTS Insearch administration fee is fully refundable only where a Student has paid and:
i. A Student’s application for a student visa is refused; or
ii. A Student is granted a student visa, does not arrive onshore , cancels their
accommodation and welfare arrangements and provides UTS with written notice at least
two (2) business days’ prior to the start date listed on their CAAW letter.
8.22. The Homestay booking fee and Homestay accommodation charge is fully refundable only
where a Student has paid and:
i. A Student’s application for a student visa is refused; or
ii. UTS Insearch is unable to provide Homestay accommodation services; or
iii. UTS cancels the course for which the Student is admitted and withdraws the offer
resulting in Homestay accommodation services no longer being required.

8.23. The Homestay accommodation fee, but not the Homestay booking fee is fully refundable
when written notice of cancellation of Homestay accommodation services is given at least
twenty eight (28) calendar days prior to the agreed start date of services;

8.24. The special diet surcharge is fully refundable only where a Student has paid and:
i. A Student’s application for a student visa is refused; or
ii. The Homestay host is unable to provide the requested dietary requirements; or
iii. Where a Student provides UTS with written notice at least two (2) business days’ prior to
the start date listed on their CAAW letter.
8.25. Where a Student applies for a refund of the Accommodation and Welfare Levy and makes an
appeal for Special Circumstances, the decision will be made on a case by case basis by the
Director, UTS International. Refer to clause 8.5.
8.26. For refunds of fees relevant to accommodation and welfare services other than the
Accommodation and Welfare Levy, students must contact the UTS Insearch Third Party
Provider with whom they have a signed agreement.

9. STUDENTS WHO OBTAIN PERMANENT RESIDENCY


9.1. Students who obtain permanent residency before Census Date are no longer considered
international students and this Protocol no longer applies to them. Terms and conditions for
fees and refunds for students who obtain permanent residency are covered on the UTS
website at https://www.uts.edu.au/future-students/international/essential-information/being-
international-student-australia/permanent and section 4 of the UTS Student Rules.
9.2. Students who are granted permanent residency in Australia after enrolment become liable to
pay the domestic fee-paying undergraduate or postgraduate Tuition Fees applicable to their
course, rather than international Tuition Fees. Students will only receive a Commonwealth
Supported Place by applying for admission via the Universities Admission Centre.
9.3. Students who obtain permanent residency after Census Date are considered an international
student for the rest of that session.

10.APPEAL AND GRIEVANCE PROVISIONS


10.1. Students who are dissatisfied with an outcome relevant to this Protocol may refer to the UTS
Handling Student Complaints Policy and the UTSI Complaints and Appeals Procedure and/or
may seek assistance from the UTS Student Ombuds Office.
10.2. This Protocol, the UTS Handling Student Complaints Policy, and the right to make complaints
and seek appeals of decisions and action under various processes, does not affect the rights
of the student to take action under Australian Consumer Law.

UTS Release Protocol


1. Background
The UTS Release Protocol is aligned with the legislative requirements of Standard 7 in the
National Code of Practice for Providers of Education and Training to Overseas Students 2018
made under s33(1) of the Education Services for Overseas Students (ESOS) Act 2000 (Cth). The
Protocol also addresses UTS’s obligations under the Simplified Student Visa Framework (SSVF).

2. Purpose of the Protocol


The purpose of this Protocol is to set out the guidelines and procedures that govern how UTS will
assess requests by international students for a transfer to another CRICOS Registered Provider
prior to the completion of the Restricted Period and the appeal procedure that applies if a student
request is refused. The Protocol applies to all UTS international students and pa ckaged pathway
students where UTS is the principal provider of their course. The Student must remain enrolled in
his or her course until the release request is determined. A release application is determined once
a release outcome is provided and any related appeals process is completed.

3. Definitions
For the purposes of this Protocol, the following definitions apply:
AQF means Australian Qualifications Framework.
CoE means a confirmation of enrolment.
CRICOS means the Commonwealth Register of Institutions and Courses for Overseas Students.
GS means a person who satisfies the genuine student criteria and intends to obtain a successful
educational outcome and has the language, educational and material background to have a
reasonable chance of achieving this educational outcome.
GTE means a person who satisfies the genuine temporary entrant criterion for a student visa
application as administered by the Department of Home Affairs. For further information, visit the
Department of Home Affairs website (www.homeaffairs.gov.au/ ).
Guardian means a person who has responsibility for the long-term welfare of the child and has all
the powers, rights and duties that are vested by law or custom in the guardian of the child. (see:
Reg 1.03 of the Migration Regulations 1994)
National Code means the National Code of Practice for Providers of Education and Training to
Overseas Students 2018 made under s33(1) of the Education Services for Overseas Students Act
2000 (Cth).
Principal Course means the main course of study undertaken by a student where the student has
received a CoE from UTS to undertake multiple courses. The Principal Course is the final course in
a package of courses.

Registered Provider means a provider approved to deliver a course to overseas students under
the Education Services for Overseas Students Act 2000 (Cth).
Restricted Period means the first six (6) calendar months from the date a student commences
their Principal Course of study.
SSVF means the simplified student visa processing framework established by the Department of
Home Affairs and designed to make the process of applying for a student visa simpler to navigate
for Genuine Students. See www.homeaffairs.gov.au/.
TEQSA means Tertiary Education Quality and Standards Agency.

Valid Letter of Offer means the following criteria are met:


a) Unconditional offer (i.e. no pending/restricted entry requirements)
b) Issued by a CRICOS registered provider for a CRICOS registered course
c) Is of the same AQF level as the student’s original principal course. For a package of
courses, the final course in that package must be of the same or higher AQF level.
d) Current and valid from the date of issue.
e) The gap of the new commencing program must meet requirements.

4. Transfer to another provider


In accordance with the National Code, an international student who has not completed six calendar
months of his or her Principal Course at UTS and who wishes to transfer to another C RICOS
provider in Australia must be approved for release by UTS, unless:
a) the student is government sponsored and the government sponsor provides written
support for the transfer as it considers the change to be in the student’s best interests;
or

b) the course for which the student received a CoE is no longer registered on CRICOS or
UTS ceases to be a Registered Provider; or

c) UTS has had a sanction imposed on its registration by TEQSA that prevents the
student from continuing his or her course at UTS.

Students under the age of 18 who wish to transfer providers must apply to UTS for the release and
provide written permission from their parent/ guardian. Where UTS approves the release and is the
nominated welfare and accommodation provider, UTS will negotiate the transfer date for welfare
arrangements with the new registered provider to ensure there is no gap.

In addition, UTS will inform students under 18 of their visa obligation to maintain their current
welfare arrangements until the transfer date, or have alternate welfare arrangements approved by
the new provider or the Department of Home Affairs or return to their home country until the new
approved welfare arrangements take effect.

5. Assessing a Release Request


5.1. UTS will not automatically grant a release. UTS will consider applications for transfer in
the context that students may have been assessed as a GS and GTE for the purposes of
obtaining a student visa under SSVF arrangements and that they have made an informed
decision to undertake a course at UTS and any preliminary courses packaged with it.

5.2. UTS assumes that a student’s decision was based on the availability of extensive course
and general information and that students have taken into account relevant factors
including family circumstances, study and career goals, other course options within
Australia, location and costs.

6. Applying for a Release


6.1. An application for a release must be made to UTS International or the Graduate Research
School for Higher Degree Research students. The application must:

a) be made in writing on the approved form (“Application for Release - International


Students”)
b) provide a statement of reasons (satisfactory to UTS) for the release request,
c) provide documentation (satisfactory to UTS) supporting the reasons for the release
request;
d) if packaged with accredited pathway providers ( for example, Insearch or TAFE NSW):
i. Where a student’s study is incomplete at the pathway provider, confirm that
the pathway provider has granted release.
ii. Where part of a package of courses is completed, provide a course
completion letter and official academic transcript issued by the pathway
provider.
e) provide a Valid Letter of Offer.
f) if under the age of 18, include a copy of written approval from a parent or guardian
supporting the transfer;
g) If under the age of 18 and not cared for in Australia by a parent or suitable nominated
relative, provide evidence that another CRICOS Registered Provider confirms they
accept responsibility for approving accommodation, support and welfare
arrangements.

UTS will not commence assessment of a release application until all appropriate
information, as listed above, is provided.

6.2. UTS will assess and reply to the request for a release within ten (10) working days.

6.3. There is no cost associated with applying for a release from UTS.

6.4. The student must remain enrolled in his or her course until the final decision is determined.
A final decision is determined once a release outcome is provided to the student and any
related appeals process is completed.

7. Grounds for Approval


UTS may grant a release where it is satisfied, in its absolute discretion that continuing the course
at UTS is not in the student’s best academic interest or there are special circumstances in favour of
the student moving to another provider including but not limited to:
a) the student had a conditional offer from UTS and in spite of the student’s best
endeavours the student did not meet its conditions; or
b) misadventure, or other compelling or compassionate grounds (e.g. events beyond the
student’s control which would have an adverse impact on their ability to continue); or

c) protracted political or civil events or a natural catastrophe in their home country, the
effects of which prevent full payment of fees; or
d) the student will be reported to the Department of Home Affairs because they are
unable to achieve satisfactory course progress at the AQF level they are studying,
even after engaging with the UTS intervention strategy; or
e) UTS is unable to deliver the course as outlined in the letter of offer and acceptance
form; or
f) there is evidence that the student’s reasonable expectations about their current course
are not being met; or
g) there is documented evidence that the student was misled by UTS or an UTS
authorised agent regarding UTS or its course and therefore the course is unsuitable to
their needs and/or study objectives; or
h) an appeal (internal or external) on another matter results in a decision or
recommendation to release the student.

8. Grounds for Refusal


UTS may, in its absolute discretion, refuse a student’s transfer request. Reasonable grounds for
refusal include but are not limited to:
a) the request for transfer is made where a student has not commenced study; or
b) if under the age of 18, the student has not provided a copy of written approval from a
parent or guardian supporting the transfer; or
c) if under the age of 18 and not cared for in Australia by a parent or suitable nominated
relative, has not provided evidence that another CRICOS Registered Provider confirms
they accept responsibility for approving accommodation, support and welfare
arrangements; or
d) the student has a packaged conditional offer and the request is not supported by the
pathway provider; or
e) if government sponsored, the government sponsor has not provided written support for
the transfer; or
f) failure to provide a complete application as required under clause 6.1 of this Protocol;
or
g) the student’s actions have caused UTS to form the view that the student is not a GS or
GTE (e.g. absence from orientation events, low attendance rate, failure to access
support services, radical change in academic direction); or
h) the student has been excluded or suspended from their course or has outstanding
debts or fines with UTS; or
i) UTS has formed the view that the student is trying to avoid being reported to the
Department of Home Affairs for failure to meet UTS’s attendance or academic
progress requirements; or
j) the student applies to transfer from a UTS course/package to a course/package that is
at a lower AQF level for which the original visa was issued; or
k) there are reasonable grounds for UTS forming the view that the student is trying to
manipulate the SSVF system; or
l) there are reasonable grounds for UTS forming the view that the transfer will be
detrimental to the student’s welfare or future studies (e.g. transfer may jeopardise the
student’s progression through a package of courses); or

m) the student has not utilised the full range of support services available at UTS and/ or
a UTS pathway provider to assist with academic and personal issues; or
n) change of mind, claims of financial hardship, transferring to another provider with lower
tuition fees; or
o) the student is not genuinely engaging with an intervention strategy with the intention of
failing and being released.

Note: UTS reserves the right to take into consideration other factors, including the
individual circumstances of a student, which may not have been specified above.

9. UTS Response to Request


9.1. If UTS refuses a student’s request for a release, it will provide the stud ent with a written
explanation setting out the reasons why the request was refused and the process to
appeal the decision.
9.2. If UTS grants a release, the student will be advised to contact the Department of Home
Affairs to ascertain whether a new student visa is required.
9.3. If UTS grants a release, the student’s UTS CoE will be cancelled and the student must
withdraw from their UTS course.
9.4. If the student is applying for a refund, the student must do so in accordance with the
Refund Protocol accessed at: www.uts.edu.au/future-students/international/essential-
information/fees-information/protocol-fees-refunds

10. Appeals against Refusal


10.1. If UTS refuses a request for release, the student has a right of appeal against UTS’s
decision in accordance with Standard 10 of the National Code. An appeal must be made
within twenty (20) working days in the first instance in writing to the Director, UTS
International or the Director Graduate Research School for Higher Degree Research
students.
10.2. A student must remain enrolled until the full internal appeal process is finalised.
10.3. If an appeal to the Director, UTS International or to the Director of Graduate Research
School in case of Higher Degree Research students is unsuccessful then students may
access the internal UTS review process by referring their case to the UTS Student
Complaints Resolution Office (SCRO).

10.5. UTS will not finalise a student’s refusal status in PRISMS until the appeal finds in favour
of UTS or the student has not appealed within the twenty (20) working day period, or the
student withdraws their appeal.

11. PRISMS
Once the final release outcome is determined, the release request will be recorded in PRISMS;
including the outcome of the release request, reasons for the outcome and date of effect.

12. Student Support Services


Prior to applying for a release, students should contact UTS International or the Graduate
Research School for assistance with accessing appropriate UTS support services.

4. Cover start date: The date you will arrive in Australia. This should be the Orientation date
(date you are likely to be permitted to arrive in Australia) noted on your ‘Offer Summary’
section of your Offer letter, as shown below.

5. Expected course completion date: This should be the Course finish date noted on your ‘Offer
Summary’ section of your Offer letter, as shown below.

Please note below is only a SAMPLE Offer Summary, you must check your own offer letter to get the
correct dates.

Your Visa End Date will be calculated for you. To ensure your visa is granted for the correct duration

6. If you leave the country before the end of your OSHC policy, you can contact Medibank directly to
enquire about a refund for the unused portion.

grace period given on your visa

10. On the “Join” page please enter your details as they appear on your passport. The system may
not accept foreign characters. (example: Jesús Ponce de León reads incorrectly as JesÃos
Ponce de LeÃ'n).

11. After entering your personal details you will see the “Declaration” section below. Please read the
declaration carefully before purchasing OSHC. Ensure that you are aware of your coverage
details, as well as any exclusions under this policy. Once you have ticked the box reading I am
the applicant and I have read, and agreed to, the above declaration select your payment
preference.

13. Finished! You will be emailed your Policy Certificate from Medibank within 48 hours. If you have
not received an email from Medibank, please check your Junk Mail and contact
oshc@medibank.com.au if you encounter any problems. This is required as evidence for your
visa application.
